Martocchia, 16 South Street, Greenport New York, at 3:00 P.M. Tuesday, March 25, 1975, with the following present: Deputy Supervisor Louis M. Demarest Councilman James H. Rich, Jr. Councilman James Homan Justice Martin Suter Justice Francis T. Doyen Highway Superintendent Raymond C. Dean Town Attorney Robert W. Tasker Town Clerk Albert W. Richmond Absent: Supervisor Albert M. Martocchia On motion of Justice Suter, seconded by Justice Doyen, it was RESOLVED that the minutes of the Southold Town Board meeting of March 11,1975 be approved as submitted. Vote of the Town Board: Ayes: Deputy Supervisor Demarest, Councilman Rich,' Councilman Homan, Justice Suter, Justice Doyen. On motion of Councilman Rich, seconded by Councilman Homan, it was RESOLVED that the next regular meeting of the Southold Town Board will be held at 3:00 P.M., Tuesday, April 8, 1975, at the office of Supervisor Albert M. Martocchia, 16 South Street, Greenport, New York. Vote of the Town Board: Ayes: Bep~ty Supervisor Demarest, Councilman-Rich, Councilman H~man, Justice Suter, Justice Doyen. On motion of Councilman Rich, seconded by Justice Suter, it was RESOLVED that the police report for the month of February be accepted and placed on file. Vote of the Town Board: Ayes: Deputy Supervisor Demarest, Councilman Rich, Councilman Homan, Justice Suter, Justice ~oyen. On motion of Councilman Homan, seconded by Justice Suter, it was RESOLVED that Supervisor Albert M. Mattocchia be and he hereby is authorized to sign the contract for the lease of a Zerox copy machine for the Town Clerk's Office, Southold. Vote of the Town Board: Ayes: Deputy Supervisor Demarest, Councilman Rich, Councilman ~man, Justice Suter, Justice Doyen. Moved by Councilman Rich, seconded by Councilman Homan, ~qEREAS, a proposed Local Law No. 1- 1975 was introduced at a meeting of th~s board held on the 25th day of February 1975, and WHEREAS a public hearing was held thereon by this Board on the llth day of March 1975 at which time all interested persons were given an opportunity to be heard thereon, NOW, THEREFORE, BE IT RESOLVED that Local Law No. 1 - 1~75 be enacted as follows, to wit: LOCAL LAW NO. 1 - 1875 A LOCAL LAW TO AMEND CHAPTER 65 (PARKING AT BEACHES) OF THE CODE OF THE TOWN OF SOUTHOLD IN RELATION TO RESIDENT PARKING PERMIT FEES. Be it enacted by the Town Board of the Town of Southold as follows: I. The first sentence of Section 65-3 A. (1) of Chapter 65, of the Code of the Town of Southold is hereby amended to read follows: (1) A resident parking permit shall be issued by the Town Clerk or a person designated by him to all persons who are qualfieid residents of the Town of Southold. II. The last sentence of Section 65-3 A. (2) of Chapter 65 of the Code of the Town of'Southold is hereby amended to read as follows: Upon payment of the permit fee, a resident shall be entitled to a permit for each vehicle owned by him f~f such vehicle is registered to an address within the Town of Southold. III. Section 65-3 A. of Chapter 65 of the Code of the Town of Southold is hereby amended to add a new paragraph thereto, to be paragraph (4), to read as follows: (4) The fee for the issuance of a re~dent parking permit- shall be such fee as shall be prescribed by a resolution of the Southotd Town Board. IV. This local Aaw shall take effect immediately upon filing with the Secretary of State of the State of New York. Vote of the Town Board: Ayes: Deputy Supervisor Demarest, Councilman Rich, Councilman Homart, Justice Suter, Justice Doyen. On motion of Councilman Homan, seconded by Councilman Rich, WHEREAS this Board has heretofore invited applications for a cable television franchise to be granted by the Town of Southold in the territory of the Town exclusive of the Village of Greenport, pursuant to public notice published in the official newspapers of the Town in Two different calendar weeks and also in the "Television Digest" and "The Wall Street Journal", and ~ ' Wt{EREAS, in response to such published notices an application was filed with the Town by Long Island Cablev±sion Corporation on or about May 15, ~974, and WHEREAS, this Board has heretofore reviewed said application and finds that the same complies with all applicable laws, rules and regulations, and WHEREAS, a public hearing upon said application~ of Long Island Cablevision Corporation and the proposed form of franchise agreement ~as held by this Board on the 18th day of March, 1975, pursuant to public notice published in the official ~own newspapers in which interested persons were invited to participate in said hearing and to comment upon the qualifications of Long Island Cablevision Corporation to construct and operate a cable television system in the Town, and WHEREA'S, by reason of the foregoing this Board finds that Long Island Cablevision Corporation possessed the necessary legal, technical, character, financial and other qualifications to construct and operate a cable television system in the Town, NOW, THEREFORE, BE IT RESOLVED that Long Island Cablevision Corporation be and it hereby ~s granted anon-exclusive franchise to construct and operate a cable television system in the Town of Southold in accordance with and subject to the form of franchise agreement heretofore prepared by the Town Attorney and submitted to this Board, and IT IS FURTHER RESOLVED that the Supervisor or Deputy Supervisor of the Town be and he hereby is authorized and directed to execute said franchise agreement on behalf of the Town of Southold. Vote of the Town Board: Ayes: Deputy Supervisor Demarest, Councilma~ Rich, Councilman Homan, Justice Doyen. Nay: Justice Suter. On motion of Justice Suter, seconded by Councilman Rich, it was ~ RESOLVED that the Supervisor or Deputy Supervisor be authorized i ~ and directed to execute on behalf of the Town of Southold, the ~ .... 1975-76 conhract with the Southold Town Police Benevolent Association, Inc. Vote of the Town Board: Ayes: Beputy Supervisor Demarest, Councilman Rich, Councilman~oman, Justice Suter, Justice Doyen. Moved by Justice Suter, seconded by CoUncilman Homan, WHEREAS Sam-.Brown applied to the Town Board for a single traile'r r~newal permit dated March 13, 1975, NOW, THEREFORE, BE IT RESOLVED that the application of Sam Brown to locate a single trailer on his property on the west side of Tuthill Lane (town road to disposal area), Cutchogue, New York be and hereby is granted for a period of six (6) months. Vote of the Town Board: Ayes: Deputy Supervisor Demarest, Councilman Rich, councilman ~oman, Justice Suter, Justice Doyen. On motion of Justice Suter, seconded by Councilman Homan, WHEREAS Oscar Goldin has applied to the Town Board for a single trailer renewal permit ~ated March 13, 1975, NOW, THEREFORE, BE 1T RESOLVED that the application of Oscar Goldin to locate a single trailer on his property at Lot 69, Greenport Driving Park, south side Linnet Street, Greenport, New York, be and hereby'is granted for a period of six (6) months. Vote of the Town Board: Ayes: Deputy Supervisor Demarest, Councilman Rich, Councilman Homan, Justice Surer, Justice Doyen. Moved by Justice Suter, seconded by Councilman Rich, WHEREAS, the Town of Southold has requested the County of Suffolk to dismantle a unidentified sunken hulk in Mattituck Inlet, Town of Southold; and WHEREAS, the County of Suffolk proposes to have its contractor do said dismantling, in the Town of Southold at a nominal cost to the Town of Southold; and WHEREAS, in order to accomplish said dismantling, plans, ~pecifications, agreements and other documenss must be executed on behalf of the Town of Southold; now therefore be it RESOLVED, that the Supervisor be and he hereby is authorized to execute,=on behalf of the Town of Southold, all necessary plans and specifications, temporary disposal agreements, assurances to the County of Suffolk, license and/or dredging permit applications to Federal and State Agencies and all other documents that may be required to accomplish said ~ismantling work. Vote of the Town Board: Ayes: Deputy Supervisor Demarest, Councilman Rich, Councilman Homan, Justice Suter, Justice Doyen. On motion of Justice Suter, seconded by Councilman Homan, it was RESOLVED that the Supervisor be and he hereby is authorized to purchase on behalf of the Town of Southold $1,000,000.00 liability insurance (less $1,000.00 deductable) for the streets and sidewalks within the Town of Southold. Estimated cost to be $2,832.00. Vote of the Town Board: Ayes: Deputy Supervisor Demarest, Councilman Rich, Councilman Homan, Justice Suter, Justice Doyen. On motion of Justice Suter, seconded by Councilman Homan, it was RESOLVED that the Southold Town Board accepts the $36,000.00 bond for the SubdiviSion known as ,Inlet East Estates." On motion of Council~mn Rich, seconded by Councilman ~oman, it was RESOLVED that the Town of Southold purchase from Altha S. Molle a parcel of vacant land on the east side of Peconic Lane, Peconic, for the sum of $10~000.00, said premises being described as follows: All that certain plot, piece or parcel of land situate, lyingand being in the Hamlet of Peconic, in the Town of Southold, County of Suffolk, and more particularly bounded and described as follows: Beginning at a concrete monument set on the easterly si~e of Peconic Lane distant ~67 feet southerly from the inter- section of the easterly line of Peconic Lane and the southerly line of Carroll Avenue as measured along the easterly side of Peconic Lane and from said point of beginning running north 30 degrees 29 minutes west along the easterly line of Peconic Lane 129 feet to a point and land formerly of the seller and conveyed by her to Walter F. Luce; thence running along said lands now or formerly of Luce north 57 degrees 23 minutes 00 seconds east 250.09 feet to a p~pint and lands of the Peconic School; thence south 30 degrees 17 minutes 40 seconds east 101.44 feet to a monument; thence still along school property south 51 degrees 05 minutes west 252.2 feet to the point or place of beginning. FURTHER RESOLVED that the Supervisor be and he hereby is authorized and directed to execute a contract for such purchase in a form approved by the Town Attorney. Vote of the Town Board: Ayes: Deputy Supervisor Demarest, Councilman Rich, Souncilman Homan, Justice Suter, ~ustice Doyen. On motion of Justice Suter, seconded by Councilman Rich, it was RESOLVED that the Supervisor be and he hereby is authorized to sign a contract with the lowest bidder for the dry cleaning of police uniforms. Vote of the Town Board: Ayes: Deputy Supervisor Demarest, Councilman Rich, Councilman Homan, Justice Suter, JuStice Doyen. A recess was called for ten minutes at 4:35 P.M., at which time Justice Doyen returned to Fishers Island. Meeting recon~ened at 4:45 P.M. On motion of Councilman Homan, seconded by Councilman Rich, it was RESOLVED that the Southold Town Board approves the Consortium agreement b~tween the County of Suffolk and the federal g~vernment for a grant under the Housing and Community Development Act of 1974. Vote of the Town Board: Ayes: Deputy Supervisor Demarest, Councilman Rich, Councilman Homan, Justice Sute~ Mr. William Gibbs, repreSenting Petty's Bight Association, protested signing of the Cablevision contract which he deems unreasonable and wished to commend Justice Suter for voting against the franchise. Mrs. Gladys Csajko questioned the purchase of land on Peconic Lane, and commented on the service of the New London ferry. Dr. Dorothy Bauer expressed her concern about the crime rate in SOuthold Town. She asked cen questions regarding the Town police and court procedure, which were answered by Justice Demarest. Mr. Robert Ward and others of Cutchogue opened a discussion about the dog leash law. On motion of Councilman Homan, Seconded by Justice Suter, it was RESOLVED that this Town Board meeting be adjo~rn~d~at 5:10 P.M.
