Doyen On motion of Councilman Rich, seconded by Councilman Homan, it was RESOLVED that the minutes of the Sou:hold Town Board meeting of° May 27, 1975 be approved as submitted. Vote of the Town Board: Ayes: Supervisor Martocchia; Councilman Rich,; Counoilman Homan; Justice Surer; Justice Demarest. This resolutiom was declared d~ly adopted. Moved by Justice Demarest, seconded by Justice Suter, it was RESOLVED that the next regular meeting of the Sou:hold Town Board will be held at 3:00 P.M., Tuesday, Jume 24, 1975 at the office of Supervisor Albert M. Martocchia, 16 South Street, Greenport, New York. Vote of the Town Board: Ayes: Supervisor Martocchia; Councilman Rich; Councilman Homart; Justice Surer; Justice Demarest. This resolution was declared duly adopted. Moved by Councilman Homan, seconded by Councilman Rich, it was RESOLVED that the reports for the month of May 1975 of :he,Building Department, Police Department, Supervisor, Town Clerk, and Justice Suter, be accepted and placed on file. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Surer, Justice Demarest. This resolution was declared duly adopted. Supervisor Martocchia reported, that he had received the fully executed copy ~f the Consortium Agreement entered into for purposes of the Housing and ~ommunity Development Act of 197~. The Town of Sou:hold anticipates the construction of a Senior Citizen-Teen Center, and is presently in negotiations with the attorney for a property owner on Peconic Lane for a vacant parcel of land. The Town's al!otment for the current year is ~23,760.00. Supervisor Marthcchia reported he has ~ritten to Dr, Mary McLaughlin, Suffolk County Commissioner of Health, requesting a variance for the use of McCabes Beach, Goose Creek Beach, and Goldsmith's Inlet Beach, due to the lack of sanitary facilities. The town is able to meet the County requirements by adding ssmitary facilities at the Sou:hold Town Beach, smd at New Suffolk Beach; The Norman E, Klipp Marine Park and Kenney's Beach have new facilties that are acceptable to the County. Supervisor Martocchia reported that the Suffolk County Department of Public Works has developed a third or relief lane for the intersection of Route 27A and Kenney's Road, Sou:hold. ~n motion of Justice Surer, seconded by Justice Demarest, it was RESOLVED that Supervisor Martocchia be and he hereby is authorized to sign the necessary papers for AN ACT, Senate Bill S.5814, Assembly Bill A.8189, in relation to eztablishing Sound Avenue, a scenic and historic corridor in Suffolk County, in honor and celebration of the American bicentennial and the role of Long Island in the American Revolution (Sound Avenue from its junction with State Route twenty- five A in the town of Riverhead to its junction with County Road twenty-seven in the town of Southold, ~0unty of Suffolk is declare~ to be a scenic and historic route in Suffolk County, and its historic, scenic, and cultural resources~and its natural beauty shall be prese~ed and protected for the benefit and enjoyment of the people o'f the state.) Supervisor Martocchia aunounced the resignation of Willard Lawrence, to be effective Jul~ 31, 1975. He invited anyone interestedfto apply for the po~tion ~h~c~will pay between $1,800.00 and $2,000.00 The Supervisor advised those presu~ut that there are applications pending before the New York State Department of Environmentall Conservation by William H. Link, Bayview Avenue, Southold,~£or 100ft. of timber bulkhead, notification before July.Tth; and George Burrwll, Bridge Ro~d, Cutchogue, for an open dock to a floating dock, notification date J¥1y 14th~ Moved by Justice Demarest, seconded by Justice Suter, it was RESOLVED that Chief Cataldo be and he hereby is authorized to attend the 1975 Pedestrian Safety Awards Program at the Statler Hilton Hotel, New York on Wednesday, June 18, 1975 and accept the Southold Town Safety Award on'behalf of the Town of Southold from the Board of Judges of the ~nerican Automobile Association. A request from the Southold Town Planning Board for the'~ Southold Town Board to sonsider the subdivision of land owned by WiIliam Schriever at Orient as a cluster concept subidivison was tabled for study. Proposed Local Law No.4 - 1975 - entitled "A Local Law providing for licensingoof home improvement con~a~ in the Town of Southold" was tabled for two additional weeks, to give the Town Board an opportunity to consult~ith East Hampton Town and Southampton Town. ~ Application of Rev. Donald Brickley for a wetland permit, hearing held May 27, 1975 was tabled until June 24th to allow the Town Board additional time to study the proposal. Moved by Justice Demarest, seconded by Councilman Homan, it was RESOLVED that approval be and hereby is given for payment of Mobil 0il Co. gas bills, 'upon' receipt of proper voucher and supporting tickets. On motion of Councilman Homau, seconded Ey Councilman Rich, it was RESOLVED that the Superintendent of Highways of the Town of Southold be authorized to advertise for bids and to purchase from the lowest responsible bidder, the following:. (2) Two D - 100 Dodge Pickup trucks - (0R'EGUAL) with trade'in allowances on (1~ one 1966 International pickup truck and (1) one 1970 International pickup truck. On motion of Councilman Homan, seconded by Councilman Rich, it was RESOLVED that the Superintendent of Highways of the Town of Southold be authorized to advertise for bids and to purchase from the lowest responsible bidder, the following, more or less, as needed: Item No. 1 - 15,000 lin. feet o£ Snow Fence with pickets 1½~x ½ ~nches, spaced 2 inches apart, 4 feet high stained red, with five (5) double strands Of 12½ gaUge galvanized wire in 100 lin. foot rolls. Item No. 2 1,000 - 6 ft. studded steel T posts with flanges or~ anchor plates on posts, posts shall not be i less than S.65 lbs. each. Mr. Benson Te!sey, Greenport, addressed the Town Board in an attempt to make a formal protest regarding the K.O.A. proposed change of zone, and handed the Town Clerk a petition in-opposition p~suant to Town Law, Section 265, containing 11 signatures. Town Attorney Tasker ruled the petition to have no legal significance. Supervisor Martocchia stated that the Town Board, as a body, cannot accept any further evidence or information on the K.0.A. petition~ as the pthlic hearing was held on May 27, 1975, after due~.notice, and any objection should have been made at that time. Any in£ormation presented at this t~ would have no 'bearing on the finat decis£on. Supervisor Martocchia encouraged residents to talk to the Town Board members individually on the outside. Mrs. Mabel Lytle, Peconic, questioned the fairhess o£ the public hearing on the K.0.S. as to the time limit set. Supervisor Martocchia explained that the petitiOner haS'the right to make a proper presentation, as those are the £acts the Town Board must be'~uided by inmmaking their decision. Every individual present at the'.pub!ic hearing, which lasted over three hours, had every opportunity to be heard for and against. Mrs. Lytle also asked Why it took'the Town Board and To~ Attorney three years to come to a d~cision to not~£y adjacent property owners. Town Attorney Tasker and Supervisor Martocchia explained that when changes are proposed for the Zomi~g Ordinance, they attempt to incorporate all proposed changes which entails !engthly study by the Town Board, Planning Board, Board or'Appeals and Town Attorney. Mr. David Driscoll, Southold, attempted to read a letter ~mt~ the minutes which he stated would present an alternate proposal for the K.O.A. project. Supervisor Martocchia ruled Mr. Driscoll out of order. Mr. Drisco!l then called for a public referendum, which Supervisor Martocchia stated is illegal, Mr. Driscol! handed his prepared statement to the Town Clerk, then withdrew it. Justice Demarest examined the statement, and on advice of Town Attorney Tasker, gave Mr. Driseolt permission to read it. He refused and invited those present to step outside the building and he would read it to those interested. Mrs. Gladys Csajko, Greenport, presented a letter to the Town Clerk which she stated was relative to X.O.A., on behalf of the Council of Allied Associations of the North Fork Taxpayers Association, Inc. Mrs. Csajko also questioned the amendment to the Zoning Ordinance~ relating to horses, asking if it is retroactive. She was advised it is not. Mr. Samuel Markel, Southold, ~uestioned the Highway Superintendent and Town Board relative to the wording of the bid for Cayuga rock salt; the bid for snow fence (most of which is about seven years old, and some of which was merely loaned temporarily to the TE~m of Riverhead.) Mr. Markel then asked if it is the policy of the Planning Board and Town Board to grant changes of zone for financial benefit of people, rather than the ~ood of the co~munity~ and how can the public learn how each Town Board member votes? Supervisor Martocchia stressed that it is the creed of the Southold Town Board to sonsider each petition for a change of zone strictly on the basis of the location, and whether it is a proper location for a particular zone, The vote is taken by individual poll of the Board at a regular Town Board meeting, as he witnessed earlier in the meeting when the Board approved the change of zone for Saint Peter's Lutheran Church. Mr. Henry Steinbrecher, Cutchogue, representing the Mattituck Senior Citizens, and Mro John Brolles, Greenport, stated their opposition to K.0.A, and were ruled out of order. On motion of Councilman Homart, seconded fby Councilman Rich, it was RESOLVED that this Town Board meeting be recessed for thirty minutes to give the Town Board an opportunity to audit the bills.
