Moved by Justice Clark; seconded by Justice Tuthill: RESOLVED::Thatthe minutes of November 25, 1958, be and hereby are duly approved as read. GRABIE for an Open Development Area under the provisions of Section 280A of th e Town Law, NOW, THEREFORE, BE IT RESOLVED: That the Town Clerk of the Town of Southold be and he hereby is directed to transmit this applic- ation to th~Planning Board in accordance with Section 901, Subdiv- ision C of~rticle IX of the Building Zone Ordinance of the Town of Southoldl The Town Board recommended that the highway be fifty feet in width. Moved by Justice Clark; seconded by Councilman Demarest: WHEREAS, the Town Board of the Town of Southold, by resolution thereof duly adopted on the 7th day of September, 1954, authorized the acquisition from the United States Governmemt of an airport or landimg field kmown as "Elimabeth Field" and appurtenances,.at~ Fishers Island, in the Town of Southold, Suffolk County, New.York, and a certain pier, buildings and land fronting on Silver Eel Cove, Fort H. G. Wright, Fishers Island, New York, and - WHEREAS, anapplication for the acquisition of said property~ ~ dated September 9, 1954, was filed, with the General Services .... Administrationof the United States Government, and~ WHEREAS, the terms and condition and the property to be included in such acquisition have been changed since the filing of said app lication, NOW, THEREFORE, BE IT RESOLVED: that EXHIBIT 1 of Laid application be and the same hereby.is amended by changing the description of the property to be acquired by the Town of Southold by'excluding there- from the battery emplacement located atthe northeasterly boundary .of the premises to be conveyed for airport purposes. The revised description of said premises being shown on a map entitled "Plan of Fort H. G~ Wright Reservation showing land sub-division, Fishers Island, N.Y." by Chandler &~Palmer, Engineers, Norwich, Conn., dated February 7, 1955, revised February 21, 1956 and further revised February 21,~1957, and described as follows: . Subject to the terms and conditions of the application, the prop erty described in Exhibit 1 shall be conveyed, together with riparian rights, if any, and subject to the following exceptions, res- ervations and encumbrances: 1. Excepting therefrom the salt-water distribution system, the fresh-water distribution system, the electric distribution system,. the~'sanitary sewer system, and all telephone and other communic- ation lines serving the Fort H. G. Wright Installation, including the airport area. 2. Reserving the right of ingress and egress for the purpose of maintaining, repairing and removing of the storm warning tower and equipment located on the easterly boundary of the premises to be conveyed for airport use, near Prospect Road, 3. ReServing the right to berth in Silver Eel Cove and the right to use the docks or piers of the premises to be conveyed for air- port use, without any charge or expense. 4. Reserving the right to use in co~m~on with others for roadway and ~highway purposes, Whistler Avenue, TrumbulI Drive, and North Military Road, also known as Greenwood Road, until such time as the same are dedicated for public road and highway purposes. 5~-Reserving an easement for ingress and egress to and from the ~remiSes occupied by the United States of America in, on, over and through Tyler Lane and any avenue, street, road or lane run- ning-around the cove and docking area which may be included in the premises to be conveyed as airport property. 6. Easements forthe maintenances and repair of the water, electric, tele~hone and other co~m.unication linees and sewer lines, and easements for ingress and egress for such purposes to be granted to Race Point Corporation. 7. Existing easements for public roads and ~ighways, public utilities, pipelines, drainage and sewer mains affecting the premises. 8. Terms, provisions, conditions, covenants and restrictions contained in instruments of record. 9. Lease NYDRE (M)-3847 to Fishers Island Telephone Corporation, Fishers Island, NewYork, terminating July 2, 1959, leasing~ certain property for co~m~unication purposes and for the install- ation of one pair ~f~telephone conductors,~encasedin cable.. extending approximately 2,000 feet from the main gate,. Fort H.G. Wright, along Whistler Avenue to Building No. '116 at said ~ilit~ry reser~tiom, together with the right to lay and maintain ~one line~djacent to South Military Road on said reser~a~i0~, a distance of approsimately 550 feet from said Building No..l16 to Building No. 254 and further, the right to install and main- tain a telephone on the outside of wall of Building N~. 254. 10. Rights of part~es in possession of property, or rights of parties under the following leases, licenses or permits~ ail of which shall be terminated by the Government on the date .off,he airport conveyance: a) Lease No. DA-30-075-ENG-8751 dated October 27, 1958 to Board of Education, Fishers Island High School, Fishers Island, New York, leasing for educational purposes Building No. 62 located on the premises to be conveyed for airport use, Fort H. G. Wright Fishers Island, New York, together with the nonexclusive use of existing parking facilities adjacent to said building for ~a pe~ios of one year, ending July 5, 1959. b) License No. DA-30-075-ENG-8753 dated October 7, 1958~-to Fishers Island Ferry District, Fishers Island, New York, permitting the nonexclusive use of a parcel of land for ferry operations fronting on Silver Eel Cove, together with Buildings Nos. 5.0 ~and T-397 and including the non-exclusive use of certain accessroads to the property for a period of one year, ending September 30,..1959. c) Lease No. NYDRE (M)-3712 dated February 25, 1958 to the Town of Southold, Greenport, Long Island, New York covering the airfield, ~¢luding Hangar Building No. 254 and Buildings Nos. T-365 and 127 for a period of hoe year, ending December 31, 1958. d) Permit No. GS-o2B-3268 (d) dated May 17, 1956 to the Town of Southold to enter, occupy and use Building No. 239 for airport use. 11. Rights of the Race Point Corporation to use, occupy and main- tain Buildings F-3 and F-3A for telephone and other communication purposes, and Buildings 208 and T-382 for sewage purposes, situatated south of Whistler Avenue near the easterly boundary of the premises to be conveyed for airport use, near Prospect Road. 12. It is understood that on or before the conveyance of the a%r- port property to the Town of Southold, the Town Shall furni~h~ General Services Administrations appropriate evidence in the form of a license, permit or other agreement, authorizing the Department of the Navy, on terms and conditions satisfactory to said~Department to use Battery Station 215 (F-1 and lA), together with the right of access thereto over existing roads, and the right to maintain, operate, repair, replace or remove a cable right-of-Way as shown~ on Property Survey, Battery 215, dated October 24, 1955 and Drawing No. 768151, dated January 31, 1957. BE IT FURTHER RESOLVED, that the said application dated Septem- ber 9, 1954 as amended and revised by this resolution be and the same is hereby ratified and that Supervisor Norman E. Klipp be and he hereby is authorized and directed to execute any and all documents .required to consumate the acquisition of said property. SACKS requesting a change, modification and ~mendment of the Building Zone Ordinance includ- ing the Building Zone Maps made a part thereof by changing from "~' Residential and Agricultural District to "B" Business District the property described in said petition, and WHEREAS, said petition was duly referred to t~e Plan~ing Board for its investigation, reco~m-aendation and report, and its report having been filed with the Town Board, and thereafter, a public hearing in relation to said petition having been duly held by the Town Board on the 25th day of November, 1958, and due deliberation having been had thereon NOW, THEREFORE, BE IT RESOLVED that the relief demanded in said petition be, and it hereby is denied. ~ote of Town Board: Ayes-Supervisor Klipp, Councilmen Albertson and Demarest; Justices ~uthill and Clark. Moved by Justice Clark; seconded by Councilman Demarest: WHEREAS, a petition was heretofore filed with the Town Board of the Town of Southold by KENNETH PAPISH requesting a change, modification and amendment of the Building Zone Ordinance including the Building Zone Maps made a part thereof by changing from '~A" Residential and Agricultural District to '~B" Business District the property described in said petition, and WHEREAS, said petition was duly referred to the Planning Board for its investigation, recommendation and report, and its report having been filed with the Town Board, and thereafter, a public hearing in relation to said petition having been duly held by the Town Board on the 25th day of November, 1958, and due delib- eration having been had thereon NOW, THEREFORE, BE IT 9£SOLVED: That the relief demanded in said petition be, and it hereby is denied.
