,'1975 SOUTHOLD TOWN BO~ MINUTES Meeting of September 23, 1975 A regular meeting of the Southold Town Board was held on Tuesday, September 23, 1975 at the town board meeting room, 16 South Street, Greenport, New York. Supervisor Martocchia opened the meeting at 3:00 P.M. with the following present: Supervisor Albert M. Ma~tocch±a Councilman James H. Rich, Jr. Councilman James F. Homan Justice Martin Surer Justice Louis M. Demarest Town Attorney Robert W. Tasker Highway Superintendent Raymond C. Dean Town Clerk Judith T. Boken Absent: Justice Francis T. Doyen On motion of Justice Surer, seconded by Councilman Homan, it was RESOLVED that the minutes of the Southold Town Board meeting of September 8, 1975 be approved as submitt~ Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Surer, Justice Demarest. This resolution was declared duly adopted. On motion of Justice Demarest, seconded by Councilman Rich, it was RESOLVED that the next regular meeting of the ?Southold Town Board will be held at 3:00 P.M., Tuesday, October 7, 1975 at the town board meeting room, 16 South Street, Greenport, New York. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homart, Justice Surer, Justice Demarest. This resolution was declared duly adopted. Supervisor Martocchia reported: 1. In response to a letter from ths Cleaves Point Association, Greenport, relative to the deterioration of the bulkhead at the inlet to Gull Pond, the matter has been referred to town engineer Lawrence Tuthill for survey and recommendations. 2. The office trailer for the town clerk's office, Southold, arrived damaged. After repair the town board examined it and found it unsatisfactory. It will be rejected. On motion of Justice Demabest, seconded by Councilman Rich,.it was RESOLVED that the officettrailer which was supplied under a bid be and hereby is rejected. The trailer arrived damaged, and does not meet the bid specifications. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Surer, Justice Demarest. This resolution was declared duly adopted. Supervisor Ma~tocchia continued his report: 3, Wednesday, September 24, 1975 Supervisor Ma~occhia, Councilman Homan and Rich will meet with representatives of the C.S.E.A. relative to salary adjustments under their contract. 4. Receip% of a letter from the Nassau Farms Association requesting that the Town Board consider (1) an ordinance controlling group rentals; (2) changes of zone from one acre parcels to one and a half and two acre parcels. 5. Applications have been received for part-time jobs working at the dog pound, ~ud further applications will be considered. 6. Extension discussions have been held by the town board relative to the spiraling costs of maintenance and operation of street lighting. The town is considering making street lights all one general town budget item, rather than individual districts. 7. Letter from the MattitUck Senior Citizens organization citing the Peconic school and Cutchogue East school possibly becoming available for a town hall; should the town choose the Peconic School, the senior citizens would like the town to buy the East Cutchogue school for their headquarters, and a youth center. 8. A vision problem at the Orient School crossing reported by Virginia Tabor, will be discussed by Justice Demarest at the next school board meeting at the Orient school. 9. Letter from Maxwell Associates, Ridgewood, New Jersey; Mr. Maxwell has a summer home in Calves Neck and wishes to be informed where the dredging will be, width, depth in Town Creek, Southold. 10. D~edging project at Silver Eel Pond,~ Fishers Island - objections must be £iZed before 0ctober 1~, 1975 with the Corps of Army Engineers, and October 16, 1975 With'the-Department of Environmental Conservation. 11. Dredging project in ~o~ss Creek, So~ho~d~ Objections to Corps of Army Engineers before October 17th. 12. Dredging project in.Downs Creek, Cutchogue, Objections to Corps of Army Engineers before October 16t~. 13. Receipt of a letter from S.R. Waters, Chairman of the Southw~$~d Town Council ~elling about his commumity and requesting information about our community. Supervisor Martocchia will furnish Mr. Waters with the necessary information. On motion of Justice Demarest, seconded by Councilman Homan, it was RESOLVED that Ma~deline Goodrich be and hereby is appointed Sout~o!d Town Historian, effective October 1, 1975, at a salary of $1,800.00 per ann~. Vote of the Town Board: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Surer, Justice Demarest. This resolution was declared duly adopted. On motion of Justice Surer, seconded by Justice Demarest, it was RESOLVED that the Southold Town Board:'approves the amount of ~35,000.00 bond as recommendedby the Southold Town P!anning Board for roads and improvements in the s~division of "Peconic Knolls" located at Peconic, New York, oVmed by Adelphi Land Corp., Mattituck, New York. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homart, Justice Surer, Justice Demarest. This resolution was declared duly adopted. On motion of Justice Demarest, seconded by Justice Surer, itwas RESOLVED that the Southold Town Board approves the amount of ~77,.000.00 bond as recommended by the Southold TownP!anning Board for roads and improvements in the subdivision of "Soundview Acre~~ at Orient", owned and developed by Carl G. Horaawood, Syosset, N.Y. Vote of tKe Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Surer, Justice Demarest. This resolution was declared duly adopted. On motio~of Councilman Homan, seconded by CouncilmamRich, it was RESOLVED that the voucher of Southold Postmaster John Jernick in the amount of ~5,000.00 be and ~ereby is approved for payment. Said payment to be used to refill the postage machine in the tax receivers office. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman-Rich, Councilman Homan, Justice Surer, Justice Demarest. This resolution was declared duly adopted. . On motion of Justice Surer, seconded ~_~by Justice Demarest, WHEREAS John Keogh, a member of the Mattituck Fire Department,. in responding to an alarm, saved a man who was ~entangted in power lines, and WHEREAS this is in the finest tradition of the Volunteer Fireman of the Town and State, and ~4EREAS both the Town of Southold and Mattituck Fire'~Department wish to honor John Keogh, NOW,-THEREFORE, BE IT RESOLVED that October 5, 1975 be declared JOHN KEOGH DAY in the Town of Southold, smd tha~suitable ceremony mark thi.s occasion. Vote of the Town Board: ?Ayes: Supervisor Martoccb~a:, ~ouncilman Rich, Councilman Homan, Justice surer, Justice Demarest. This resolution was declared duly adopted. Supervisor Martocchia asked if anyone present wisheddto speak. Mrs. Gladys Casjko read a letter to the town board (on file in the town clerk's office) urging the town board to remove the justices from the town board and replace them with councilman by means of a permissive referendum provided for under Section 60A of the Town Law. Mrs. Casjko strongly recommended that the town use the aforesaid method rather than declare Southo!d a first class town, which she feels would "further strengthen the patronage system", be establishing numerous appointive positions.*****Supervisor Martocchia stated the matter is being considered and expects by 1976 Southold To~n will have taken steps to replace the justices on the town board with Councilman. Supervisor Martocchia took exception to the use cf the word "patronage". Ms. Sherley Katz suggested that the town engineer or highway superintendent or a member of the highway committee attend the planning beard meetings. She attends these meetings and observed numerous occasions the town engineer or highway superintendent are needed for advice or opinions.*****Supervisor Martocchia thanked Ms. Katz for the good'suggestion. Mr. S~muel Markel asked how the town Board arrived at picking the town historian, as far as qualifications.*****Supervisor Martocchia advised he interviewed two people and talked to .others casually. Mr. Walter Goebel was interviewed, but did not know too much about the job, but with the help of his wife might be able to do it. He was recommended by the Southold Historical Society President Robert Waggoner, and another group. Mrs. Goodrich is very active in community functions, president of the Southo!d Legion Auxiliary, was a professional in social services, working with the commissioner, and has a good education. The historical records are all in good condition and the main task is correspondence. The records are being indexed at the present time.*****Mr. Marke! stated he does nov think Mrs. Goodrich meets the qualifications as historian. A member of the audience stated that she has been informed the construction of the dog pound is so poor you can see outside through the walls. Other individuals stated there is no venilation in the room where the cages are. There were numerous criticisms ef the construction and d~sign elf the building.*****Su~ervisor Mart0cchia discussed the construction, stating the ~uns would be expanded. However, it is merely a pound, not a shelter where dogs will be held indefinitely. Ail of these points will be examined closely before the building is accepted. Mr. Robert Hamilton, Jr., President of the Southo!d Town Baymen's Association, Inc. stated that at their last meeting they voted unanimously to oppose dredging of Peters Neck Pointkon the basis that it will lead to the pollution of the creek and submitted a letter to the town board stating same. Mr. Hamilton also submitted a letter from the Baymen's Association requesting the to~n to close all town waters to scalloping until ~ctober 10, as more than ½ bushel is being taken, many bushels are being taken il!ega!ly.*****Town Attorney Tasker stated the present scalloping dates were adopted several years ago with the cooperation of the Baymen. Mr. David Driscolt asked who on the Board is responsible for the bookkeeping.*****Supervisor Martocchia stated that his secretary, Mrs. Angell is the bookkeeper, and each justice has their own bookkeeping records, and the highway does the same. Each year the town hires an auditor to audit the books at the end of the year, and every three yea~s the state auditors audit all the town records. Mr. Driscoll also asked, referring to a resolution at a previous meeting, about the "open ticket" given to the highway department to buy sealer; how much was bought and what it cost.*****Highway Superintendent~Dean stated that none had been purchased.***Mr. Drisco!! asked if there is any limit or budget or bidding if the amount is above norma!?****eSupervisor Martocchia stated there certainly would be. Mr. Samuel Markel brought to the board's attention a problem with garbage cans at Kenney's Beach. People who come out for weekends this time of the year load the cans and put the garbage around them; the area is desecrated. He suggested the larger pick-up vessels rather than the 55 gallon oil drums being used.*****Supervisor Martocchia stated that it was a very good suggestion and he welcomed such ideas.*****Mr. Markel stated that the setbacks were not observed for the p~acement o£ the sanitary facilities at Kenney's Beach, in comparison with the setbacks for his residence required by the It is too close to the road and ~s hazardous. Mrs. Gladys Csajko asked if the town is going to continue Mrs. Jean Tiedke as the intervener .at the Long Island Lighting Company nuclear hearings since Riverhead has signed the contract?***** Supervisor Martocchia stated Mrs. Tiedke, who has represented the town very well, will be continued on~ On motion o£ Justice Demarest, seconded ~y Councilman Homan, it was RESOLVED that everyone having had an opportunity to be heard, this town board meeting be adjourned at 3:45 P.M.
