Vice-Chairperson Jealous-Dank: Good evening and welcome to the Special Meeting for
Monday, January 6, 2025 for the Southold Town Planning Board. This meeting is public. The
Planning Board may add or remove applications from the agenda upon its discretion, without
further notice. Applications may not be heard in the order they appear on this agenda.
SUBDIVISION 'APPLICATIO+NS
DETERMINATION
Vice-Chairperson Jealous-Dank: Dignans Resubdivision —This proposed
Resubdivision is to merge SCTM#1000-83.-2-7.4 and 7.5 to create a single 4.76-acre
parcel in the R-80 Zoning District. The property is located at 2100 & 2240 Dignans
Road, Cutchogue. SCTM#1000-83.-2-7.4 & 7.5

Pierce Rafferty:
WHEREAS, on September 10, 2024, the applicant submitted a Resubdivision
application for review by the Southold Town Planning Board; and
WHEREAS, this Resubdivision proposes to merge SCTM#1000-83.-2-7.4 and 7.5 to
create a single 4.76-acre parcel in the R-80 Zoning District; and
WHEREAS, at their work session on December 2, 2024, the Southold Town Planning
Board found the Resubdivision application complete; and
WHEREAS, pursuant to §240-56 Waivers of certain provisions, the Southold Town
Planning Board shall have the authority to modify or waive, subject to appropriate
conditions, any provision of these subdivision regulations, if in its judgment they are not
requisite in the interest of the public health, safety and general welfare,'except where
such authority would be contrary to other ordinances or state law; and
WHEREAS, the Southold Town Planning Board has determined that the following
provisions of the Southold Town Code §240 Subdivision of Land are not requisite in the
interest of the public health, safety and general welfare because this Resubdivision
does not create any additional residential building lots, and the amount of land being
transferred from one lot to the other is small, and therefore are eligible for a waiver:
a. Sketch Plat Review;
b. Existing Resources Site Analysis Plan (ERSAP);
c. Yield Plan;
d. Primary & Secondary Conservation Area Plan;
e. Preliminary Plat Review;
f. Public Hearing on Final Plat; and
WHEREAS, pursuant to the Resubdivision policy set by the Planning Board on
February 2011, this application is eligible for a decision from the Planning Board prior to
receiving approval by the Suffolk County Department of Health Services (SCDHS) as it
meets the following criterion set forth in that policy:
• Where no new development potential will be created in the parcel to which the
land is transferred; and
WHEREAS, this application is EXEMPT from review by the Local Waterfront
Revitalization Program as no new development potential will come as a result of this
Resubdivision; and
WHEREAS, the Southold Town Planning Board, pursuant to State Environmental
Quality Review Act (SEQRA) 6 NYCRR, Part 617, has determined that the proposed
action is a Type II Action under SEQRA according to 617.5(c)(16) "granting of individual
setback and lot line variances and adjustments;" therefore be it

RESOLVED, that the Southold Town Planning Board, pursuant to §240-56 Waivers of
certain provisions, hereby waives the following provisions of subdivision:
a. Article V: Sketch Plat Review;
b. §240-10 (A): Existing Resources Site Analysis Plan (ERSAP);
c. §240-10 (B): Yield Plan;
d. §240-10 (C): Primary & Secondary Conservation Area Plan;
e. Article VI: Preliminary Plat Review & Public Hearing;
f. Article VII: Public Hearing on Final Plat;

BOND REDUCTION
Vice-Chairperson Jealous-Dank: The Fields at Mattituck—This approved major
subdivision is for the subdivision of a 60.42-acre parcel into 27 lots. The property is
located at 2530 Stanley Road, Mattituck. SCTM#1000-113-2-1.1
Vice-Chairperson Jealous-Dank:
WHEREAS, this Standard Subdivision divided 60 acres into 27 lots including a new
road proposed to be dedicated to the Town of Southold as a public street; and
WHEREAS, on September 14, 2004, the Southold Town Planning Board resolved to
accept a Stipulation of Settlement to approve this subdivision, including a Bond
Estimate in the amount of$588,343; and
WHEREAS, on June 3, 2005, the Town of Southold received an Irrevocable Standby
Letter of Credit ("ISLC") in the amount of$588,343, dated May 18, 2005 from the North
Fork Bank (aka Capital One) on behalf of the applicant Winhaven Associates LLC; and
WHEREAS, much of the required public improvements were constructed in subsequent
years, however they were never completed and were not maintained, causing the
drainage system to fail; and
WHEREAS, the current landowner requested a revised bond estimate; and
WHEREAS, on December 2, 2020, Michael Collins, Town Engineer, after inspecting the
site and condition of the improvements, recommended an updated bond amount of
$327,320; and
WHEREAS, the landowner submitted a Wells Fargo Bank, N. A. Irrevocable Standby
Letter of Credit number IS000175029U issued on March 8, 2021, in the amount of
$327,320, accepted by the Planning Board and the Town Board; and

WHEREAS on December 16, 2024, following a discussion with the Planning Board at
their work session, the applicant submitted a request to reduce the performance
guaranty amount with details of the line items that have been completed; and
WHEREAS the Town Engineer has reviewed the request to reduce the amount of the
performance guaranty and provided a Revised Bond Estimate dated December 23,
2024, in the amount of$110,660.00 for the items remaining to be completed; and
WHEREAS, the Planning Board has found the line item for $44,400 for the required
street trees can be reduced to zero after finding that the street trees have been planted
to their satisfaction. The amount of the remaining performance guaranty can be reduced
by another $44,400, for a total reduction of$261,060; be it therefore
RESOLVED, that the Planning Board hereby accepts a reduction in the performance
guaranty from $327,320 to $66,260 for the Fields at Mattituck Subdivision and
recommends.that the Town Board accepts same.

SEQRA CLASSIFICATION/ SET HEARING
Vice-Chairperson Jealous-Dank: Old Sound Winery & Farmhouse —This Site Plan
proposes a 4,800 sq. ft. winery with a tasting room and basement storage, preserving
an existing greenhouse and barn/potting shed, and repurposing a historic blacksmith
shop for storage. The plan includes 29 parking stalls, pedestrian access to the winery, a
building envelope for a future farmhouse, and designated areas for agricultural
plantings. After Resubdivision, the 12.59-acre parcel spans R-40 (±0.74 acres) and R-
80 (±11.85 acres) zoning in Mattituck. The property is located at 10020 & 9650 Sound
Avenue, Mattituck. SCTM#1000-122.-2-8.1 & 24.4

WHEREAS, this Site Plan application is for proposed construction of a 4,800 sq. ft.
winery with a tasting room and basement storage, preserving an existing greenhouse
and barn/potting shed, and repurposing a historic blacksmith shop for storage. The plan
includes 29 parking stalls, pedestrian access to the winery, a building envelope for a
future farmhouse, and designated areas for agricultural plantings. After Resubdivision,
the 12.59-acre parcel spans R-40 (±0.74 acres) and R-80 (±11.85 acres) zoning in
Mattituck.; and
WHEREAS, the Southold Town Planning Board, pursuant to State Environmental
Quality Review Act (SEQRA) 6 NYCRR, Part 617, has determined that the proposed
action is an Unlisted action as it does not meet the criteria for a Type I or Type II action;
be it therefore
RESOLVED, that the Southold Town Planning Board has determined that this proposed
action is an Unlisted Action under SEQRA as described above;
