Meeting of April 22, 1975
The Southold Town Board met at the office of Supervisor Albert M.
Martocchia, 16 South Street, Greenport, New York, at 3:00 P.M.,
.Tuesday, April 22, 1975, with the following present:

On motion of Councilman Homan, seconded by Councilman Rich, it was
RESOLVED that the minutes of the Southold Town Board meeting of
April 8, 1975 be approved as submitted.

On motion of Justice Demarest, seconded by Justice Suter, it was
RESOLVED that the next regular meeting of the ~outhold Town Board
will be held at 3:00 P.M., Tuesday, May 6, 1975 at the office of
Supervisor Albert M. Martocchia, 16 South Street, Greenport, New
York.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.
On motion of Councilman Rich, seconded by Justice Suter,
WHEREAS a proposed Local Law No. _~-1~75 was introduced at a
meeting of this board held on the llth day of March, 1975, and
~iEREAS a public hearing was held thereon by the Board on the
8th day of April, 1975, at 3:30 P.M. at which time all interested
persons were given an opportunity to be heard thereon,
NOW, THEREFORE, BE IT RESOLVED that Local Law No.~3~- ~875 be
enacted as follows, to wit: ~

A LOCAL LAW Ii~ RELATION TO EXPENSES OF
CERTAIN TOWN OFFICERS ~ILE ATTENDANCE
AT MEETINGS.
Be it enacted by the Town Board of the Town of Southold as
fo 1 lows:
Section 1. All actual and necessary expenses of travel, meals
and lodging of a member of the t~wn board, planning board and board
of appeals, who resides at Fishers Island, in the Town of Southold,
incurred in connection with the attendance of such member at official
meetings of said boards at a place in the Town other than at Fishers
Island, shall be a charge against the Town of Sou thold, and the
amount of such expenses shall be audited, allowed and paid in the
same manner as other claims a~a~nst the Town of Southold.
Section 2. This local law shall take effect immediately upon
filing with the Secretary of State of New York.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Councilman Homart, Justice Suter, Justice Demarest.
On ~otion of Justice Demarest, seconded b~ Justice Suter~ it was
RESOLVED that permission be and hereby is granted to the Children's
Bible Fellowship of New York, Inc. to conduct story hours for children
on Town Beaches during the summer of 1975.

Rich, Councilman Homan, Justice Suter, Justice Demarest.
On motion of Justice Suter, seconded by Councilman Homan, it was
P~ESOLVED that David Witherspoon, Lynn Summers and Catherine
Perrin be appointed ~art-time Program Aides to the program under
the Southold Town Narcotic Guidance Council through June 30, 1975,
at $4.00 per hour, not to exceed ten hours a week.

Rich, Councilman Homan, Justice Suter, Justice Demarest.
On motion of Councilman Rich, seconded by Justice Suter,
WHEREAS the Southold Town Planning Board and Suffolk County Department
of Planning have prepared official reports and recommendations on the
application of Richard C. Wilton and John J. Clanton for a change of
zone from "A" Residential and Agricultural District to "M~i" General
Multiple Residence District and "B" Light Business District,
NOW, THEREFORE, BE IT P~ESOLVED that a public hearing will be ~eld
by the Southold Town Board at 7:30 P.MJ, Tuesday, May 27, 1975 at
16 South Street, Greenport, New York on the abovementioned petition
and that the Town Clerk be and he hereby is authorized and directed
to cause notice of said hearing to be published in the official
newspaper pursuant to the requirements of law.

Rich, Councilman Homan, Justiee Suter, Justice Demarest.
On motion of Justice Suter, seconded by Justice Demarest, it was
RESOLVED that the E.L.I. Gymnasts be granted $500.00 for custodial
services at the Mattituck School, upon ~bmission of a proper voucher
for this charge.

Rich, Councilman Hmman, Justice Suter, Justice Demarest.
· n motion of Justice Suter, seconded by Councilman Homan, it was
RESOLVED that the Southold Town Board authorizes the payment of
$190.00 for the use of two buses by the Mattituck Senior Citizens
on May 18, 1975; and $444.00 far three buses for the Southold Senior
Citizens on May 21, 1975 for a trip to the Vanderbilt Museum.

On motion of Councilman Homan, seconded by Justice Suter, it was
P~ESOLVED thatthe Peconic Bay District of the Boy Scouts of
America be granted permission to use Moores Lanej Depot Lane,
School House Road and No~th S~reet at Cutchogue, on May 4, 1975
for formation and parade route for their annual Scout Exposition
and parade.

Rich, Councilman Homan, Justice Suter, Justice Demarest.
On motion of Justice Demarest, seconded by Councilman Rich, it was
RESOLVED that the Southold American Legion, Griswold-Terry-Glover
Post No. 803 be granted permission to plan and organize a parade
along the Main Road of Southold on Monday, May 26, 1975.

Rich, Councilman Homan, Justice Suter, Justice Demarest.
On motion of Justice Demarest, seconded by Justice Suter, ~t was
RESOLVED that a public hearing will be held by the Southold Town
Board at the Supervisor's Office, 16 South Street, Greenport, New
Y~rk, at 3:30 P.M., Tuesday, May 27, 1975, in the matter of the
application of Rev. Donald P. Brickley for a permit under the
provisions of the Wetland Ordinance of th~ Town of Southold for
the purpose of excavating and filling portions of his. property at
75 Broadwaters Road, Cutchogue, New York. Ail persons in~res~ed
· n said matter shall appear at the time and place above specified
and will be given an opportunity to De heard.

Rich, Councilman Homan, Justice Suter, Justice Demarest.
On mo~ion of Councilman Homan, seconded by Councilman Rich,
WHEREAS Minnie Wilson applied to the Town Board for a single
trailer renewal permit dated April 10, 1975,
NOW, THEREFORE, BE IT RESOLVED that the application of Minnie
Wilson to locate a single trailer on her property on the west side
of-private road, off the north side Middle Road (CR 27), Cutchogue,
New York, be and hereby is granted for a period of six (6) months.

Rich, Councilman HOman, Justice Suter, Justice Demarest.
On motion of CQuncilman Homan, seconded by Councilman Rich,
WHEREAS the Burton Potter Post ~185, American Legion, Greenport, New
York has applied to the Town Clerk for an Amended Bingo License, and
WHEREAS the Town Board has examined the application, and after
investigation, duly made findings and determinations as required by law,
NOW, THEREFORE, BE IT RESOLVED that the Supervisor be and he
hereby is authorized and directed to execute on behalf of the
Town Board the findings and determinations as required by law,
and it is further
RESOLVED that the Town Clerk be and he hereby is directed to issue
an Amended Bingo License to the Burton Potter Post ~185, American
Legion, Greenport, New York.

Rich, Councilman Homan, Justice Suter, Justice Demarest.
On motion of Justice Suter, seconded by Councilman Rich,
WHEREAS the term of office of Fred E. Hulse, Jr., Greenport, New
York, a member of the Board of Appeals of the Town of Southcld
expires on April 19, 1975, and
WI{EREAS in the past as a member of the Board of Appeals Fred E.
Hulse, Jr. has rendered the Town of Southold a most valuable service,
NOW, THEREFORE, BE IT RESOLVED that Fred E. Hulse, Jr. be and he
h~ereby is appointed as a member of the Southold Town Board of Appeals
for a term of five (5) years commencing April 19, 1975, and ending
April 19, 1980.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.
On motion of Councilman Homan, seconded by Justice Surer,
WHEREAS the term of office of Henry Moisa, Orient, New York, a
member of the Planning Board of the Town of Southold expires on
April 30, 1975, and
W~tEREAS in the past as a member of the Planning Board Henry Moisa
has rendered the Town of Southold a most valuable service,
NOW, THEREFORE, BE IT RESOLVED that Henry Moisa be and he hereby
is appointed as a member of the Southold Town Planning Board for
a term of five (5) years commencing April 30, 1975, and ending
April 30, 1980.

Rich, Councilman Homan, Justice Suter, Justice Demarest.
On motion of Justice Demarest, seconded by Councilman Homan, it was
RESOLVED that Ellen DeMaria, Orient, New York, be and she hereby
is appointed as a member of the Southold Town Conservation Advisory
Council for a term of two (2) years commencing June l, 1975, and
ending June l, 1977.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Councilman ~oman, Justice Suter, Justice Demarest.
On motion of Justice Demarest, seconded by Justice Suter, it was
RESOLVED that the Southold Town Board supports any and all proposed
legislation which will add to the benefits of volunteer firemen.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.
Om motion of Councilman Homan, seconded by Justice Demarest, it was
RESOLVED that Police Chief Cataldo be and he hereby is authorized
to purchase steel s~elves for police headquarters at an amount not
to exceed $486.57.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.
Moved by COuncilman Homan, seconded by Justice Sut~ro it was
RESOLVED that Jean Tiedke be and she hereby is designated Southold
Town representative to the Long Island Lighting Company nuclear
plant hearings beginning April 28, t975, a t a salary of $50.00
per day,~'with an addition $5.00 per hour for transcription of
the information; total cost not to exceed $750.00.

On motion of Justice Suter, seconded bl;Councilman Rich, it was
RESOLVED that the Fishers Island F~rsyH~use be designated Town Hall
on Fishers Island for the purpose of voter registration on Saturdays
from 12 Noon to 7:00 P.M. during June and July.

On motion of Councilman Homan, seconded by Councilman Rich, it ~was
RESOLVED that the Town Board of the T~wn of Southold ~r®~g~ objects
to the passage of Assembly Bill No. 6243 and Assembly Bill No. 5502,
which would deny commercial fishermen the right to harvest and sell
striped bass.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.
On motion of Councilman Rich, seconded by Justice Demarest, it was
~ESOLVED that Town Attorney Tasker be and he hereby is authorized
to purchase a dictating machine for town use in the amount of
$1,098.80, and enter into a service contract for such machine in
the amount of $122.00 per year.

Rich, Councilman Homan, Justice Suter, Justice Demarest.
On motion of Councilman Homan, seconded by-Councilman Rich, it ~as
RESOLVED that Supervisor Albert M. Martocchia be and he hereby is
authorized to purchase a tape recorder for the town in the amount
of $169.00.

On motion of Councilman Homan, seconded by Justice Suter, it was
RESOLVED that a recess be taken at 3:55 P.M. for thirty minutes.

On motion of Justice Suter, seconded by Councilman Homart, it was
RESOLVED that effective this date, April 22, 1975, non-resident
beach parking permits shall be ~2.50 per day for each vehicle.

On motion of Councilman Rich, seconded by Councilman Homan, it was
RESOLVED that this Town Board meeting be adjourned at 5:40 P.M.
