Appointment: · 7:00 p.m. - Erwin/Henske Open Land Project Presentation A 90-minute Open Land Project Solution presentation was conducted by John Erwin, Esq. and Tom Henske. Printed material was distributed to LPC members and reviewed. Committee members were encouraged to ask questions and answers were provided by Mr. Erwin and Mr. Henske. A Town committee had been formed by Supervisor Horton to research this concept further. Adoption of Meeting Minutes: · Adoption of minutes from September 28, 2004 and October 12, 2004 MOTION made by Craig Arm, seconded by Ray Huntington, to accept minutes of the September 28, 2004 and October 12, 2004 meetings. Motion carried 5/0. (Eric Keil absent from vote) Applications: · GRIGONIS PROPERTY (TPDR): SCTM #: 55-2-8.50 Location: Old North Rd, Southold Total Acreage: +11.2 acres PDR Acreage: +10.84 Zoned: A-C CPF: Yes Authorization to order appraisal. LPC decided to order appraisal on other Grigonis property (55-1-5.1) also, for discussion purposes. MOTION made by Craig Arm, seconded by Ray Huntington, to direct Melissa Spiro to commission an appraisal on the Grigonis property. Motion carried 4/0. (John Sepenoski abstained, Eric Keil absent from vote) DUBNER PROPERTY (TPDR): SCTM #: 84-4-6.1 Location: 3670 Cox Lane, Cutchogue Total Acreage: +52.93 acres PDR Acreage: +44 acres Zoned: AC CPF: Yes SCTM #: 84-1-8 Location: 24515 CR 48, Cutchogue Total Acreage: +23.33 acres PDR Acreage: +21 acres Zoned: AC CPF: Yes Update. Melissa gave update regarding meeting with Town Board at Town Board Work Session. Town Board approved revising the easement language so that it is in conformance with language required by State Ag & Markets. This will enable project to be eligible for grant ($1,350,000) from NYS Ag & Markets. An appraisal provided by Pipia's attorney. HOLD until more members present for discussion. PEARSON PROPERTY (TPDR): SCTM #: Location: Total Acreage: PDR Acreage: Zoned: CPF: 75-7-6.1 3258 South Harbor Rd, Southold +16.98 acres +14 acres A-C Reviewed application for PDR offer on all but "footprint" area of existing house and accessory structures. Discussed possibility scenic easements on waterfront if PDR area left out waterfront area. Melissa to explore scenic easement option for waterfront area. MOTION made by Craig Arm, seconded by Fred Lee, to direct Melissa Spiro to commission an appraisal on the Pearson property. Motion carried 5/0. (Eric Keil absent from vote) Inquiries: · CABERON PROPERTY: SCTM # 1000-109-6-15 Location: 765 (e/s) Case's Lane, Cutchogue Total Acreage: +7.1 acres Zoned: R-40 CPF: n/a SCTM # 1000-109-5-16.1 Location: 450 (s/s) Cedars Road, Cutchogue Total Acreage: +6.7 acres Zoned: A-C CPF: n/a Update on meeting with Town Board regarding inquiry for Town to purchase development rights. Majority of Town Board members were favorable to concept with thoughts that an easement be specific and require that golf course remain public or that parcel remains recreational. If landowner decides to proceed, Town/LPC will re-discuss specific requirements for purchase. · MATRICK/GANCARZ PROPERTIES: SCTM #: 95-4-12 Location: 19285 CR 48, Cutchogue Total Acreage: +6.55 acres PDR Acreage: Zoned: AC CPF: Yes SCTM #: 95-4-13 Location: 19155 CR 48, Cutchogue Total Acreage: +6.38 acres PDR Acreage: Zoned: AC CPF: Yes Discussed status. Property is for sale and listed with a real estate broker. No application has been requested by property owners. Request was made for LPC to commission an appraisal. LPC was not in favor of proceeding with appraisal since concept plan unknown at this time and also since request did not come from a contract vendee. General: · Status report of Melissa Spiro not available for this meeting. Informational: Fred Lee reported on his conversation with Mr. Rowehl regarding further interest in the preservation program. MOTION made by Ray Huntington, seconded by Michelle Zaloom, to direct Melissa Spiro to commission an updated appraisal on the Rowehl property. Motion carried 5/0. (Eric Keil absent from vote) Rudolph H. Bruer, Esq. had a meeting with Melissa Spiro regarding the Conway property on Hortons Lane in which the development rights had been sold to the Town in 1999. Mr. Bruer, as attorney for the Conway Estate, is questioning what can and can't be done to distribute the property between the heirs. (John Sepenoski recused himself) Next Regular Meeting: The next regular meeting will be held on Tuesday, November 9, 2004, in Conference Room, at 7:00 p.m. Craig Arm informed the committee that he will not be attending said meeting.
