Tuesday, February 25, 1975, with the following present: Supervisor Albert M. Martocchia Councilman James H. Rich, Jr. Justice Martin Suter Justice Louis M. Demarest Justice Francis T. Doyen Town Attorney Robert W. Tasker Highway Superintendent Raymond C. Dean Town ~erk Albert W. Richmond Absent: Councilman James Homart On motion of Justice Surer, seconded by Counciln~n Rich, it was RESOLVED that the minutes of the Southold Town Board meeting held February 6, 1975 be and hereby are approved as submitted. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Custice Surer, Justice Demarest, Justice Doyen. On motion of Justice Demarest, seconded by Justice Suter, it was RESOLVED that the next regular meeting of the Southold Town Board will be held at 3:00 P.M., Tuesday, March 11, 1975 at the office of Supervisor Albert M. Mattocchia, 16 South Street, Greenport, New York. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Justice Suter, Justice Demarest, ~ustice Doyen. Moved by Justice Demarest, seconded by Councilman Rich, WHEREAS the following local law being proposed Local Law No. 1 1975 was heretofore introduced at this meeting by a member of this Board, said local law being as follows, to wit: LOCAL LAW NO. 1 - 1975 A Local Law to amend Chapter 65 XParking at Beaches) of the Code of the Town of Southold in relation to resident parking permit fees. Be it ena~ed by the Town Board of the Town of Southold as follows: I. The first sentence of Section 65-3E. (1) of Chapter 65 of the Code of the Town of Southold is hereby amended to read as follows: (1) A resident parking permit shall be issued by the Town Clerk or a person designated by him to all persons who are qualified residents of the Town of Southold. II- The last sentence of Section 65-3E. (2) of Chapter 65 of the Code of the Town of Southold is hereby amended to read as follows: Upon payment of the permit fee, a resident shall be entitled to a permit for each vehicle owned by him if such vehicle is registered to an address within the Town of Southold. III. Section 65-3A. of Chapter 65 ~f the Code of the Town of Southold is hereby amended to add a new paragraph thereto, to be paragraph (4), to read as follows: (4) The fee for the issuance of a resident parking permit shall be such fee as shall be prescribed by a resolution of the $outhold Town Board. IV. This local law shall take effect immediately. NOW, THEREFORE, BE IT RESOLVED that a public hearing be held by this board with respect to the adoption of the aforesaid loc~ law at the Supervisor's office, 16 South Street, Greenport, New York at 3:30 o'clock P.M. on the llth day of March, 1975, and it is further RESOLVED that the Town Clerk be and he hereby is authorized and directed to cause public notice of said hearing to be given as provided by law. Moved by Justice Demarest, seconded by Justice Suter, WHEREAS the following local law being proposed Local Law No. 2 - 1975 was heretofore introduced at this meeting by a member of th~ Board, said local law being as follows, t~ wit: ~OCAL LDAW NO?~- 1975 ~ local law to amend Chapter 100 (Zoning) of the Code of the Town of Southcld in relation to notice of change of zone; notice of hearings by the Board of Appeals; and keeping ~nd housing of animals; site plan approval; the length of multiple'dwellings; minimumfloor area of dwelling units; detached or ground signs; display of merchandise; uses in B-1 Districts; expiration of Building permits; and front yard set back in C ~istricts. NOW, THEREFORE, BE IT RESOLVED that the Town Clerk of the Town of Southold be and he hereby is directed to transmit this Local Law No. 2 - 1975 to the Planning Board of the Town of Southold for their recommendation and report. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Justice Suter, Justice Demarest, Justice Doyen. On motion of Councilman Rich, seconded by Justice Doyen, it was RESOLVED that Supervisor Albert M. M~rtocchia be and he hereby is authorized to notify the proper individuals that the Southold Town Board disapproves of Senate Bill S221 which reads as follows: An act to amend the navigation law, £n relation to the definition of the navigable waters of the s~ate. Section 1. Subdivision four of section two of the navigation law, as amended by chapter one hundred sixty-five, is hereby amended to read as follows: 4. "Navigable waters of the state" shall mean all lakes, rivers, streams and waters within the boundaries of the state and not privately owned, which are navigable in fact or upon which vessels are operated *(except all ~idewaters bordering o~ and lying within the boundaries 'of Nassau and Suffolk Counties). *() is old law to be omitted. 2. This act will take effect immediately. Vote of the Town Board: Ayes: Supervisor M~rtocchia, Councilman Rich, Justice Suter, Justice Demarest, Justice Doyen. On motion of Justice Demars~t, seconded by Councilman Rich, it was RESOLVED that the 1975 beach parking s£ickers be purchased from The North Fork Press, Greenport. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Justice Suter, JuStice DemarsRt, Justice Doyen. On motion of Justice Demarest, seconded by. Councilman Rich, it was RESOLVED that the Southold Town Board authorizes payment of voucher in the amount of $1,100.00 to Francis J. Yakaboski, Esq. for legal services rendered. Vo~e of the Town Board: Ayes: Supervisor Martocchia, councilman Rich, ~ustice Suter, Justice Demarest, Justice Doyen. On motion of Justice Demarest, seconded by Councilman Rich, it was RESOLVED that the Southold Town Board authorizes payment of voucher in the amount of $1,300.00 to Smith, Finkelstein, Lundberg, Baisley & Yakaboski for legal services rendered. On motion of Justice Demarest, seconded by Councilman Rich, it was RESOLVED that Smith, Finkelstein, Lundberg, Baisley & Yakaboski be engaged to defend the Town of Southold in the matter of Bu~nowski vs. the Zoning Board of Appeals. On mot£0n of Ju~ice Doyen, seconded by Councilman Rich, it was ~W$OLVED that the Southold Town Board approves the action of the Fishers Island Ferry District in granting Mrs. Ione Norton, Clerk- Typist for the Fishers Island Ferry Distr~ct, a $.20 per hour raise effective February 1, 1975. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Justice Suter, Justice Demarest, Justice Doyen. On motion of Councilman Rich, seconded by Justice Demarest, WHEREAS the St. Agnes Church, Greenport, New York has applied to the Town Clerk for an Amended Bingo License, and ~iEREAS the Southold Town Board has examined the application, and after investigation, duly made findings and determinations as required by law, NOW, THEREFORE, BE IT RESOLVED that the Supervisor be and he hereby~ is authorized and directed to execute on behalf of the Town Board the findings and determinations required by law, and it is further RESOLVED that the Town Clerk be and he hereby is directed to issue an amended bingo license to the St. Agnes ChUrch, Greenport. Vote of the Town Board: Ayes: Supervisor Mattocchia, Councilman Rich, Justice Suter, Justice Demarest, Justice Doyen. On motion of Justice Suter, seconded by Councilman Rich, WHEREAS the Marian Council ~3852 Knights of Columbus, Cu~chogue, New York has applied to the Town Clerk for a Bingo License, and ~F~EREAS the Town Board has examined the application, and after investigatiDn, duly made findings and determinations as required by law, NOW, T~_EREFORE, BE IT RESOLVED th~ the Supervisor be and he hereby is authorized and directed to issue on behalf of the Town Board ~he findings and determinations required by law, and it~ further RESOLVED that the T~wn Clerk be and he hereby is directed to issue a Bingo License to the Marian Council ~3852, Knights of Columbus, Cutchogue, New York. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, ~~m~nter, Justice Demarest, Justice Doyen. On motion of Justice Suter, seconded by Justice Demarest, it was RESOLVED that the request of the Cutchogue Fire Department for the exclusive use of the Fire Department parking area in Cutchogue on Saturday July 19, 1975 for a parade and drill and on August 23, 1975 for their annual barbeque be granted. Vote of the To~n Board: Ayes: Supervisor Martocchia, Councilman Rich, Justice Suter, Justice Demarest, Justic~ Doyen. On motion of ~u~tice Suter, seconded by Justice Demarest, WHEREAS John C. Tuthill has applied to the Town Board for a single trailer renewal permit dated February 19, 1975, NOW, T~EREFORE, BE IT RESOLVED that the applicatiDn of John C. Tuthill to locate a single trailer on his own property on the east side of Elijah's Lane, Mattituck, ~ew York, be renewed for six (6) months. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Justice Suter, Justice Demarest, Justice Doyen. On motion of Councilman Rich, seconded by Justice Demarest, WHEREAS Isidore P. Krupski has applied to the Town Board for a single trailer renewal permit dated January 27, 1975, NOW, THEREFORE, BE IT RESOLVED that the application of Isidore P. Krupski to locate a single trailer on his own property on the 1975 north side Main Road, approximately 1000 feet east of Bay Avenue, Peconic, New York, be renewed for six (6) months. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Justice Suter, Justice Demarest, Justice Doyen. On motion of Justice Demarest, seconded by Councilman Ri~h~ it was RESOLVED that a public hearing will be held by the Southold Town Board on the 18th day of March, 1975, at 7:30 o'clock P.M, at the Supervisors Office, 16 South Street, Greenport, New York on the application of Long Island Cablevision Corporation for a Cable television-franchise for the Town of Southold pursuant to a public notice published in The'Suffolk Times; the'Long Island Tra~ele~? Mattituck Watchman; Television Digest and the Wall Street Jou~n~l advising the cable industry that the Town of Southold was accepting franchise applications and pursuant to a franchise application duly filed by Long Island Cablevision Corporation on May 15, 1974, all in accordance with the Rules and Regulations of the New York $~ate Commission on Cable Television. Vote of the Town Board: Ayes: Supervisor Martocchia, CouncilmEn Rich, Justice Suter, Justice ~emarest, Justice Doyen. On motion of Justice Suter, seconded by Councilman Rich, it was RESOLVED that Theodore Heus~be and he hereby is apPointed ~t~ the Board of Assessment Review for a period of five years, effective February 22, 1975, term ending February 22, 1980. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Justice Surer, Justice DemareSt, Justice Doyen. On motion of Justice Suter, seconded by Councilman Rich, it was RESOLVED that John Talbot be and he hereby is appointed to the Board of Housing Appeals for a period of three years, effeCtive January 9, 1975, temmr ending January 9, 1978. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Justice Suter, Justice Demarest, Justice Doyen. On motion of Justice DemareSt, seconded by Justice Suter, it was RESOLVED that the Scuthold Town Board approves th~ amount of $1~0,000 bond estimate for the subdivision known as "Greenfields at Southcld." Vote of the Town B~rd: Ayes: Supervisor Martocchia, Councilman Rich, Justice Suter, Justice Demarest, Justice Doyen. On motion of Justice Suter, seconded by Justice Demarest, it was RESOLVED that the Southold Town Board approves the amount of $36,000.00 bond estimate for the subdivision known as "Inlet Ea~ Estates" Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Justice Suter, Justice Demarest, Justice Doyen. On motion of Justice Demarest, seconded by Justice Suter, it was RESOLVED that the Town Board approves the amount of $20,000 bond estimate for the subdivision known as "Syloret Estates.~ Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Justice Suter, Justice Demarest, Justice Doyen. On motion of Justice Suter, seconded by Justice Demarest, it was RESOLVED that the Southold Town Board ~3.9~e~p-ts~ th~ $100,000.~0 bond for the subdivision known as "Oregon View Estates." On motion of Justice Demarest, seconded by Justice Suter, it was RESOLVED that the Superints~dent of Highways of the Town of Southold be authorized to advertise for bids and to purchase from the lowe~responsible bidder, the foklowing: One (1) 1972 used American Hornet Rnnabout, 2~ door, 2 seat wagon, 6 cylinder, 30~000 miles or less - (or equal. ) Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Justice Suter, Justice Demarest, Justice Doyen. On motion of Councilman Rich, seconded by Justice Demarest, it was RESOLVED that the Town Clerk be and he hereby is instructed to requ~s~t the Long Island Lighting Company to remove present light and install new 175MV light on Pole ~24, Peconic Lane, opposite the post office, Peconic,New York. Vote of the Town Board: Ayes: On motion Of Justice Suter, seconded by Councilman Rich, it was RESOLVED that the Town Clerk be and he hereby is instructed to request the Long Island Lighting Company to remove present light, and install 175MV lights on Poles 1 and 2, Jackson Street, New Suffolk. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, ~s~ Suter, Justice Demarest, Justice Doyen. Mrs. Dorothy Sullivan, Stillwater Avenue, Cutchogue, presented a petition containing 406 s&~natures requesting an ordinance calling for a leash law for the Town of Southold. Mr. Ward of Fleets Neck, Cutchogue asked if the Board could place the Leash kaw amendment on the ballot. Mr. William P. Pfeffer of Southold, a retired New York City fire chief, suggested that the Town Board take a close look at the Southold Fire Chiefs Council's fire prevention code. Supervisor Martocchia announced that the Town is currently studying ~he possibility of banning the use of firearms in the Gull Pond section of Greenport. On motion of Justice Surer, seconded by Councilman Rich, it was RESOLVED that this Southold Town Board meeting be adjourned at 4:10 P.M.
