ZBA Application No.: 8040SE Applicants/Owners: Donald H Laslcey, III Property Location: 855 Horton Avenue,Mattituck,NY SCTM No.1000-11 1-24.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions,without further requirements under SEQRA. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt'list and is not subject to review under Chapter 268. REQUEST MADE BY APPLICANT. The Applicant-Owner requests a Special Exception under Zoning Code Section 280-13(B)(13)to legalize an Accessory Apartment in an existing accessory structure. PROPERTY FACTS/DESCRIPTION: The subject property is a nonconforming 20,830 square foot parcel located in the R-40 Zoning District. The northerly property line measures 124.14 feet,the easterly property lire measures 150.00 feet,the southerly property line measures 175.23 feet and is adjacent to Horton Avenue and the westerly property line measures 139.24 feet. The parcel is improved with a one- story single family frame residence and a detached two-car garage with a second story area as shown on the survey prepared by John Minto,LS, dated August 8,2016 and drawing A-01,Laskey Residence Garage Apartment,prepared by Eric Eugene Peterson,Registered Architect, dated April 9, 2025. ADDITIONAL INFORMATION: A dormer was added to the residence with a covered porch addition with a Certificate of Occupancy issued November 14,2003. The survey prepared in 2016 does not show the dormer addition. The accessory garage with non-habitable second floor was issued a Certificate of Occupancy on November 17, 1994: The survey does not show the evidence, of the required three on-site parking spaces, but visual inspection of the property indicates there is sufficient parking. On November 22, 2024 a Stop Work Order was.issued by the Southold Town Building Department to suspend all work at the premises: The basis for this Stop Work Order was construction of an accessory one-bedroom, 500- square foot apartment in the formerly non-habitable second-story space in the garage without first obtaining a Building Permit. Further rmore,the applicant acknowledges that establishing an accessory apartment, at no time,will the owner-occupied primary residential unit qualify fora rental permit. During the public hearing,the applicant was asked to provide: 1) an amended-lease, 2)a current driver's license, and 3) a copy of the surve-y indicating no less than three parking spaces. All three items were received on October 7, 2025. Page 2,October 16,2025 #8040SE,Laskey SCTM No. 1000-141'.-1-24.1 FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 2, 2025 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and the surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant: In considering this application,the Board has reviewed the code requirements set forth pursuant to Article 111, Section 280-13(B)(13)to legalize an Accessory.Apartment in an Accessory Sfructure and finds that the applicant does comply with all of the requirements for the reasons noted below: 1. The owner confirms that the accessory apartment shall contain no less than 220 square feet and shall not exceed 750 square feet of livable floor area and shall have no more than two bedrooms and one bathroom with the entirety of the livable floor area of the accessory apartment located on one floor of the accessory structure. If established on the first floor, access to any storage area above shall be by pull-down ladder staircase only. The architectural plans prepared by Eugene Peterson, Architect, dated September 4, 2025 depict an accessory apartment with one full bathroom entirely on the second floor of the accessory. structure with a conforming 500 square feet of livable floor area, as verified by the Building Department's "Verification of Livable Floor Area"request by the ZBA dated July 2, 2025. 2. The dwelling unit complies with the definition of same in §280-4 of the Town Code. 3. The applicant herein owns and resides at the property as documented by a New York State Driver's License and an electric bill from PSEG and confirms that occupancy of the accessory apartment on the premises shall be subject to the issuance of an annual rental permit in accordance with 280-13D and the following requirements: one of the dwelling units shall be for the sole, exclusive occupancy of the owner or family member, as defined in chapter 280-4; the other dwelling unit shall be leased for year-round occupancy, evidenced by a written lease for a term of one or more years,to a family member or a resident who is currently on the Southold Town Affordable Housing Registry and eligible for placement. The applicant testified that the tenant of the accessory apartment will be Kelsey Bertolas as evidenced by a signed irotarized statement of familial relationship to the owner as a cousin through marriage. 4. The owner's plans comply with the on-site parking requirements of three spaces,two for the principal dwelling and one for the accessory apartment, and provide for a total of 4 parking spaces, as shown on the survey prepared by John Minto, LS, and dated August 8, 2016 and a copy of a site plan received October 7, 2025 showing a total of seven(7)parking spaces drawn in by the applicant. 5. Only one accessory apartment will be on the subject property and no Bed and Breakfast facility, as authorized by Section 280-13(B)(14) hereof shall be permitted in or on premises for which an accessory apartment is authorized or exists. 6. This conversion shall be subject to a building permit, inspection by the Building Inspector, approval by the Suffolk County Department of Health Services of the water supply and sewage disposal system(s) and the issuance/renewal of an annual permit in accordance with Chapter 280-13D. 7. No special exception shall be granted unless the Zoning Board of Appeals, in addition to the considerations,determinations and findings required in Chapters 280-142 (General Standards)and 280-143 (Matters to be Considered)specifically finds and determines the following: Page 3,October 16,2025 48040SE,Laskey SCTM No. 1000-141 1-24.1 a) That the granting of the special exception will not adversely impact the privacy and use and enjoyment of any adjoining parcel. b) That the granting of the special exception will not adversely impact the character of the neighborhood in which it is located. c) That the cumulative effect of approving the present application along with previously approved applications will not have a cumulative adverse impact on the surrounding neighborhood. d) That the cumulative effect of approving the present application along with previously approved applications will not have a cumulative adverse impact on the school district in which the property is located. e) That sufficient off-street parking exists on the subject property to accommodate the proposed accessory apartment. f) Whether adequate buffer yards and screening can and will be provided to protect adjacent properties from possible detrimental impacts of the proposed use. RESOLUTION OF THE BOARD:In considering the entire record and the applicable code requirements,motion was offered by Member Acampora seconded by Member Steinbugler,and duly carried,to GRANT the Special Exception Permit as applied for SUBJECT TO THE FOLLOWING CONDITIONS: 1. This Special Exception Permit requires.an annual renewal by a Code Enforcement Officer. It is the applicant's responsibility to apply to the Building Department each year to renew the accessory apartment permit. Failure to do so may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. 2. This Special Exception permit cannot be transferred to new owners. 3. The septic system on the subject property must be approved by the Suffolk County Department of Health Services. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision, may result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. In the event that this is a special permit subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. Any violations of the conditions, occupancy or other requirements described herein, may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein.
