Facts
As Described in the Wetland Permit & CEH Law application: The
property is located at 54505 County Rout 48, Southold. The property
is improved with a 1 Y2 story house (42.5' x 305) air conditioning unit
on the west side, open wood porch on the front of the house (7.8' x
22'), garage below, concrete driveway with retaining walls below
grade and asphalt driveway to CR 28. An attached wood deck on the
seaward side of the house was replaced@15 years ago with a brick
patio on sand (28' x 16.4').
The owner-applicant requested a wetland permit pursuant to Town
Code 275 for the brick patio and bocci court on grade, in addition the
wetland permit included all existing structures to allow the structures
to be maintained. Also, an application for a Coastal Erosion Hazard
Law permit was required by the Trustees to accompany the wetland
permit application. The wetland permit was granted but the Coastal
Erosion Hazard permit was denied.
No Coastal Erosion Hazard permit was required:
1 . All structures requiring a permit exist and have CO's or Pre-
CO's. The house, retaining walls and bulkhead predate Trustees
Jurisdiction and Coastal Erosion Hazard Law. The bulkhead
appears on a 1968 survey. Existing Structures do not require a
Coastal Erosion Hazard permit.
2. The patio and bocci ball court are "on grade" and were
constructed approximately 15 years ago, they were granted a
wetland permit but they are not "regulated activities" under the

Coastal Erosion Hazard law because they are not "structures",
and they do not materially alter the conditions of the land.
3. However, if the Board believes that a Coastal Erosion Hazard
Law permit is required for the existing structures (above
grade) and the on-grade patio and bocci court, then a
variance is requested.
Applicable Definition:
Town Code 111-6: EXISTING STRUCTURE
A structure and appurtenance in existence, or one where construction
has commenced, or one where construction has not begun but for
which a building permit has been issued prior to the effective date of
the chapter. (emphasis added)
Town Code 111-6: NORMAL MAINTENANCE
Periodic replacement or repair of same-kind structural elements or
protective coatings which do not change the size, design or function of
a functioning structure. A "functioning structure" is one which is fully
performing as originally designed at the time that normal maintenance
is scheduled to begin. "Normal maintenance" of a structure does not
require a coastal erosion management permit. (emphasis added)
Town Code 111-6: REGULATED ACTIVITY
The construction, modification, restoration or placement of a structure,
or major addition to a structure, or any action or use of land which
materially alters the condition of land, including grading, excavating,
dumping, mining, dredging, filling or other disturbance of soil.
Error of law:
POINT I: No Coastal Erosion Permit was re uired.
The existing house, garage below the house, retaining walls and
driveway, bulkheads and steps to the beach are "existing structures"
constructed prior to the adoption of chapter 111 .
Applicable Town Code 111-6: EXISTING STRUCTURE
A structure and appurtenance in existence, or one where construction
has commenced, or one where construction has not begun but for
which a building permit has been issued prior to the effective date of
the chapter. (emphasis added)
The Trustees required the applicant to file a Coastal Erosion Hazard
application for the "existing structures", where no construction activity
is proposed, and "does not materially alter the condition of land.
Land use regulations are not retroactive unless specifically stated to
be retroactive. The Coastal Erosion Hasard Law applies to
"construction, modification, restoration or placement of a structure, or
major addition to a structure, or any action or use of land which
materially alters the condition of land, including grading, excavating,
dumping, mining, dredging, filling or other disturbance of soil" after the
date of the enactment of chapter 111 .
The only activity on the property after the adoption of Chapter 111 ,
was the on-grade patio and bocci ball court. However, the patio and
bocci all court do not rise to the level of "filling and disturbance to the
soil" necessitating a CEH permit. An on-grade patio on sand and
bocci ball court are no more disturbance to the soil than planting
vegetation which is not a "regulated activity'
POINT II: Maintenance of existing structures does not re uire a
Coastal Erosion Hazard Permit.
Unlike Chapter 275, Wetland Code, which requires that the existing
structures be "permitted" to be maintained even if the structures
predate the wetland code, the Coastal Erosion Hazard Law does not
have this requirement. Normal Maintenance of existing
"functional" structures does not re uire a CEHL permit,
(see 111
Conclusion:
The Trustees had two options regarding the existing structures:
Either issue a permit for the existing structures because no change to
the structure was proposed which would materially alter the condition
of the land" or determine that no CEHL permit was required for the
existing structures and improvements since there was no regulated
activity proposed.
The Board mistakenly (error) claimed that they did not have the
authority to issue a Coastal Erosion Permit, that the Town Board
would have to issue a variance for the existing structures, including
the patio and bocci ball court.

SPECIFIC CHAPTER/SECTION INVOLVED:
1. CEH Permit is not required for preexisting structures and improvements which
are not"structures".
2. If required, CEH permit for the existing structures should have been issued
because there was no change to the existing structures & the "on grade
patio/bocci court" did not materially alter the conditions of the land
3. No variance was required.
THE ALLEGED ERRORS IN THE DETERMINATION ARE: The existing
house, garage below the house with retaining walls and asphalt driveway predate
the Coastal Erosion Hazard Law, see attached pre-CO and CO's. A brick patio on
sand replaced a wood deck @ 15 years ago and a bocci ball court was added years
ago. The property was sold to the applicant and the seller agreed to obtain
applicable Trustees' permits for the patio which replaced a wood deck and bocci
ball court. The wetland permit was issued. However, the Trustees required the
applicant to obtain a Coastal Erosion Hazard permit for the existing structures.
They believe that they cannot issue a Coastal Erosion Hazard permit, and a
variance/appeal is required.
The house predates the adoption of the Coastal Erosion Hazard Law in 1991. The
only change to the property in the last 15 years was removal of a above ground
wood deck(structure) with an on-grade brick patio on sand and an"on grade"
bocci court. Neither is a"structure". The Coastal Erosion Hazard Line runs
through the existing house. All improvements are on the property were included
in the wetland permit pursuant to the Trustee's procedures and a wetland permit
was issued.
INTERPRETATION THAT IS CLAIMED TO BE CORRECT: If a Coastal
Erosion Hazard permit is required for the brick patio on grade and bocci ball
court on grade, then a CEHL permit should be issued because these
improvements conform to the "purposes "of chapter 111.
RELIEF SOUGHT: Either a determination that no CEH Permit is required or a
CEHL permit matching wetland permit is sought: 28'x 16.4' on grade brick patio
on sand 18.2' from top of bank and 14' to the bulkhead (total distance 32.2' from
bulkhead), 8.1 x 31.1 bocci court on grade, 1 1/2 story single family dwelling
(42.5 x 30.5') with air coy ditioning HVAC unit on west side of house, 7.8' x 22'
open wood porch on the front of the house (outside of the CEH Area), garage
below house, concrete driveway 69.69 SF with retaining walls for the below
grade garage and asphalt driveway to CR 48 (outside of CEH area) and 1 1/2 2 car
garage in the front yard (out of the CEH area), existing beach stairs 2.6' x 9'
seaward of the bulkhead and existing wood steps in pathway 3' x 6.4' landward
of the bulkhead.
The structures on the property were constructed prior to zoning and prior to the
adoption of chapter 111. The Trustees required the owner to obtain a Coastal
Erosion Hazard permit as described in the wetland permit application.
Pursuant to chapter 111 "existing structures", do not require a Coastal
Erosion Hazard Permit. Under the policies of the Southold Town Trustees,
existing structures require a wetland permit to allow the maintenance of existing
"permitted" structures. Under chapter 111, existing structures may be
maintained without a CEH permit.
The Board claimed that existing structures are not "grandfathered". To the
contrary, existing structures do not require CEH permits therefore they are
"grandfathered" as preexisting structures.
"NORMAL MAINTENANCE Periodic replacement or repair of same-kind

or function of a functioning structure. A "functioning structure" is one which is
fully performing as originally designed at the time that normal maintenance is
scheduled to begin. "Normal maintenance" of a structure does not require a
coastal erosion management permit."
The patio and bocci court were placed on the property after the adoption of the
Coastal Erosion Hazard Law. Both are on grade, pervious, and are
landward of a bulkhead, and landward of an existing natural vegetative
buffer. The Trustees wetland permit included expanding the existing
vegetative buffer to start 3' seaward of the bocci court (approximately 45' in
width). The Trustees also required that the existing house connect to a drywell
to be in the front yard. The proposed vegetative buffer and drywell are shown
on the updated survey prepared by Aerial Land Surveying last dated October
18, 2025.
This application conforms to the purposes of chapter 111:
a. "minimize and prevent damage to structures from coastal flooding and
erosion and to protect natural protective features and other natural resources."
The on-grade patio & bocci ball court do not affect the natural protective
features or natural resources. The vegetative buffer was expanded to enhance
the natural protective feature (bluff).
b. "Minimize and prevent damage or destruction to man-made property, natural
protective features and other natural resources and to protect human life". No
activity is proposed affecting the natural protective features or natural
resources. This application is for existing improvements. The patio and bocci
ball court are approximately 15 years old and are on grade and not structures.
c. The patio and bocci court are at a safe distance from the bank. The bulkhead
and natural vegetation prevent erosion. The existing house, driveway and
appurtenances are at a safe distance from the impact of coastal storms. There
are no areas of active erosion on the property. The shoreline is protected by
large boulders on the Long Island Sound and the bulkhead. The existing house
has withstood storms since the 30's when the house was constructed. The land
is protected to ensure that these structures are not prematurely destroyed or
damaged due to improper siting, as well as to prevent damage to natural
protective features and other natural resources.
D. Restrict public investment in services, facilities or activities which are likely
to encourage new permanent development in erosion hazard areas. (Not
applicable)
E. Regulate the construction of erosion protection structures in coastal areas
subject to serious erosion to assure that when the construction of erosion
protection structures is justified, their construction and operation will minimize
or prevent damage or destruction to man-made property, private and public
property, natural protective features and other natural resources. (Not
applicable) the property is protected by a bulkhead and vegetative buffer.

consideration for the issuance of the Permit does understand.and prescribe to the following:
L That the said Board of Trustees and the Town of Southold are.released from any and all
damages,or claims for damages, of suits arising
sing directly or indirectly as a result of any
operation performed pursuant to this permit,and the said Permittee will, at his or tier own
expense,defend any and All such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees
of the.Town of Southold.
2. That this Permit is valid for a period of 36 months,which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the-work involved will be subject to the inspection and approval of the Board or its
agents,and non-'compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5 That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6, That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in the
location of the work herein authorized,or if, in the opinion of the Board of Trustees,the work
shall cause unreasonable obstruction to free navigation,the said Permittee will be required,
upon due notice,to remove or alter this work project herein stated without expenses to the
Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office�as a notice covenant and deed restriction to
the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar
days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
-authorized.
10. That the Permittee will obtain'all othei permits and consents that may be required
supplemental to this permit,which may be subject,to revoke upon failure to obtain same.
11. No'right to trespass or interfere with riparian rights. This permit does pot convey to the
pennittee any right to trespass upon the lands or interfere with the riparian rights of others in
order to perform the permitted work nor does it authorize the impairment of any rights,title,
or interest in real or personal property held or vested in a person not a party to the permit.

Dear Ms. Moore:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, August-13, 2025 regarding the above matter:
WHEREAS, Patricia C. Moore, Esq. on behalf of 536 BAYVIEW, LLC applied to the
Southold Town Trustees for a permit under the provisions of Chapter 111 of the
Southold Town Code, the Coastal Erosion Hazard Areas Ordinance of the Town of
Southold,*application.dated May 29, 2025; and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP under Policy 4 - minimize losses of human life and
structures from flooding and erosion hazards, and Policy 6.3 - protect and restore tidal
and freshwater wetlands, as a permanent, non-miovable structure is located seaward of
the Coastal Erosion Hazard Area line; and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on August 13, 2025, at which time all.interested persons were given an
opportunity to be heard; and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area; and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application; and,
WHEREAS, the proposal of 536 BAYVIEW, LLC a permit for all of the existing
structures on the property consisting of a 42.600.5' 1 & Y2 story dwelling with seaward

16.4'x28' on-grade paver patio; an 8.1'x31.T wood-tie curb area; and for 3'x6.4' wood
steps in pathway down to 2.6'x9' beach stairs seaward of the Coastal Erosion Hazard
Area line as per Chapter 111 of the Southold Town Code; and,
WHEREAS, Chapter 111-10(B) prohibits the construction of non-movable structures as
applied for herein within the structural hazard area;
WHEREAS,.Chapter 111-8 prohibits any regulated activity in an.erosion hazard area'
without first obtaining a coastal erosion management permit; the application herein
requests approval for regulated activities constructed and placed without a CEHA
permit;
WHEREAS,.the.42.5'x30.5' 1 & Y2 story dwelling'with seaward 16.4'x28' on-grade paver
patio are larger,than permitted under Chapter 111 of the Southold Town Code, Coastal
Erosion Hazard Areas; and,
NOW THEREFORE BE IT
RESOLVED, that the Board of Trustees DENIES the application of 536 BAYVIEW, LLC
for all of the existing structures on the property consisting of.a 42.5'x30.5' 1 & % story
dwelling with seaward 16.4'x28' on-grade paver patio, 7.8'x22' front open wood porch
with a garage below that has a 69.69sq.ft. concrete driveway with retaining walls for

opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in,question and the surrounding area, and;
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and, ,

WHEREAS, the project complies With the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as,proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management

Permit to construct and complete project will expire three years from the dame the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.

Regarding the Appeal process,you will also need the Trustees Wetland Permit as well as the denial. Again the revised
plans needed the addition of gutters to leaders to drywells installed with the drywells installed landward of the dwelling
within one year of the issuance of the permit. Also to establish and perpetually maintain a vegetated non-turf buffer
within the area located three (3)feet seaward of the edge of the bocce ball court along the top of the bank.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of
the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP)
Policy Standards. Based upon the information provided on the LWRP Consistency
Assessment Form submitted to this department, as well as the records available to me, it is
my recommendation that the action is INCONSISTENT with Policies 4 and 6.3 of the
LWRP.
