3/,7 SOUTHOLD TOWN BOARD M~NUTES Meeting of December 9, 1975 A regular meeting of the Southold Town Board'was held on Tu~ day, December 9, 1975 at the town board meeting room, 16 South Street, Green~prt, Mew York. Supervisor Martocchia called the meetigg to order at 3:00 P.M. with the following present: Supervisor Albert M. Martocchia Councilman James H. Rich, Jr. COuncilman James Homan Justice Martin Surer Justice Louis M. Demarest Town Attorney Robert W. Tasker Town Clerk Judith T. Boken Absent: Justice Francais T. Doyen On motion of Councilman Rich, seconded by Councilman Homan, it was RESOLVED that the minutes of the November 18, 1975 Town Board meeting be and hereby are approved. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Surer, Justice Demarest. This resolution was declared duly adopted. On motiOn of Justice Surer, seconded by Justice Demarest, it was RESOLVED that the next regular meeting of the Southold Twon Board will be held at 3:00 P.M., Tuesday, December 23, 1975 at the town board me,ting room, 16 South Street, Greenport, New York. On motion of Councilman Homan, seconded by Councilman Rich, it was RESOLVED that the reports of Supervisor Martocchia, Justice Surer, Town Clerk Boken, and Building Inspector Terry be ahd'hereby are accepted and p!acedomn file. On motion of Justice Demarest, seconded by Justice Surer, it was RESOLVED that the Southold Town Board approves the action of the Fishers Island Ferry District in appointing Mrs. Ruth Pickett to the position of reservation clerk which was vacated by the resignation of Mrs. McCloskey; salary for said position to be $3.00 per hour for a.~15 hour Week. Vote of the Town Board: Ayes: Supervisor Martocchia, 'Councilman Rich, Councilman Homart, Justice Suter, Justice Demarest. This resolution was declared duly adopted. Supervisor Martocchia reported% 1. Receipt of a letter from the Southold Public Schools advising of the defeat of the proposition to sell the buildings on Peconic Lane to the Town.and notification that the funds deposited by the Town shall be returned in full. 2. Letter from the Long Island Lighting Company stating they have filed with the Public Service Commission a modification of their demand clause, which, if approved, will reduce their former 85% to 17% in 1976, 34% in 1977, 51% in 1978, 68% in 1978, and the full 86% in 1980. The east End Superviso~and the Southold Tovna Board will pursue this further as they do not like the 85% in five years. On motion of Councilman Homan, seconded by Justice Surer, (%~EERE~S, a joint Energy Research and Development Administration RDA) and National Academy of Sciences Study is now underway to determine where to locate the Solar Energy Research Institute (SERI), an institute whose prime thrust is to provide the method by which solar research and development can be quickly translated into production; and WHEREAS, the preliminary National Academy of Sciences report endorses locating the SERi'-near major research installations, preferably near a national laboratory to facilitate rapid start-up. SERI also needs an environment p~oviding e~eeptional research facilities, academic i inputs and a sophisticated industrial base capable of marketing solar energy equipment; and WHEREAS, Long Island has all the resource~ and site parameters ~to allow it to compete with massive out-of-state competition for this industry. However; this competition demands overt and tangible support by the State of New York; and. WHEREAS, the establishment o£ a Solar Energy industry would be particularly beneficial to Long Island, whose ecenmmy is tied to some extend to governmental contracts; and WHEREAS, it is estimated that the SERI'S budget will be approximately $50 million annually; and WHEREAS, the SERI will have a staff of approximately 1,000 conststing of highly train.ed professional persons to be hired from the local region, with a "ripple effect" of approximately 5,000 new jobs; and WHEREAS, a facility located on approximately 100 acres will be created to house the ~ERI, involving about $25 million in construction costs; and WHEREAS, the $50 million operating budget for SERI will translate into approximately a $200 million operating improvement to the Long Island economic area. WHEREAS, the Town Board of the Town of Southold will strong!y encourage the application of solar energy throughout the TOwn of South01d, in both new and existing structures; now therefore be it RESOLVED, that the Town of Southold hereby urges the Governor of the State of New York and the Federal Energy Research and Develppment Agency to join in a unified effort to attract the SERI to th~ region where it will not only be welcomed and supported by the:community of Southo!d, but will also provide a new and long term stimulus to Long Island's economy. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Surer, Justice Demarest. This resolution was declared duly adopted. Supervisor Martocchia reported: 3. In connection with the new street lighting plan for the town, use o£ telephone poles is necessary. The New York Telephone Company indicated their willingness to discuss with the town use of their poles. $. Report from Chief Cataldo relative to a s~udy he has made of traffic in Southold Village at the post office and a new site proposed for the post office. 5. Letter from the Orient Fire District thanking the town officials for their help in securing a generator for their fire house. 6. Letter from Don Acuri a property owner at Horton's P0int, Southo!d. He is asking for less parking, more signs, no'picnicing on the beach, garbage cans at the end of the road. 7. Letter from the Suffolk County Girl Scout's Ceuncil asking for Southo!d Town's bikeway p!an.---~his plan has been submitted to the Suffolk County Planning Department for evaluation. On motion of Justice Demarest, seconded by Councilman Rich, it was RESOLVED that Supervisor Martocchiabe and he hereby is authorized to have the police boat placed in storage at the Port of Egypt Marine, Inc., Southold fora fee of $200.00 per year; said boat to be placed in an area where it can be taken out and launched for an emergency in a matter of minutes; at $10.00 for each launching. Vote of the Town Board: Ayes: Supervisor Martecchia, Councilman Rich, Councilman H~man, Justice Surer, Justice Demarest. This resolution was declared duly adopted. Supervisor Martocchia reported: 8. Letter from William Collins, Mattituck, citing problems road washout at his property. Steps will be taken to have the problem corrected by the. ~e¥,eloper.who is causing it. 9. Letter from David V. Huschle of the Suffolk Convention & Visitors Bureau asking for an inventory of accomodations from Laurel to Orient for the purpose of answering inquiries from out-of-town people seeking what the north fork has to offer. The letter.will be referred to the president of the chamber of commerce for a reply. On:~otion of Councilman Rich, seconded by Councilman Homart, it was RESOLVED that upon the recommendation of the ~outhold Town Fire Chiefs Council, the following be appointed to succeed themselves ~as Deputy Fire Coordinators f~r the~Town of Southold: Edward A. Lademann, Jr., Southold, Leander B. G!over, Jr., Cutchogue, Gerrge Lessard, Mattituck,and IT IS FURTHER RESOLVED that Anthony Blados, Cutchogue, be and he hereby is appointed the Southold Town representative on the Suffolk County FEte A~ivsory Board. Vote of'the Board: Ayes: Supervisor Martocchia, Councilman Rich, CoUncilman Homan, Justice Surer, Justide Demarest. This resolution was declared duly adopted. Supervisor Martocchia reported: 10. Study made by Chief Cataldo and Patrolman Sidor relavive to signs for the Baywater Avenue and Bayview Road area,Southold. 11. Letter from Reverend Donald S. Stacey supporting the proposed leash law. 12. Requests for improvements to be made in traffic safety at the Orient school. Plans have been submitted to the Department of Transportation at Hauppauge, and the plans have been accepted and put on the work order. 13. There will be a meeting Dec. 10 at 4:00 P.M., St Peter's Lutheran Church, Greenport, in reference to the Southold Tow~ Community Health Council. The town board members have been invited to attend this meeting. On motion of Councilman Homan, seconded by CoUncilman Rich, it was RESOLVED that the agreement between the Town of Southold, and the Civil Service Employees Association, Inc., Suffolk Chapter, Southold To~n Unit dated January 31, 1~75 be amended by adding a new paragraph thereto to provide as follows: (c) For the one-year period commencing on January 1, 1976, the wage rate of all full time employees represented by CSEA sha~be increased by the sum of $.40 per hour. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, CoUncilman Homan, Justice Surer, Justice Demrrest. This ~ solution was declared duly adopted. Supervisor Martocchia reported: 14. Due to the unfavorable vote for a new town hall at Peconic, in au attempt to provide additional temporary space, the town attorney and building inspector will draft specifications for a large office trailer to be located at the town hall site in Southold. 15. Letterjfrom the President of the Fishers Island Civil Association stating he has written to Assemblyman Perry Duryea and Anthony Tarom~ua about a possible lobster permit in the Fishers Island area.-- He also thanked the board for may help they may have given to Obtaining She new boat for emergency use. On motion of Justice Demarest, seconded by Justice Surer, it was RESOLVED that $1,050.00 be and hereby is transferred from Highway Item IV, Miscellaneous Contractual (DS5140.4) to Item IV, Snow and Ice Control Contractual (DS5142.4). Vote of the Town Board: Ayes: SuPervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest.~ This resolution was declared duly adopted. On motion of Justice Surer, seconded by Justice Demarest, it was RESOLVED that $21,000.00 be transferred from unexpended balance to F&shers Island Ferry District to Operation of the Ferry - Fishers Island Ferry District. Town Attorney Tasker is drawing up an easement £or the purpose o£ draining water at Wol£ Pit Lake, Mattituck. On motion o£ Justice Demarest, secondedbby Councilman Rich, £2 was RESOLVED that Bond No. 73 S-7262 BCA issued by the Aetna'Cau~a!ty and Surety Company in the name of George Me!!as, Receiver o£'~Taxes o£ the TOwn of Seuthold, in the. amount o£ ~100,000.00 be and the same is h~reby approved as to its £orm, m~nner o£ execution, and su££iciency o£ ~ties ther~ein. Moved by Councilman Homart, seconded by Councilman Rich, it WHEREAS Henry C. Weismann applied to the Southo!d Town Board £or a permit under the provisionsj~£ the Wetland Ordinance o£ the Town of Southold, 2pplication dated August 1, 1975, and WHEREAS the said application was re£erred to the Southold Town Board o£ Town Trustees and the SoUtho!d Town Conservation Advisory Council £or their £indings and recommendations, and WHEREAS a public hearing was held by the Town Board with respect to said application on the 18th day o£ November 1975, at which tim~ all interested persons were given an opportunity to be heard, NOW, THEREFORE, BE IT RESOLVED that Henry C. Weismann, 145 W. Mai~ St., Smithtown, New York, be' granted a permit under the provisions o£ the Wetland Ordinance o£ the Town o£ Southo!d to remove materi~ from an existing canal and deposit same behind a proposed new bulkhead at his property on the southeast terminus o£ ~arpon Drive at Arshamomaque, fronting on an existing canal on the south side o£ the property. Vote o£ the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Snter, Justice Demarest. This resolution was declared duly adopted. Supervisor Martocchia reported: 18. Request £or status o£ the bond o£ Elijah Lane Estates,, Section I, Mattituck, £or roads and improvements, will be re£erred to the town engineer for recommendation. 19. Application o£ Al£red R. Towle to the Department o£ ~ Environmental Cpnservation for permission to construct a one-family residence at Cutchogue. Objections must be received by December 22~ hearing December 29. 20. Application off Cross Sound Ferry Service, Inc. to the Department og Environmental Conservation flor permission to d~edge and reconstrmct and expand the present facilities. Objections must be received by December 31; hearing Jmnuary 7, 1976. 21. No~±fication that the L.I.R.R. overpass at Arshamomaque is to be constructed, the project to start next June or July, and should last flor one to one and one half years. It is guaranteed two lan~s will be kept open.-- Mrs. Gladys Csajko questioned the project. On motion off Councilman Homart, seconded by Councilman Rich, it was RESOLVED that a~recess be taken at 3:30 P.M. flor the purpose off holding a p~blic hearing on the application off Leander G!over, Jr. flor a permit: to excavate sand, gravel, s~one, or other materials. Moved by Justice Surer, seconded by Councilman Rich, W/qEREAS Frank Sturm has made application to the Town Board to dedicate certain highways at Gre~npor~w~2o bak~own~as-Green Hill Lane, Inlet Pond Road, and Homestead Way, more fully described in said petition, tOgether with release executed by the owners thereof, and WHEREAS ~h~ Highway Superintendent has inspected the said highways and has ::~ised the Town Board that said proposedhighways comply in all respects with the specifications for the dedication off highways in the Town of Southold, NOW, THEREFORE, BE IT RESOLVED that the Town Clerk be and she hereby is authorized'and directed to forthwith cause the deRication, releas8 and deed to be recorded in the office off the Clerk of the County off Suffolk. On motion of Councilman Homan, seconded by Councilman Rich, it was RESOLVED that a public hearing will be ehdl by the Town Board off the Town off Southo!d, Suffolk County, New York, at the Supervisor's Office, 16 South Street, Greenport, New York, on the 23rd day off December, 1975, at 3:30 o.'c!ock P,M..of said day, for purpose off considering .a contract with the Villageof Greenport, Suffolk County, New York, for fire protection to be furnished by said Village to the Fire Protection District established in saidTown and known as "East~West Greenport F~re .~roteotion DistriCt, Town off Southold, N.Y." upon the £ollowing general terms, to wit: (a) The Fire Department o£ said Village shall be subject to call for attendance upon any fire occuring in said District with aminimum o£ three pieces o£ apparatus and suitable men and equipment when notified by alarm or by telephone call from any.person within said District. Said Local Law provides that it shall be unlawful for any person owning or harboring a dog in the Town of Southo!d to permit or allow such dog to: (~) Run at large elsewhere than upon the pre~es of .the owner or custodian unles~ such dog shall be on a leash or accompanied by a per'son at !aast twe!~e years of age, having adequate control ofsuch dog, or unless it be upon the premises of another person with th~ know!edge~and consent of such person; that a dog or dogs hunting in comp~ with a hunter or ~nters shall be considered as accempanied by its ~ner; (B) Engage in habitual howling or barking or to habiutally annoy an~rson other than the owner or person harboring auch dog; (~) C~mse damage or destruction to property other than ~he property of the owner or ~erson harboring such dog; (~) Chas~ or otherwise harass any persom i~ such manner as reasonably to cause intimidation or ~to put such pers0h-~in reasonable apprehension of bodity harm or injury. Moved by Councilman Homart, seconded by Councilman Rich, WHEREAS Leander Glover, Jr. has, by written application, applied to this board for a renewal of his permit to excavate-sand, gravel, stone or o~her materials from£permises located on the north side of Middle Road, at Chtchogue, New York, and WHEREAS a public hearing was' h$1d on the original application on JMly 13, 1971 and the Town Clerk issued a permit as authorized by resolutions dated October 26, q971, August 8, 1972, Settember 11, 1973, smd September 24, 1974, subject to the terms and conditions set forth in said resolutions, NOW, THEREFORE, BE IT RESOLVED that the Town Clerk be and she hereby is authorized .~nd directed to issue a renewal permit to said Leander Glover, Jr. for the exaavation of sand, gravel, stone, or other materials from the above described premises for a term of one year, subject to the same terms and ~onditions set forth in sa~d resolutions of October 26, 197:1, Augtt~v 8, 1972, Setpember 11, 1973, and September 34, 1974. On motion of Justice Demarest, seconded by Councilman Rich, it was RESOLVED that the Town of Southold enter into a contract with the Raymond Cleaves Post #861, American Legion, Mattituck, forlthe rental of a justice Office, at ~7~0~[00perm':~ year with four:~ one-year options, rent payable manually. Councilman James Homan reported on ~is trip to Henders0nvitle, North Caroline (at his own expense) to stMdy strset lighting at the G.E. Street ~igh~ing Division. At this location G.E. has a Panorama of Lights and Hall of Lights showing the various types of lights used throughout ~he country. He spent consider~ffD~e time with the G.E. ,respres~ntatives going over what they have to offer for Southold Town in street lighting ~nd he has several recommendations for the Board. Mr. David Driscoll asked if the trip was not at the invitation o£ the General Electric Company?---Councilman Homan answered that General Electric had a symposium on November 6,7,8,, at which people were invited and they would pay for the meals and transportation from the airport; the towns were to pay the transportation down and motel room~ He was unable to go at that time. Colavito applier to the Southold Town Board for a ~ermit under the prSvisions of the Wetland Ordinance of the Town of Sout~old, application dated March 27, 1975, and WHEREAS the said application was refermed to the Southold Town Board of Town Trustees and the Southo!d Town Conservation Advisory Council for their findings and recommendations,_and WHEREAS a pbblic haering was held by the Town Board with respect to said application on the 18th of November 1975, at which time all interested persons were given an opportunity to be heard, and RZ~EREAS this Board has thereafter examined all statemen-ts smd documents submitted with respect to such application and has also visited the premises in question and is therefore familiar with the© permises and the affects upon the same which would mesult by reason of the granting of amid application, NOW, THEREFORE, BE IT RESOLVED that wetland application #22 of Michael F. Colavito to £ill his property to the southerb ~roperty line is DENIED in all respects as tb~fill would result 'in the complete elimination of a natural drainage area, and.disturb the natural ecology of that area.
