This application is for a Wetland Permit for the as-built clearing of an approximately 10-
foot wide by 80-foot-long area, and to revegetate this area using native vegetation; and
to establish and perpetually maintain a 10' wide vegetated non-turf buffer area along the
landward edge of the 100-foot jurisdictional edge/line.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency
Review of the Town of Southold Town Code and the Local Waterfront Revitalization
Program (LWRP) Policy Standards. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records
available to me, it is my recommendation that the proposed action is CONSISTENT with
the policies of the LWRP as follows:
6.1. Protect and restore the quality and function of Town of Southold's ecosystem.
B. Protect and restore ecological quality by adhering to the following measures.
2. Retain and add indigenous plants to maintain and restore values of natural ecological
communities.
b. Include the use of suitable indigenous plants in the landscaping plans
for new development and in redevelopment projects where loss or
disturbance of existing indigenous plants could not be prevented during
construction.
3. Avoid fragmentation of ecological communities and maintain corridors to facilitate the
free exchange of biological resources with and among communities.
b. Where fragmentation of ecological communities has already occurred,
the adverse effects of fragmentation can be mitigated by maintaining or
providing connecting corridors to allow exchange of biological resources.
6.3. Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town
Board of Trustees laws and regulations for all Andros Patent and other lands
under their jurisdiction.
C. Prevent the net loss of vegetated wetlands according to the following
measures. Use the measure resulting in the least environmentally damaging
practicable alternative.
3. Provide compensatory mitigation for adverse impacts with may result
from the unavoidable fill, excavation or other activities remaining after all
appropriate and practicable minimization has been accomplished.
a. Restore former wetlands or create new tidal wetlands according
to the followinn priorities;
(i) Restore former wetlands or create new tidal wetlands in
areas adjacent to or contiguous to the site.
Condition to consider:
Prior to any re-planting of this area, all fill should have been removed to restore the pre-
disturbance elevations. Without this, wetland species cannot survive. While the

proposed (executed?) plan does utilize a list of what can generally be considered
"native" wetland species, the genus and species are not listed and many of plants
selected are not suitable for this site. As the site exists, the soil and hydrology will not
support several of the obligate wetland species selected. If the intention of this action
was to mitigate for the initial clearing and filling, the fill should have been removed, and
species selection should have been different. In addition, consider installation of a split
rail fence or similar to define the upland edge of the 100ft set-back (with buffer) to
prevent future mowing or other disturbance in this area.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency
Review of the Town of Southold Town Code and the Local Waterfront Revitalization
Program (LWRP) Policy Standards.

Applied for to mitigate the accidental clearing of the freshwater wetland vegetation near the 100-foot wetlands
line.
We met with professionals,ordered native plants,created a landscaping/revegetation plan for the area that was
cleared,and used the plants named below to create the requested 10' non-turf buffer within the 100-foot Trustee
jurisdictional area,as well as an additional ten (10)foot wide vegetated non-turf buffer area along the landward
edge of the 100-foot jurisdictional edge/line.

The goal of the attached plans is to remedy the mistakes made by my excavator with native plants that both fulfil
your requirements,AND provide a beautiful water and streetscape for the island,the neighborhood and the water
community. To formulate the attached plans,we got input from neighbors,and worked with David Burnham from
Race Rock Landscaping,and Patrick and Graham at New England Wetland Plants.
