Tefeohone SO 5-2660 MINUTES SOUTHOLD TOWN BOARD OF APPEALS August 2, 1962 A regular meeting of the Southold Town Board of Appeals was held 7:30 P.M.~ Thursday, August 2, 1962 at the town Office, Main Road, Southold, New York. There were present: Messrs. Robert W. Gillispie~ Jr., Chairman, Robert Bergen and Charles Grigonis, Jr. Absent: Messrs. Herbert Rosenberg and Serge Doyen, Jr. Mr. and Mrs. Raymond Slavin, Broadwaters and Oak Drive, Cutchogue, and their builder Mr. Emory Tuthill appeared before the Board of Appeals for an informal discussion. In June Mr. Slavin had made application for permission to reduce front yard setback on a corner lot. An addition had been erected in the front yard area in violation of the Zoning Ordinance. After a hearing this application was denied and upon another application the applicant was given permission to keep the foundation as a patio, but nothing could be erected on the patio. Mr. Stavin now wishes to re-erect the porch on the patio. The Board stated that that had previously been denied and they did not see where ccaditions had changed to warrant a re-hearing. Mr. Slavin produced a petition signed by property owners in the area and stated that he would like to present the petition at a re-hearing. Southold Town Board of Appeals -2- ~ugust 2, 1962 On motion of Mr. Gillispie, seconded by Mr. Bergen, it was I~ESOLVED that Mr. Raymond Slavin be granted permission to apply for a re-hearing on his Appeal No. 466~ previously denied. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, and Mr. Grigonis. PUBLIC PYM.__ARING: Appeal No. 493 - Upon application of Mattituck Inlet Marina & Shipyard, Inc., Mill ~oad, Mattituck, New York, for a special exception in accordance with the Zoning Ordinance~ Article V~ Se c tion 502, for permission to erect and maintain a directional sign on the setback of a roof of a building owned by Jean Fenmore, Naugtes Drive, Mattituck, New York. Prop- erty bounded north by Mattituck Inlet~ east by Gotham Sand and Stone~ south by right-of-way~ and west by I. Vignes. Fee paid $5. o0. The Chairman opened the hearing by reading application for a special exception, legal notice of hearing, affidavit attesting to its publication in the official newspaper and letter of permission from the property owner. THE CHAIRF~AN: Is there anyone present who wishes to speak for this application? MR. WILLIAM BOSCOLA, JR., Mattituck, New York: I would like to speak for it. THE CHAIRMAN: You wish to put the sign on the top of a building? MR. BOSCOLA: It is the icehouse of Mr. Fenmore. THE CHAIRMAN: We have never granted a directional sign placed on the top of a roof. Can you achieve the same purpose by putting the sign on the ground? MR. BOSCOLA: Yes. We have discussed that and feel it would be just as good a location. Southold Town Board of Appeals -3- August 2, 1962 THE C~LAIRMAN: You indicate in the application that you want a 4 ft. by 8 ft. sign. We only grant 4 ft. by 6 ft. signs for marinas. MR. BOSCOLA: I believe that would be satisfactory. T~ CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response.) After investigation and inspection the Board finds that this new constructed modern marina is in need of identification to direct people to their site on Mattituck Inlet. The Board finds that the public convenience and welfare and justice will be served and the legally established or permitted use of neighborhood property and adjoining use districts will not be permanently or substantially injured and the spirit of the Ordinance will be observed, therefore On motion of Mr. Gillispie, seconded by Mr. Bergen, it was RESOLVED that Mattituck Inlet Marina & Shipyard, Inc. be granted permission to erect and maintain a 4 ft. by 6 ft. directional sign on the property of Jean Fenmore~ Naugles Drive, Mattituck, New York. The size of the sign shall be 4 ft. by 6 ft., 5 fto from any property line, no higher than 15 ft. 6 in. from the ground level and lower edge no closer than 3 ft. above the ground. Wording on the sign to be: "Mattituck Inlet Marina & Shipyard, Inc., Dockage at Concrete Floats" with an arrow. Permission for this sign is granted for one year. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, and Mr. Grigonis. Dr. and Mrs. Edward B. Hornowski, accompanied by Beatrice Wasson~ appeared before the Board to discuss the possibility of using the Baum Estate at Peconic Bay B oulevard~ Laurel, for the congregation of serious students of applied arts for intense summer ~outhold Town Board of Appeals -4- August 2t 1962 study as well as occasional summer concerts to which the public will be invited with or without charge. Their present school on Parsons~Boulevard at Flushing, the Long Island Institute of Music, is both State and Federally approved. They propose to construct student housing and serve meals incidental to the conduct of the school. They will probably construct an acoustic shell near the center of the Bay front property, sufficient in size to seat a philharmonic orchestra. Their present enrollment includes students in music~ art, drama and ballet and modern dancing and numbers approximately 1000~ up from ~25 10 years ago. They also have a faculty of 30, of whom many are nationally and internationally known. Both the State of New York and the students are desirous of continuing their education in the summer months. The Chairman advised that he would have to take the matter up with the Town Attorney and Supervisor to determine what steps Dr. Hornowski wouldhave to take to be able to begin his project in the Town of Southold. (After a discussion with Town Attorney Tasker and Supervisor Albertson it was determined under Article III, Section 300, Sub- section 2, "churches, schools, libraries" are a permitted use. Under Subdivision 8 of Section 300 it states: "uses customarily incidental to any of the above uses when located on the same lot and not involving the conduct of a separate-business." It was the opinion of the Town Attorye that what Dr. Hornowaki proposes is a permitted use in the "A" Residential-Agricultural District.) Mr. and Mrs. Manuel Gloria appeared before the Board to discuss their property on Flint Street, Greenport. They have recently contracted to sell two separate 50 ft. by 112 ft. lots to two different individuals. They had previously sold three lots each containing 100 ft. ~ontage by 112 ft. in depth. After considerable discussion the Board advised that it might be necessary to shift the lots so that there would be no~l 10t with less than 100 ft. frontage. Since the property has notb~nbuilt upon it does not seem that that would be an impossibility. Mr. Heffernan of Island View Lanet Greenport appeared before the Board to determine the Health Department regulations on the property of Arthur J..Maillet~ Jr. who has purchased property on the opposite side of the street from them. The Board advised that this information would have to be secured from the Board of Health at Riverhead. Southold Town Board of Appeals -5- August 2, 1962 On motion of Mr. Gillispie, seconded by Mr. Grigonis it was RESOLVED that the minutes of July 26, 1962 be approved as submitted. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, and Mr. Grigonis. On motion of'Mr. Bergen, seconded by Mr. Grigonis, it was RESOLVED that the Board~ Appeals set 7:30 P.M. (E.D.S.T.), Thursday, August 1~, 1962, Town Office, Main Road, Southold, New York as time and place for hearing upon application of Margaret Palmer, Westphalia Avenue, Mattituck, New York, for a variance in accordance with the Zoning Ordinance, Article III, Section 303 and Article X~ Section 1000A, for permission to divide property into two lots each containing less frontage and area than prescribed in the Ordinance. Location of property: east side Westphalia Road, Mattituck, New York, bounded north~by ~ubbar~ east by O. Gunther, south by right-of-way and west by Westphalia Avenue. Vote of the Board: Ayes:- Mr. Gillispie~ Mr. Bergen, and Mr. Grigonis. It was further RESOLVED that legal notice of the hearing be published in the official newspaper on August 9, 1962. vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, and Mr. Grigonis. The next meeting of the Southold Town Board of'Appeals will be held 7:30 P.M., ThurSday~ August 16, 1962, Town Office, Main Road, Southold, New York. Meeting adjourned at 10:45 P.M.
