Dear Mr. Goggins;
After an initial review of the two (2) applications that you have prepared in order to submit to the
Zoning Board of Appeals, the Zoning Board of Appeals ("Board")has determined that the following
documents should be included before your application can be deemed complete:
1. Two current original surveys of Existing Conditions certified by licensed surveyor
2. Site Plan of Proposed Improvements in accordance with Article XXIV, Section 280-133 B of the
Southold Town Code.
3. Completion of a Full Environmental Assessment Form (FEAF) so that a comprehensive review
can be conducted under the State Environmental Quality Review Act(SEQR). (Enclosed)
Please be advised that pursuant to Section 280-35 A(4) of the Southold Town Zoning Code, hotels
are permitted by Special Exception and are subject to site plan approval by the Planning Board,
provided that the subject hotel meets the following criteria:
(a) Minimum parcel size shall be five acres.
(b) The maximum number of guest units shall be:
[1] One unit per 6,000 square feet of land without public water or sewer.
[2] One unit per 4,000 square feet of land with public water and sewer.
(c)No music, entertainment or loudspeaker system shall be audible from beyond the property
line.
(d) The maximum size of a guest unit shall be 600 square feet.
Please provide this Board with a written narrative describing how the proposed hotel is consistent
with the above outlined requirements. If the requirements of 280-35 A (4) cannot be met, the project
plans will have to be amended or the application will have to be amended to also include a request for

any necessary variance relief. By way of example, it has been determined, after a cursory review,
that the number of proposed guest units exceed what is allowed pursuant to 280-35A(4). Therefore,
at the very least, it appears that the plans must be amended to show a number of guest units in
conformance with 280-35 A(4), or the application must be amended to include a request for variance
relief.
Furthermore, due to the scope and cumulative impact assessment required for the above referenced
project, the Board will retain an environmental consulting firm to provide assistance with the review
of the project pursuant to the State Environmental Quality Review Act(SEQRA); the cost of which
will be borne by the applicant. You will be informed of the environmental services fee once the
requested site plan, survey and FEAF have been reviewed.

The applicant proposes a Hotel at the site pursuant to Southold Town
Zoning Code Section 280-35 A (4), which requires a minimum parcel of five
(5) acres, 4,000 square feet of land per hotel unit with public water and
sewer, no music or loudspeaker system audible from beyond the property
lines, and guest units less than 600 square feet per unit.
The applicant meets the parcel size requirement of five (5) acres. The
applicant has public water at the site. The applicant will install a sewage
facility under the guidelines of the Suffolk County Health Department.
There will not be audible music and entertainment beyond the property lines,
and the individual hotel units will be less than 600 square feet per unit.
The subject parcel is zoned General Business containing 325,273
square feet of area. Based upon the criteria set forth in Section 280-35 A (4)
the permitted number of rooms is eighty-one (81) hotel rooms. The
calculation is: 325,273 sq. ft./ 4,000 sq. ft. = 81.318
The applicant seeks an area variance for relief from the limitation of
an eighty-one (81) room hotel applying for a two hundred (200) room hotel.
