According to the survey that you provided, and the Notice of Disapproval, the proposed and "as- built" construction will be located in close proximity, as well as, located seaward to the top of the bluff. Based upon the aforementioned documents, and the adjourned public hearing of October 2, 2025, the ZBA will ask that the Board of Trustees review an application for a Wetlands Permit and make a decision prior to the ZBA rescheduling a public hearing. A memorandum has been forwarded to the Board of Trustees affirming this request. Please do not hesitate to contact this office with any questions or concerns. Sincere y, Kim E. On October 2, 2025, during the applicant's public hearing in front of the Zoning Board of Appeals, the Board made a motion to adjourn the hearing until January 2026. Because of the proposed location of the swimming pool and the "as- built" locations of the seaward structures, we are requesting that the Board of Trustees proceed with reviewing and deciding on an application for a Wetlands Permit prior to reconvening the public hearing before our Board I've attached a ZBA application packet which includes a survey prepared by Michael J. Scalice, LS, last revised June 23, 2025 and architectural plans prepared by Venci Benic, Architect, last revised May 12, 2025. A letter will be sent to the applicant's representative indicating our procedure. Thank you for your assistance in this matter.
