To whom it may concern,
This letter shall serve to certify that all of the units 1-19& the Pavilion were tested at
200lbs for a period of 2 hours and there was no change in pressure. This test was witnessed by
Gregory E.Sulger and Thomas P. Walsh.All of the lines have since been filled with glycol for
freeze protection. Therefore, a water flow test cannot be conducted without compromising the
system.A manual test was performed on all of the water flow switches.All alarms are active.

The Planning Board has found that the requirements of the above-referenced Amended
Site Plan have been completed based on the site inspections made September,14,
2025 and October 10, 2025; and, the Planning Board work session on October 20,
2025. The approved structures and associated improvements are in general
conformance with the approved amended site plan entitled "Eastern Long Island
Kampground" prepared by John J. Condon P.E., dated December 16, 2019, and last
revised September 24, 2020. Contingent upon the site's-continued compliance with all
applicable provisions of the Town Code, the Planning Board supports the issuance of a
Certificate of Occupancy by the Building Department.
This letter does not condone any changes from the approved site plan and approvals
from other agencies; Planning Board approval is required prior to any significant
changes to the site.

SERA DETERMINATION: The Southold Town Zoning Board of Appeals declared Lead Agency
status for the SEQRtA review of the special exception application and an—uncoordinated review was
conducted. It was determined that this is an Unlisted Action pursuant to State Environmental Quality
Review Act(SEQRA)6 NYCRR,Part 617, as it does not meet any of the thresholds of a Type I Action,
nor does it meet any of the criteria on the Type ll list of actions and that the Southold Town Zoning Board
of Appeals,pursuant to SEQRA,hereby made a determination of non-significance for the proposed action
and grants a Negative Declaration.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was'referred-as required under the
Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of
Planning issued its reply dated January 24, 2020 stating that this application is considered a matter for.
local determination as there appears to be no significant county-wide or inter-community impact.
LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed
under the Minor Actions exempt list and is not subject to review under Chapter 268.
TOWN OF SOUTHOLD PLANNING BOARD: The Planning Board offered comments on this
application in their June 24, 2020 memorandum. The Planning Board generally has no objection to the
Special Exception and cabin size due to the fact that the existing site and.use thereof received Special
Exception approval in 1976 and Site Plan approval in 1976 and 2005. The Planning Board currently has
not endorsed a Site Plan for this proposal and reserves the right to make any necessary changes to the Site
Plan after reviewing all proposals thoroughly.
PROPERTY FACTS/DESCRIPTION: Subject property consists of 23.61 acres located in the Resort
Residential (RR)Zoning District. The property is a campground with both mobile&tent sites currently
available. The property is improved with an office/bathroom facility, sites for mobile homes, and tent
camping sites.
BASIS OF APPLICATION: Request for Special Exception per Code Section 280-35B(5) and Town
Code Article 1, Section 253-1, the applicant is requesting permission to alter the existing Tourist and

Trailer campground by removing twenty(20)tent sites.and constructing twenty(20)seasonal cottages,'as
well as variances for twenty(20) cottages measuring 504 sf where the code only allows cottages to
measure a maximum of 450 SF in size; located at: 64500 County Rd 48,Greenport,SCTM# 1000-40-3-5
VARIANCE RELIEF REQUESTED: The applicant's proposal was amended to convert 33-existing tent
camping sites to 20 seasonal use cabins of approximately 504 sq. ft. with an exterior covered porch,
where only 450 sq. ft. cabins are allowed. The cabin floor plans also depict a 90 sq. ft. covered porch to
be attached to the cabins for an overall size of 594 sq. ft. In addition, a 600 sq. ft. pavilion with an
exterior deck will also be constructed.
ADDITIONAL INFORMATION: The proposed 20 cottage sites are a reduction of the currently 33
existing tent.sites. There are certificates of occupancy for all of the existing campground buildings &
inground swimming pool. The current site.plan was approved in 2006, and allows for 63 seasonal RV
sites, 90 short term RV/Pop Up sites, and 33 tent sites. The site plan also approves 186 parking spots
with an 80-car overflow. The original campground &trailer park came about from a Special Exception
permit approval ZBA file#2147 dated July 22, 1976.
A Letter of No-Jurisdiction was issued by the New York State Department of Conservation (NYSDEC)
indicating that no permit is required from the agency, but advised that no construction, disturbance,
clearing or sedimentation of any kind may take place within 100 feet of NYS regulated freshwater
wetlands without a permit.
SPECIAL EXCEPTION:
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on August 6,2020 at which time
written and oral evidence were presented. Based upon all testimony,documentation,personal inspection
of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following
facts to be true and relevant and makes the following findings:
The Board has reviewed the General Standards governing Special Exception uses set forth in Section 280-
142 and finds:
A. That the use will not prevent the orderly and reasonable use of adjacent properties or of properties
in adjacent use districts. The subject property has legally existed as a tourist camp since 106 without
adverse impacts
B. That the use will not prevent the orderly and reasonable use of permitted or legally established
uses in the district wherein the requested use is Iocated or of permitted or legally established uses.in
adjacent use districts.No new uses are being proposed in this application
C. That the safety, the health,the welfare,the comfort,the convenience or the order of the town will
not be adversely affected by the proposed use and its location. The proposed cabins will meet all
county sanitary regulations and will be serviced by Suffolk County Water and Greenport Village
Sewer System. The site is readily accessible to fire and police protection.

E. That the use will be compatible with its surroundings and with the character of the neighborhood
and of the community in general, particularly with regard to visibility, scale and overall appearance.
The property is screened from the road, and is adjacent to Moore's Woods.
F. That all proposed structures, equipment and material shall be readily accessible for fire and police
protection.The existing unimproved road will be widened for better fire and police access and the
campground has its own fire emergency plan and fire truck on site
G.That the proposal shall comply with the requirements of Chapter.236, Stormwater Management
In making such determination, consideration was also given to:
A. The character of the existing and probable development of uses in the district and the
peculiar suitability of such district for the location of any of such permitted uses.
B. The conservation of property values and the encouragement of the most appropriate uses
of land.
C. The effect that the location of the proposed use and the location that entrances and exits
may have upon the creation or undue increase of vehicular,traffic congestion on public
streets,highways or sidewalks to assure the public safety.
D. -The availability of adequate and proper public or private water supply and facilities for
the treatment,removal or discharge of sewage,refuse or other effluent(whether liquid,
solid, gaseous or otherwise)that may be caused or created by or as a result of the use.
E. Whether the use or the materials incidental thereto or produced thereby may give off
obnoxious gases,odors,smoke or soot.
F. Whether the use will cause disturbing emissions of electrical discharges,dust,light,
vibration or noise.
G. Whether the operation in pursuance of the use will cause undue interference with the
orderly enjoyment by the public of parking or of recreational facilities, if existing or if
proposed by the Town or by other competent governmental agencies.
H. The necessity for bituminous-surfaced space for purposes of off-street parking of vehicles
incidental to the use and whether such space is reasonably adequate and appropriate and
can be furnished by the owner of the plot sought to be used within or adjacent to the plot
wherein the use shall be located.
I. Whether a hazard to life, Iimb or property because of fire, flood, erosion or panic may be
created by reason of or as a result of the use or by the structures to be used therefor or by
the inaccessibility of the property or structures thereon for the convenient entry and
operation of fire and other emergency apparatus or by the undue concentration or
assemblage of persons upon such plot.
J. Whether the use or the structures to be used therefor will cause an overcrowding of land
or undue concentration of population.
K. Whether the plot area is sufficient, appropriate and adequate for the use and the
reasonably anticipated operation and expansion thereof.
L. Whether the use to be operated is unreasonably near to a church,school,theater,
recreational area or other place of public assembly.

O. Whether adequate provision can and will be made for the collection and disposal of
stormwater runoff, sewage, refuse and other liquid,solid or gaseous waste which the
proposed use will generate.
P. Whether the natural characteristics of the site are such that the proposed use may be.
introduced there without undue disturbance or disruption of important natural features, .
systems or processes and without risk of pollution to groundwater and surface waters on
and off the site.
AREA VARIANCE:
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on August 6,2020 at which time
written and oral evidence were presented. Based upon all testimony,documentation,personal inspection
of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following
facts to be true and relevant and makes the following findings:
1. Town Law§267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the
character of the neighborhood or a detriment to nearby properties. The area where the proposed cabins
are to be located is already cleared for tent camping sites with parking. Due to the size of the property,
and it being adjacent to Moore's Woods,there will be no detrimental effect to the surrounding
neighborhood.
2. Town Law 6267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved.by some method,
feasible for the applicant to pursue., other than an area variance. The proposed cabins are 504 sq.ft. with
a 90 sq. ft. covered porch, (total 594 sq.ft.)which is more than the allowable 450 sq..feet.The applicant's
agent stated that the applicants,determined that they could not adequality fit the modern day needs of
potential campers within the size limits currently permitted by code.
3. Town Law §267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing
12%relief from the code.However,this variance is mitigated by the fact that the sites are already cleared
for tent camping with prior approvals,the overall square footage for all of the cabins will only be 10,080
square feet of. lot coverage over a 23.61-acre property, and that site plan approval by the Planning Board
will be required.
4. Town Law 5267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this
residential community will have an adverse impact on the physical or environmental conditions in the
neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management
Code and conditions set by this board.
5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel
after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive
knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the
time of purchase.
6. Town Law U67-b. Grant of the requested relief is the minimum action necessary and adequate to
enable the applicant to enjoy the benefit of 20 seasonal rental cabins while preserving and protecting the
character of the neighborhood and the health,safety and welfare of the community.

RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test
under New York Town Law 267-B,motion was offered by Member Lehnert,seconded by Member
Weisman(Chairperson),and duly carried,to
GRANT, a Special Exception, as applied for,and GRANT the variance as applied for,as shown on the
Site Plan and Architectural Plans prepared by John J.Condon,LPE, last revised February 17,2020,
SUBJECT TO THE FOLLOWING CONDITION:
1. The applicant must obtain site plan approval from the Planning Board.Failure to do so will
render this Special Exception Permit and variance relief null and void.
NOTE. Violations of Conditions. A violation of any limitation or condition of a special
exception approval or of any provision of this chapter applicable to a special exception
use shall constitute a violation of this chapter. The Zoning Board ofAppeals shall retain
jurisdiction and shall have the right, after a public hearing to modify, suspend or revoke
such approval or any term or condition thereof or to impose thereon one or more new
conditions,pursuant to Article XXv Section 280-141 of the Town Code.
Any deviation from the variances) granted herein as shown on the architectural drawings, site plan
and/or survey.cited above, such as.alterations, extensions, or demolitions, are not authorized under this
application when involving nonconformities under the zoning code. This action does not authorize or
condone any current or future use, setback or other feature of the subject property that.may violate the
Zoning Code, other than such uses, setbacks and other features as are.expressly addressed in this action.
In the event that this.is an approval subject to conditions, the approval shall not be deemed effective until
such time that the foregoing conditions are met,and failure to comply therewith will render this approval
null and void.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration.

Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the
Board of Appeals shall become null and void where a Certificate of Occupancy has not been
procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three
(3)years from the date such variance was granted. The Board of Appeals may,upon written
request prior to the date of expiration,grant an extension not to exceed three(3)consecutive one(1)
year terms.

WHEREAS, this amended site plan is to replace 33 existing tent sites with the proposed
