SCTM# 1000-78-2-27 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposal is INCONSISTENT with the LWRP. The proposal is to extend the dock's footprint by adding a 4' x 20' fixed "T" section, which is inconsistent with Policy Standard 9.4 Assure public access to public trust lands and navigable waters. The creek is very narrow at this location with less than 40' between the end of the existing dock and the structure on the opposite shore. Adding the "T" section extends the length of the structure into the creek by an additional six feet (survey of existing shows a 28' dock, proposed is at 34') The remainder of the project could be found consistent if the "T" section is not added, and the new dock, after construction, remains in the same footprint as the existing. The new design incorporates best.practices to protect the intertidal zone and meet LWRP policies including the following: Policy Standard 6.3 Protect and restore tidal and freshwater wetlands The catwalk Is elevated at least four feet above grade in,the intertidal zone and constructed with light penetrating open grate decking so as to not impede the potential growth of vegetation beneath it. This will replace the existing solid decking to minimize adverse impacts to the tidal wetlands.
