Weisman April 13, 2023 ZBA Chairperson Zoning Board of Appeals Town Hall Annex, 53095 Main Road Southold, New York 11971 Re: Code Interpretation — Meaning of the phrases "community water and sewer" and "public water and sewer" Dear Ms. Weisman: I have received your memorandum dated March 21, 2023, requesting assistance with the meaning of the phrases "community water and sewer" and "public water and sewer" in §280 of the Southold Town Code. Community Water and Sewer Please note that sewers and water supplies in the Town of Southold are regulated by the Suffolk County Department of Health Services. §760-603 (Definitions) of the Suffolk County Sanitary Code states the following: • Community Sewerage System means a system utilized for the collection and disposal of Sewage or other waste of a liquid nature, including the various devices for the treatment of such wastes, serving more than one parcel, whether owned by a municipal corporation, private utility, or otherwise. • Community Water System means a source of water and necessary appurtenances together with a distribution system serving more than one parcel, whether owned by a municipal corporation, private utility, or otherwise. It is clear from these definitions that Community Sewerage System and Community Water System are terms applied to systems that serve more than one parcel. Public Water and Sewer §280-4 (Definitions) of the Code of the Town of Southold states the following: • Public Water: Public Sewer— Communal sewage disposal systems and communal water supply systems as approved by public agencies having jurisdiction therof. It is clear from this definition that it applies to a Community System approved by a public regulatory agency.
