T~leonone SO 5-2660 MINUTES SOUTHOLD TOWN BOARD OF APPEALS July 19, 1962 A regular meeting of the Southold Town Board of Appeals was held 7:30 P.M., Thursday, July 19, 1962 at the Town Office, Main Road, Southold, New York. There were present: Messrs. Robert W. Gillispie, Jr., Chairman, Robert Bergen, and Herbert Rosenberg. Absent: Messrs. Charles Grigonis, Jr., and Serge Doyen, Jr. PUBLIC PIEARING: Appeal No. 488 - 7:30 P.M. (E.D.S.T.), upon application of Valentine Ruch, and Jacob Van Dyke, Jr., private road and Route 27A, Southold, New York, for recognition of access in accordance with State of New York Town Law, Section 280A. Location of property: private road (Arshamomaque Colony Road), So~%hol~ New York, bounded north by H. A. Kotm, east by V. Ruch, south by I~ G. Pitman, and west by Arshamomaque Colony Road. Fee paid $5.00. Southold Town Board of Appeals -2- July 19, 1962 The Chairman opened the hearing by reading application for recognition of access, legal notice of hearing, affidavit attesting to its publication in the official newspaper and notification to the applicant. THE CHAIRMAN: Is there anyone present who wishes to speak for this application? RENSSELAER G. TERRY, JR., Southold, New York: I appear here for Mr. Ruch and Mr. Van D~ke and I think the application is self-explanatory. The nature of the area is such that we ~think the development has been quite an asset to -~the community. This is one of the vacant 75 ft. lots in the area and~Mr. Van Dyke would like to build a ~welling on it. We request your favorable consideration. THE CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response.) After investigation and inspection the Board finds that this lot is located in the midst of a development which has existed for about 40 years and is nearly entirely built up. The present p~ved private road is used by all residents and is kept in excellent condition. All of the conditions set forth in the Ordinance under the section applicable in this case have been met and provided this access road is kept in legal passable condition as it has been through the years this access should be granted. On motion of Mr. Gillispie~ seconded by Mr. Bergen, it was RESOLVED that Valentine Ruch and Jacob Van Dy~e, Jr. be granted recognition of access to a lot on private road (Arshamomaque CoLony Ro~d), Southold, New York. Lot bounded north by H. A. Kolm, east by V. Ruch, south by I. G. Pitman and west by Arshamomaque Colony Road. Vote of the Board: Ayes:- Mr. Gitlispie, Mr. Bergen, and Mr. Rosenberg. On motion of Mr. Gillispie, seconded by Mr. Rosenberg, it was RESOLVED that Lefferts Po Edson be granted a recess on the hearing of Appeal No. 484, Alexander W. Koke and Frederick C. Koke to 8:30 P.M.~ July 26, 1962. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen~ a~d Mr. Rosenberg. PUBLIC HEARING: Appeal No. 489 - 7:45 P.M. (E.D.S.T.), upon application of Estate of William H. Wasson, 120 Court Street, Riverhead, New York, for recognition of access in accordance with State of New York Town Law Section 280A. Location of property: south side Peconic Bay Boulevard, Laurel, New York, bounded northby other land of Wasson Estate~ east by land of Haley~ south by Peconic Bay, and west by land of Stalzer. Fee paid $5.00. (There was no response°) THE CHAIRMAN: Mr. O'Keeffe~ attor_~ey for the Wasson Estate has been in regardi~ this property before and I think we are all familiar with the situation. Southold Town Board of Appeals -4- July 19, 1962 (The Board discussed the property and decided the access should be 15 ft. in width. Mr. Terry, the Building Inspector advised that Mr. O'Keeffe had stated to him that a 15 ft. access would be agreeable to him.) THE CHAIRMAN: Is there anyone present who wishes to speak against this applicatiDn? (There was no response. ) This application is for access to a lot approximately 178 ft. Bay frontage, 148 ft. wide at the northerly end and approximately 310 ft. on the westerly boundary and 226 ft. on the easterly boundary. There is at the present time a paved roadway leading from Peconic Bay Boulevard to this improved property. After investigation and inspection the Board finds that the conditions set forth in the Ordinance in respect to this appli- cation have been fully complied with. This aceess road must be maintained in a legal passable condition to a widt~ not less than 15 fto On motion of Mr. Gillispie, seconded by Mr. Bergen, it was RESOLVED that the Estate of William H. Wasson be granted recognition of access to a lot on the south side Peconic Bay Boulevard, Laurel, New York. This access road must be maintained in a legal passable condition to a width not less than 15 ft. Vote of the Board: Ayes:- Mr. Gillispie~ Mr. Bergen, and Mr. Rosenberg. PUBLIC PBM. ARING: Appeal No. 487 - 8:15 P.M. (E.D.S.T.), upon application of Karl and Peter Sledjeski, Main Road, Orient~ New York, for a special exception in accordance with the Zoning Ordinance, Article Xt Section 1003a, for permissic~ to enlarge existing labor camp facilities. Location of property: south side Route 25, Orient, New York, bounded north by Main Road, east by J. B. Droskoski, south by J. Tuthitl & J. Dyer, and west by J. Tuthill & J. Dyer. Fee paid $5.00. There being no one present to speak for or against this application the Board on motion of Mr. Gillispie, seconded by Mr. Rosenberg RESOLVED that Appeal No. 487, application of Karl and Peter Sledjeski be recessed to 8:15 P.M., Thursday, July 26, 1962, Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, and Mr. Rosenberg. Kenneth Tabor, Orchard Street~ Orient, New York, ~r a special exeeption in accordance with the Zoning Ordinance, Article X, Section 1003A~ for permission to enlarge existing labor~mp facilities. Location of property: s/s ~rchard Street, Orient, New York, bounded north by Orchard Street, south by Percy Douglass, east byE. K. Jagger and west by H. G. Tabor Estate. Fee paid $5.00. The Chairman opened the hearing by reading application for a special exception, legal notice of hearing, affidavit attesting to its pUblication in the official newspaper and notification to the applicant. THE CHAIRMAN: Is there anyone present who wishes to speak for this application? E. KENNETH TABOR, Orient, New York: I do. (Mr. Tabor stated that the camp has been in existence since 1951 and they have had a Board of Health permit every year, also a State permit. This is an expansion from 14 to 18 individuals. The building is 16½'x12'3". - There were pictures and a tracing of the tax map in the file.) Southold Town Board of Appeals -6- July 19, 1962 TP~ CHAIRMAN: Is there anyone present who wishes to speak against ~his application? (There was no response.) After investigation and inspection the Board finds that the application is occasioned by an expansion of the applicant's present labor camp. Due to the discontinuance of the Greenport Eastern Suffolk Cooperative~Labor Camp the farmers must house additional temporary help. This camp has been in continuous existence since 1951 and has been commended by organizations which have investigated migrant labor camps in this area. The present camp is being remodeled to conform to the strict regulations of the County Health Department and another building is being added, and this new construction will further modernize the camp. ~his is open farm country and the use of so-called migrant labor is an accepted practice and in the past has not been objectionable. This type of farm labor is essential for the conduct of these farms and all camps are under rigid supervision of the County Health authorities as well as inspection by State Police at regular intervals. The Board finds that inasmuch as this type of labor camp on the farms of active owners is definitely a requirement for the operation of the local farms a permit valid until December 31, 1962 should be issued. The applicant wishes to increase the capacity of the camp from 14 to 18. The limited time will give all concerned an opportunity to observe the conduct and result of these camps. All of the requirements and standards set forth in the Ordinance have been met. On motion of Mr. Gillispie, seconded by Mr. Rosenberg, it was RESOLVED that E. Kenneth Tabor be granted permission to enlarge his existing labor camp facilities. The permit should be issued until December 31, 1962 for the housing of 18 workers. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, and ~Lr. Rosenberg. On moti~nof Mr. Rosenberg, and seconded by Mr. Bergen., it was RESOLVED that the Board of Appeals set 7:30 P.M., Thursday, August 2, 1962, Town Office, Main Road, Southotd, New York as time and place for hearing upon application of Mattituck Inlet Marina & Shipyard, Inc., Mill Road, Mattituck, New York, for a special exception in accordance with the Zoning Ordinance, Article V, Section 502, for permission to erect~and maintain a directional sign on the setback of a roof of a building owned by Jean Fenmore, Naugles DriVe, Mattituck, New York. Property bounded north by Mattituck Inlet, east by Gotham Sand and Stone, south by right- of-way, and west by I. Vignes. vote of the Board: Ayes:- Mr. Gillispie~ Mr. Bergen, and Mr. Rosenberg. It was further RESOlvED that legal notice of the hearing be published in the official newspaper on July 26, 1962. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, and Mr. Rosenberg.
