(631)765-1809 `� t '' FINDINGS,DELIBERATIONS AND DETERMINATION MEETING OF OCTOBER 16,2025 ZBA FILE No.: 8047 NAME OF APPLICANT: Gregory White PROPERTY LOCATION: 550 Locust Lane, Southold,NY SCTM#1000-62-3-31 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property,a non-conforming 6,891 square foot parcel in the R-40 Residential Zoning District,is lot 55 in the map of Founders Estates filed with the Town of Southold and with Suffolk County May 10, 1927. The property has 50.00 feet fronting Locust Lane; the southerly property line runs 137.81 feet along an adjacent residential property to the rear property line, which runs 50.00 feet to the northerly property line, which runs 137.81 feet back to Locust Lane. The property is developed with a one-and-one-half story frame dwelling, an asphalt driveway, a covered.entry way, and a rear paver patio, all as shown on the survey prepared by Nathan Taft Corwin II1,Land Surveyor, last revised January 27, 2025 showing the proposed improvement. BASIS OF APPLICATION: Request for Variances from Article IV, Section 280-18;Article XXXVI, Section 280- 208; and the Building Inspector's May 14, 2025 Notice of Disapproval based on an application for a permit to construct first and second story additions to an existing single family dwelling; at: 1) located less than the code required minimum front yard setback of 35 feet; 2) located less than the code required minimum side yard setback of 10 feet; 3) located less than the code required minimum combined side yard setback of 25 feet;4)the construction exceeds the permitted sky plane as defined in Article I, Section 280-4 of the Town Code located at: 550 Locust Lane, Southold,NY. SCTM No. 1000-62-3-31. RELIEF REQUESTED: The applicant requests variances to enlarge the dwelling including enclosing a front porch to expand a bedroom by approximately 85 square feet; removing a side porch and adding rnudroom and entry porch; constructing an addition on the rear of approximately 294 square feet to create a dining room; and constructing a 137.5 square foot porch in the rear. In addition,the project proposes to raise the second-floor roof to convert a loft, storage, and HVAC space to 410 square feet of livable area,adding two bedrooms and one bathroom. The house as constructed has a non-conforming 2.7-foot side yard setback, where a minimum of 10 feet is required, and a non- conforming 21.6-foot front yard setback, where a minimum of 35 feet is required, both of which remain unchanged with the proposed additions. As built,the house has a nonconforming combined side yard setback of approximately 21.6-feet which the project reduces to 19.4 feet, where a combined side yard setback of 25 feet is required. All measurements are as shown on the survey prepared by Nathan Taft Corwin III, Land Surveyor, last revised January 27, 2025 and the plans titled "Proposed Alteration to the: White Residence" prepared by Charles M Thomas, Architect, dated December 9, 2024 (Proposed Addition / Alteration), October 3, 2024 (Existing Elevations), and October 2, 2024(Existing Plans). ADDITIONAL INFORMATION: The dwelling is covered by Certificates of Occupancy No.42714 dated January 31, 2022 pursuant to Building Permit No. 47339 dated January 13,2022 for"as built"alterations, including HVAC, hot water heater,bathroom, kitchen and finished loft. The dwelling is covered by Pre-Existing Certificate of Occupancy No. 42715 dated January 31,2022 for a wood frame single family dwelling with a covered front porch. During the public hearing a neighbor expressed concerns about potential damage to his fence during construction and about visibility from the proposed second floor to his back yard. I FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 2, 2025 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The house is located in the Founders Landing neighborhood, which was laid out in 1927,prior to zoning,and many of the lots are small and non-conforming. The front yard and side yard setbacks are existing and the proposed project does not alter them;the house immediately to the south has a smaller front yard setback. The project does reduce the combined side yard setback from 21.6 feet to 19.4 feet; however, this is due exclusively to the existing northerly nonconforming 2.7-foot side yard setback; the southerly side yard setback remains conforming. The neighborhood has a mix of one, one-and-one-half, and two-story dwellings and adding a functional second floor to the subject dwelling, although it exceeds the skyplane,will be in character with other homes in the area. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. Due to the existing non-conforming front yard and side yard setbacks, any addition would require area variances. The existing non-conforming side-yard setback is so small as to preclude a reasonable second floor addition without a skyplane encroachment. 3. Town Law V67-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 38.3% relief from the code for the front yard setback, 73% relief for the side yard setback, 22.4% relief for the combined side yard setback, and 100% for the skyplane. However the front and side yard setbacks have been in place for the life of the dwelling,the project reduces the pre-existing combined side yard setback by only 1.2 feet,and the skyplane will be exceeded only in the front approximately 17 feet of the dwelling,thereby limiting its impact and any detriment to the community. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an enlarged first floor and a functional second floor while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD:In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Steinbugler, seconded by Member Acampora, and duly carried,to GRANT the variances as applied for,and shown on the survey prepared by Nathan Taft Corwin 111,Land Surveyor, last revised January 27, 2025, and on the plans titled "Proposed Alteration to the: White Residence" prepared by Charles M Thomas,Architect, dated December 9,2024(Proposed Addition/Alteration), October 3,2024(Existing Elevations), and October 2,2024(Existing Plans). SUBJECT TO THE FOLLOWING CONDITION: 1. The septic system on the subject property must be approved by the Suffolk County Department of Health Services. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appealsfailure to comply with the above conditions may render this decision null and void. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity, provided de minimis relief,is requested within one year of the date of this decision. Any time after one year,the Board may require a new application. IMPORTANT LIMITS ON THE APPROVAL(S) GRANTED HEREIN Please Read Carefully Any deviation from the survey,siteplan and/or architectural drawings cited in this decision,or work exceeding the scope of the relief granted herein, will result in delays and/or a possible denial by the Building Department of a building permit and/or the issuance of a Stop Work Order, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings,site plan and/or survey cited above,such as alterations, extensions, demolitions;or demolitions exceeding the scope of the relief granted herein, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code,other than such uses,setbacks and other features as are expressly addressed in this action. While I did;riot find any properties within the Founders Landing neighborhood that have received sky.plane relief— as no such applications appear to have been made— I located approvals elsewhere in the-Town of Southold for projects of a similar nature.. The following Zoning Board of Appeals applications were granted relief for exceeding sky plane requirements: • Appeal #7918- 2440 Village Lane, Orient: Granted 100% sky plane relief to remove the existing roof over the garage and construct a new roof and dormer to accommodate a proposed bedroom. The existing nonconforming side yard setback of 5.3 feet was maintained. The second-floor roof and dormer that extend beyond the allowable sky plane are a direct result of the existing setback conditions. (See Attachments). • Appeal #7878- 560 Oak Street, Cutchogue: Granted sky plane relief for a second-floor addition, which expanded an existing nonconforming side yard setback of 3.2 feet (See Attachments). These approvals represent projects comparable in scale and intent to the one proposed at 550 Locust Lane, each involving modest residential expansions within existing side yard constraints. Given the existing lot configurations and setback conditions within the Founders Landing area, it is reasonable to conclude that many existing homes — if seeking to expand or renovate —would similarly require sky plane relief. The neighborhood's established character includes homes situated on narrow lots with limited side yards, which makes strict adherence to the sky plane regulation particularly challenging. So Our proposed dormer addition at.550 Locust Lane is designed to expand second-floor living space.to better accommodate the family's needs while maintaining architectural harmony with the surrounding homes. By opting for a dormer rather than a full second-story addition, we are able to preserve a lower overall building height and keep the existing roof in the back of the house which is consistent with the neighborhood's scale and aesthetic. This design approach also allows the project to remain financially feasible for the homeowner.
