SOUTHOLD TOWN BOARD OF APPEALS
November 8, 1962
A regular meeting of the Southold Town Board of Appeals
was held 7:30 P.M.s Thursday, Novenfoer 8, 1962 at the Town
Office~ Main Road~ Southold, New York.
There were present: Messrs. Robert Wo Gillispie~ Jr.,
Chairman~ Robert Bergen, Herbert Rosenberg, and Charles
Grigoniss Jr.
Absent: Mr. Serge Doyen~ Jr.
PUBLIC ~ARING: Appeal Noo 526 - 7:30 P.M. (E.S.T.),
upon application of Joseph Romanox a/c Tollewood Associations
Meday Avenue, Mattituck, New York, for a special exception
in accordance with the Zoning Ordinance, Article III, Section
300, Subsection 3A~ for permission to establish a private
community marina at the northerly end of Illinois Avenue,
Tollewood Subdivision, Mattitucks New York. Fee paid $5.00.
The Chairman opened the hearing by reading application
for a special exception, legal notice of hearing~ affidavit

attestingto its publication in the official newspaper and notice
to the applicant.
THE C~iAIRMAN: Is there anyone present who wishes to speak
for this application?
Mr. Allen Cox and wife spoke for Joseph Romano on behalf
of the Tollewood Association. There was a question from the
Westphalia Association relative to the use of the word "marina"
and it was stated that this would be strictly a private.?marina~
and restricted to the property owners in the subdivision.
There are 30 homes in this subdivision and there will be at
least six boat ~ners to use the dock and facilities. There
will be no sale of products of any type. The largest boat
will be a 24 ft. Owens. There will be a float at the end of
a 100 ft. dock and some boats will be staked off the sides of
the dock.
THE CHAIRMAN: Is there anyone present who wishes to speak
against this application?
(There was no response°)
After investigation and inspection the Board finds that
a permit was granted by the Town Trustees for construction of
a dock for mooring purposes.
The standards and conditions imposed by the Ordinance for
a special exception exist and should be granted with the condition
that this dock and boat basin be limitedto use by the Association
for its members and provided further that no business of any sort
is to be conducted on the premises
On motion of Mr. Gillispie, seconded by Mro Bergen, it was
RESOLVED that Joseph Romano, a/c Tollewood Association,
Mattituck, New York, be granted permission to establish a private
community marina at the northerly end of Illinois Avenue,
Tollewood Subdivisiong Mattituck, New York and this dock and
boat basin is to be limited to use by the Association for its
members and provided further that no business of any sort is to
be conducted on the premises.

PUBLIC HEARING: Appeal No. 527 - 7:45 P.M. (E.S.T.)s
upon application of Charles K. Bittner, Main Streets New Suffolk~
New York, for a variance in accordance with the Zoning Ordinance,
Article IV, Section 400, Subsection 1, as it refers to Article
IIIs Section 303~ forpermission to divide property into two parcels
each containing insufficient frontage and area. Location of property:
south side Main Street, east side Second Streets New Suffolk, New
York, bounded north by Main Street, east by F. Flurry, so~2a by
Parker and A. Polashocks and wes= by Second Street. Fee paid $5.00.
The Chairman opened the hearing by reading application for
a variances legal notice of hearing, affidavit attesting to its
publication in the official newspaper and notice to the applicant.
THE CHAIRMAN: Is there anyone present who wishes to speak
f~r this application?
Mr. Walter G. Kapps attorney for the applicant spoke in
favor of the application stati~gthat Mr. Bittner has rented the
subject property for many years and now desires to sell it.
The lots will be in keeping with the area, there being mostly
substandard lots under the present ordinance.
It was pointed out that Section 1000A~ Article X~ should be
added to the appeal and Mr. Kapp requested that this be done.
On motion of Mro Gillispie, seconded by Mr. Bergens it was
RESOLVED that this application be amended to include Article
X, Section 1000A.
Vote of the Board: Ayes:- Mro Gillispie~ Mro Bergen, Mr.
Rosenberg~ and Mr. Grigonis.

After investigation and inspection the Board finds that the
two lots in question were purchased about 15 and 20 years ago°
The lot and house on the Second Street and Main Street corner
was purchased about 15 years ago and being a very old residence
was modernized and used for rental purposes.
The adjoining house, 50 ft. by 125 ft. lot, was constructed
about 20 years ago and is occupied by Bittner.
This is a business zone and most of the surrounding properties
are undersized lots and many are used for business and tourist
colonies.
~ne two lots in question have been used for over fifteen years
as separate parcels having no connection with each other.
On motion of Mro Gillispie, seconded by Mr° Grigonis~ it was
RESOLVED that-Charles K. Bittner~ Main Streets New Suffolk,
New York be granted ~mission to divide property into two parcels
containing insufficient frontage and area.. One parcel, a corner
lot on Main Street and Second Street is 100 ft. by 75 ft. The
other parcel fronting on Main Street is 50 ft. by 125 ft.
Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, Mro
Rosenberg, and Mr~ Grigonis.
On motion of Mro Bergen, seconded by Mr° Rosenberg, it was
RESOLVED that the minutes of October 25,. 1962 be approved
as submitted.

the October 25th meeting°)
On motion of Mr. Gillispie~ seconded by Mr. Bergen~ it was
RESOLVED that the Board of'Appeals set 7:30~P.M. (E.S.T.),
Friday, November 23~ 1962, Town Office~ Main Road~ Southold, New
York as time and place for hearing upon application of Eugene
Horton~ New Suffolk Avenue~ New Suffolk, New York, a/c Irma
Merrill~ Broadwaters Drive, Cutchogue~ New York, for a special

exception in accordance with the Zoning Ordinance~ Article iii,
Section 306, for permission to reduce front yard setback on a
corner lot to 25 feet. Location of property: southwest corner
of Mason Drive and Broadwaters Drive, Cutchogue, New York,
bounded north by Mason Drive, east by Broadwaters~Drive, south
by The Narrows, and west by R. French~
Vote of the Board: Ayes:- Mro Gillispie~ Mr. Bergen~ Mr.
Rosenberg, and Mr. Grigonis.

RESOLVED that the Board of Appeals set 7:45~P.M. (E.S.T.)~

York as time and place for hearing upon application of Robert
and Agnes Friedman~ BayLake Drive, East Marion~ New York~ for a
variance in accordance with the Zoning Ordinance~ Article III,
Section 300, Subsection 7, for permis~sion to erect a private
detached garage in the side yard area of lot located on the west
side Bay Lake~Drive ( Truman Path), Bay Lake Park~ East Marion,
New York~ b~unded north by Jo W. Billman, east by Truman Path~
south by J. F. Alexander~ and west by Marion Lake.
Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen~ Mr.

It was further RESOLVED that legal notice of hearing be
published in the official newspaper on November 15g 19622
Vote of the Board: Ayes:- Mro Giltispie~ Mr. Bergen~ Mr.
Rosenberg~ and Mr. Grigonis.
The next meeting of the Southold Town Planning Board will
be held Friday~ November 23~ 1962 at the Town Office, Main Road~
Southold, New York.
There was a discussion relative to the Industrial section
of the Ordinance and the Board requested Mr. Howard Terry to
speak to the Town Board relative to amending the Zoning Ordinance
to show all those prohibited uses listed in the Ordinance under
"C" Industrial as a special exception by the Board of Appeals.
