It is the custom and practice of the Southold Town Zoning Board of Appeals (ZBA) and
the Southold Town Board of Trustees that when both agencies have concurrent jurisdiction
over an application, and part of that application involves proposed or existing construction
within an area that such construction may or has resulted in negative environmental
impacts, the Trustees may be asked to review the project.
According to the survey that you provided, and the Notice of Disapproval, the proposed
and "as- built" construction will be located in close proximity, as well as, located seaward
to the top of the bluff.
Based upon the aforementioned documents, and the adjourned public hearing of October 2,
2025, the ZBA will ask that the Board of Trustees review an application for a Wetlands
Permit and make a decision prior to the ZBA rescheduling a public hearing. A
memorandum has been forwarded to the Board of Trustees affirming this request.

Attached, please find is a copy of a ZBA application which resulted from a Notice of Disapproval that
identified variance relief required to construct an in- ground swimming pool located less than 100 feet from
the Top of the Bluff and to legalize three "as built structures located seaward of the Top of the Bluff.
On October 2, 2025, during the applicant's public hearing in front of the Zoning Board of Appeals, the Board
made a motion to adjourn the hearing until January 2026. Because of the proposed location of the swimming
pool and the "as- built" locations of the seaward structures, we are requesting that the Board of Trustees
proceed with reviewing and deciding on an application for a Wetlands Permit prior to reconvening the public
hearing before our Board
I've attached a ZBA application packet which includes a survey prepared by Michael J. Scalice, LS, last
revised June 23, 2025 and architectural plans prepared by Venci Benic, Architect, last revised May 12, 2025.
A letter will be sent to the applicant's representative indicating our procedure.
