On motion of Justice Surer, seconded by Justice Demarest, it was RESOLVED~ that the next regular meeting of the Southold Town Board will be held at 3:00 P.M.s, Tuesday, December 21, 1976 at the office of theSUPervi~or, 16 South Street, Greenport, New York. On mo~ion of Justice Suter, seconded by Councilman Homan, it was RESOLVED that the November. reports of Supervisor Martocchia, Town Clerk Terry, Justice Surer, Building Department be accepted and placed on file. Befor~vOting on'the forego~ng'reSo!ution Justice Demarest pointed out that ~60,448.00 in ~ntere~t was. earned by the Town throUg~ thS"Superlntandent of Highways account and other funds. SherIey Katz questioned if this was through Federal Revenue Sharing funds?~Justice Demareststated that it was not Federal Revenue Sharing Funds. This was-from money in this years~budget that was kept in interest bearing accountS. SuperVisor~Martocchia reported: 1~ Receipt~f only one bid for.the f~rniture for the Town HaI~ at Sou~hold. -The bidwas received from McCabes at Riverhead. Super- visor Martocchia~stated that it was brought to his attention that the figure stated in the newspaper seemed like a large figure for what were ~re getting~ Buthe said that the newspaper did not state all of the furniture we are actually receiving,~ There are quite a few pieces we are getting that they did not mention. He stated that he revie~d'thi4 with an interested party and they were quite satisfied because there~ was morse furniture involved .than what the newspaper indicat~m~. Sherley KatZ stated that the L. I. Traveler did elaborate on ~h~nUmber of pieces. Supervisor Martocchia samid that itmust have been the Suffolk Times that didn't. The bid figure is $5,682.00. On motion of Justice Surer, seconded by Councilman Homan, it was RESOLVED that Supervisor Albert M. Martocchia be and he hereby is authorized to enter into a contract with McCabes, the lowest and only responsible bidder for furniture at the Southold Town Hall addition at Southold, New York, in the amount of $5,682.00. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Couucilman Homan, Justice Surer, Justice Demarest. This resolution was declared duly adopted. Supervisor Martocchia reported: 2. Receipt of letter from the Suffolk County Community College, Richard Minisce, Associate Professor of Sociology. He was one of the men we employed this past summer with the police department at no salary. .He was able to spend the-summer .and a little beyond with us learning police procedures, office work, etc. -He participated in everything involved_as a policeman. Zt. did give-him a tremendous amount of wealth to be able.to go back into his classroom, and lecture on things after being on the scene and actually participating. He.sends his appreciation to the elected officials of the Town of SoWthO!d and. the'pOlice department for this opportunity. 3. Southold Public. School'isrequestihg som~ funding which the town has money set aside f0r"th~ sc~o0t tO extend recreation programs for their youth, whether it be into the summer further or into the winter further. Due to the f~ct that Southeld School was on austerity for quite ~ while t~y ~0Uld not participate in the summer program, The money was held in custody of Southo~d Town accounts. The school has come uD with a "matching dollar involvement program" in which they will participate to thetune of $2,500.00 and there is a little outside money also. -They~ask i~ t-he-Town will participate with the money that was normally set aside_ for ~outhold. They are ~sking that we match their $2,~00.00 Plus~ $300.O0'for CY0'prog~am. ~ Th&s w~'~ent to the[Town~At~0rnsy for clearance tb~be'~ure~at.'&~eryt~ing'was in'p~0~e~ 0~der. On motion of Councilman Rich, seconded by Justice Surer, it was RESOLVED. that the Southold 'ToWn Board appr0vesa recreation expenditure tm the Southold 'Public Schools'in the .amountof $2~800.00 to extend recreation programs. Vote of the-Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilm~u Homan, Justice Surer, Justice Demarest. This resolution was declared duly-adopted. Sherley Katz questioned if this can be done though it is only a summer funding.---Supervisor Martocchia answered that they have an entire braakdoWn of the programs which has been examined and they are very careful using the money as intened, they feel that the spirit isbeing followed. Supervisor Martocchia: 4. Supervisor Martocchia.reported that c~rtain towns and villages wdr~ entitled to Put in for some of-their expenses.-that were incurred during""Hurricane~Belle,,. The Southold Tewn Highway Department andPolice Department'~did occur expenses above an8 · beyond the norm. The Town of/Southold~ill be receiving about $70,O00100~eventUally from the New York State Office of Disaster Preparedness. At this point, we have,received a check-for $37,300.00 to be~divided between the Public Works program at the disposal area, which the Town Board controls, the Highway Department, and the Police Department for some overtime to .personnel~and some of the damage to our generator. So we will be getting part.of th~s $37,300.00 in, our Town Board account. Mr. Dean is holding the check. The Police Departmant put in fbr $1~386.20; they.-were alloWed$~,24~.00. 5. Supervisor MartoCChia reported~0n~-the outcome of the~ meeting'~atthe Mattituck High~!Sdho~l in reference to problems in the Mattituck-West Cutchogu~ area of poor television rece~io~. There was~a meeting set up by'Peter Jones, Manager of the-Riverhead branch of CATV. There was a turn-out of about 100 people. It.was quite an open meeting. 8ome o£'them were quite unhappy with the service for which they were paying and not gettimg a goo~ picture. Mr. Jones indicated that he was'trying to remedw it-as best as Dossible and review the-reports of the people who gave t~eir names and complaints at the meeting. He sent a report of the ones his repair and engineering staff have visited. They corrected many of the problems. There was no one single type of problem. They were different types of problems. There is still more to do, some people were not at home when they came. They left door knockers but they never received a follow-up on them. From what I read here most. of the o~oole are h~ +h~ +~ were. The CATV is making efforts to clear the problems up. They have. 3 crews Working. 6. Supervisor Martocchia reporte~ that~he received a letter from the North Fork Lions Club informing us that ~yare organizing a group from the North Fork Lions, Rotary, & Xwianis. They are willing to be more aware of what is going on and what they see and reporting it to the police. Whether it be a strange car in a strange place or person acting strangely. They CoUld be another set of ~eyes for the police d~partment. It was endorsed by the Chief of Police and Supervisor Martocchia. It is ca!led a "community awareness program". 7. ~SupervisOr~Martocchia reported receiving request from the attorney fortheowners of "Oregon View Estates" asking for a reduction of their subdivision bond. On motion of Justice Surer, seconded by Justice Demarest, it was RESOLVED that the Southold Town Board hereby denies request for reduction of performance bond of Oregon View Estates, subdivision located at Cutchogue, owned and developed by Louis Hodor. Bond to remain as in ~ntil work is completed in accordance with the highway specifications for this particular subdivision. Vote of the Town Board: Ayes: SuperviSor Martocchia, Councilman Rich, CoU~Clilman Homart, Justice Surer, Justice Demarest. This resolution was declared duly adopted. Supervisor Martocchia: 8. Supervisor Martocchia reported receivingnotice of hearing to amend the Code of the Town of Riverhead in relation to zoning. 9~~ Supervisor Martocchi~ reported receiptof letter from Ethel .Wortis, South Harbor Road; SOuthold, concerning the property directly in front~of the end of 'South Harbor 1Road and property immediately west - the Southold Park District owns the property to the east. Over the years the town has been leasing this property from Mrs. Wortis. She indicates she would like to talk ~bo~t selling this to the Town of Southo'ld and/or to the Southold Park District. The ParkDistrict has indicated to the Town that they are not interested. Supervi~s0r'Martocchia researched this with former Supervisor Lester~M. Albertson and ~omund that some dredging and filling had been done there and arrangements had been made with the family'that a given point in time the property would be deeded~,to the Town of Southold for $1.00, but it seems that Mrs. Wortis does not remember this. SuperVisor Martocchia and board members will meet with her to see what can be worked out.--Gladys Csajko questioned if there was anything in writing?---Supervisor .Martocchia said that there was not. However, Mr. Albertson did go with him to talk to her and the .point was brought out ver~y strongly ~egarding the arrangement.---Sherley~Katz questioned how much property was involved?---Supervisor Martocchia answered that it was the property at the end of the road and d~mediately west, less than an acre. - !0. Supervisor Martocchia reported receipt o£ letter from Mr~-'Edward-.A~a~ns, Orient, in reference to the.League b'f Women Voters to head a drive to make citizens aware of and interested in participation and planning of the Coastal Zone Management Boards. -Mr. Rhodes Trautman is the committee chairman for the RiYerhead-SoutholdLeague of Women Voters. This has to do with the~200 mile~zon~._~--CouncilmanHoman stated that the various fisher~/ groups have just voted to stay in the Int~ernational Conference of North American Fisheries which will give the state ~epartment control of the area. 11. Receipt of letter from Elaine F. Caldor, CPA offering to audit books-fo~ ~he y-ear .of 1976 ~or a fee of '$1, 600. 00. She has ~done theme, anuua:l~y-over the years=. On motion of Councilman Homan, seconded by Oounc~tman-Rich, WH~EAs Section 123 of th-e: Town Law provides that town officials and employees who rec~ei~e-an~ disburse monies of the town shall accouter to-the town-'.board for ~11' monires received and disbursed by them by the 20th day of January, and WHEREAS the Town Board deems it necessary to engage a public accountant to_-prepare.~he 'aforesaid annual account for all town officers and employees, NOW, THEREFORE, BE IT RESOLVED that the Town Board engage the services of Elaine F. Kaldor, Certified Publfc ~AcC0untant~~ to make the,annual audit of the books and records of of~icers and employees of the Town of Southold for the fiscal year 197$'at acontract fee of ~1.,600.00. Be it enacted by the Town Board of the Town of Southold as follows: I. Section 69-102, Article I, Chapter 69 of the Code of the Town of Southold is hereby amended to read as follows: 69-102 License required. It shall be tmlawfu! for a person to act as a hawke~, peddler or solicitor within the limits of the ToWn,of Southo!d,-except in-conformity with the provisions of - . this Article, and without first having obtained::andl -- - pai'd for.and having-in force and effect a license,~-as provided herein. Notwithstanding the foregoing' provisions of this Section., a merchant having an established, place or'business within the Town of Southold, or his employees Shal'l not be~reqUired,io obtain a license issued pursuant to the provisions of. this Article. Charges preferred by Chief of Police Cataldo were read by Supervisor Martobohia. On motion of Justice Demarest, seconded by Councilman Homan~ WHEREAS, on the 26th day of October, 1976 Carl Cataldo fi~!~dwritten charges with this~Bo~rd against Pol~oe Officer-~SalvatoreM. Crim~', and WHEREAS, a hearing with-respect to said charges was held by this Board on November 22, 1976, and~ WHEREAS, this Board has reviewed all 0f the evidence.addUced at said hearing, NOW,-THEREFORE, IT IS RESOLVED AND DETERMINED, ~ follows: 1. That this Board finds.Police Officer Salvatore M'. Crimi Guilty of all of the charges preferred against him. 2. That P0!~ce Officer Salvatore M. Supervisor Martocchia reported-that wetlands violation of Valentine Ruch IV needs further study by the board. 15. NOtice from the New York State Department of Environmental Conservation that a hearing will beheld upon the application o£ Charles A. Gagen, 2400 Pine Neck Road, Southold, N.Y., for construction .o£.~a one-£amily dwelling, on January I0, 1977~at 2:00 ?.Mi; objections by. January ~, 1977. 16. The Town Board is still looking £or names of people who m!ght like to serve~on the Conservation Advisory Council; must have the n.amesby the,next meeting on December 21st. 17. Correspondence~was ~received at. the last'meeting from Holzmacher, McLeondon, & Murre!l, P.C. in reference to the waste water-study. Supervisor Martocchia met with'Jim Monsell from the-Vil!ag~ of Greenport thismorning. The Town Board and the Viltage.o£'Greenport are requesting a meeting with a representative o£-~the-~-~i~.rm,to find out more about it.---Sherley Xatz questioned wha~ t~e study was all about, and where the waste Water was £rom. ---Supervisor~Martocchia answeredthat it was a waste water study onwaste Erom sewage plants. 'The Village O£ Greenport serves many areas outside the village limits.---Justice Demarest stated that it is a study to'see how much waste water we can put bacM into the ground without £ouling up the water supply. Although the Village has ~ts own sewage and disposal system; they are also interested in the areas outside o£ the village because all of their working wells, except the one on Moores L~Ne, ar~ in the Town. So they certainty.are interested in the waste outside the Village because it could foul up the wells that supply everyone.---Supervisor Mart~cDhia stated that jointly between the Town and the Village, it will cost the Town $700.00-$800.00 to prepare the necessary papers to apply for the grant to do the study. Then if the grant is approved, it will cost us $9,000.00-$10,000.00 as our share to make the study. The Town and Village will have to pick up 12% of~the cost.~ A formula is being worked out, bit it will cost us approximately $9,000.00-$10,000.00. 18. Supervisor Martocchia announced that a parade and Christmas.~Party will be.~hetd on December 19that l:'00 P.M. at the,Greenport Fire House. Receipt of request f~r cluster concept ~subdivision "Southold Gardens", owned by-Babcock~& Rimm!er, located at ~ Southold. Consists of 12.056 acres. This matter needs further study, and will be examined by the Town Board. Supervisor Martocchia-:opened-'the floor to the publiC. Mr. Charles Hickey questioned if'any decision has been reached on the telephone system for the town hall.---Supervisor Martocchia answered that the Town has gone into.contract with Pr0gressi~e Phone. Systgms,--~he same as Greenport Hospital.' We also considSred Executone and the'New York Telephone Co. Based on the findings of our study, we can save at least $24,000.00 over the next t~n years with the Progressive System verses the others.-'-'-Mr.' Hickey stated that the County is being criticized in todays' p~per for doing ,the same thing. The T~lephone Co.-gave them some new~f~gures, now theM are'showing a saving of:$6'00,000..00+.idiSupervi'sor Martocchia stated that they met with the representatives of ~.~ Telephone. Co. many times.-They all have to work with guide!ines, fixed tariffs, whereas the'other companies do not. The proposals ~me taken apart by our town attorney. The N.Y. Telephone Co. proposal was not very clear. The figures that they quoted ~s were not accurate 'figures. We found that they were not really fixed figures, but subject.to ~ate increases.--LMr..' HickeY stated that he handled a similar matter for his company in New York~six years ago. He found that the private compan:ies are lower initially, but they ran into trouble on repairs an~ service. N. Y. Telephone Co.'s response time is 15 minutes.---Supervisor Martocchia stated that we have a service contract to go with the package. The first year is free, then there is a $2.00 charge per teI~phone for the next nine years. The response time. is up to 4'hours for amy major problems~.and.24 hours for minor ones. Supervisor Martocchia agreed that you do have'a different: fe~ing of security with the Telephb'n~. Co., buts-how· much of.a price~ou have tO pay for iii We had to consider this into our evaluation· This Board did~pass a resolution to go wi~h the N~Y. ~etephone Co. proposal, but contained.e clause to cancel if we saw'fit or could do better with someone else· We were'willing to go ahead with them knowing that they were a little-higher, but at: the time we didn't realize how much higher it was~ AfZer everything was brought out, we found that they were considerably higher. ~iadys Csajko ques~ionedi£-the Town Board is going to open their' working sessions to the public on Januarylst.---SUpervisor ' Martocchia stated that this really has not been discussed yet. He asked Town Attorney Tasker if this was. mandatory or optional. ~r. Tasker~Stated that.~an executive~.session, Under 'the new Iaw, ms a session where you ta'ke-legal action. The Town Board does not have those. If you were to recess now and go into eK~cutive sessionally.the only lway you can:gO into executive session un, er the .new law is to recess a-public session for speoific purposes set down in the law and you take action in those executive sessions. We don't have those. ~.What we do in the morning up until'the meeting is not really an executive session.---Supervisor Martocchia asked if the Town Board would be covered by the new ruling?--Mr. Tasker stated that~the~Town Board would not b~' c0v~red by it, our working session is~[~0t an executive session. Mrs-Ta'~ker saidthat'the new law defines~%wo types of meetings: (1) a pmbliC meeting; (2) an executive ses~ion;' Theydefine exaatly what'each one is. An executive session is w~ere~if'~his~Board Wished to recess and go into an executive session to take legal official action on a vote or a specific thing. ---G!a&¥s Csajko questioned if you~would have~te~-have minutes of it?--- MP~Tasker answered yes~ that you wout~ have to have minutes. It is a reg~la~ offfCial meeting,but held~in secret and of which minutes must be'~aintained. T~is'~:resolution was declared duly adopted, On motion of Justice Demares~, seeonded by Councilman Homan, WH:~EAS,~he Building Inspector, heretofore served a nOtice of violation ~upon the Estate of Valentine Ruch IV, pursuantoto Section 96-31 of the Wetlands 0rdinanoe of the Town of Southold, and WHEREAS, this Board held a hearing with respect thereto, pursuant to section 97-32 of said Ordinance, a~d WHEREAS.~.it appears, that the ~ew York State-Department of Environ- mental Conservation, in its consideration of a permit application with respect to said presmies, found that wetlands did exist in the area %o.'be.filled, but determined that the filling thereof would not cause irreparable damage to the water; And it further appearing, upon a personal inspection caused to be made by this board that wetlands were present in the area to be filled and therefor a wetland permit should be applied for, NOW, THEREFORE, BE IT RESOLVED that the Notice of Violation of the Building Inspector is being sustained and it is further RESOLVED that the Estate of Valentine Ruch IV apply for and obtain a wetland permit before conducting any further filling and/or construction work to be conducted on the premises in question. This resolution was declared duly adopted. 0n motion of Councilman Homan, seconded by Justice Surer, WHEREAS, the Board of Commissioners of the Fishers Island Ferry District, in the Town of Southold, Suffolk County, New York, has recommended that the facilities of said Ferry District be increased and improved by the acquisition of au additional ferryboat at an estimated maximum cost of $730,000.00 to replace the ferryboat "Mystic Isle", presently o~r~ted by the Fishers Island Ferry District and to apply the $141,000.00 expected to be received as trade-in on the "Mystic Islane", to the purchase price of said new ferryboat, bringing the actual total purchase price to $589,000.00, said new ferryboat to be used on the authorized routes of said Ferry District, and has caused preliminary plans and specifications for the construction thereof to be prepared by Blount Marine Corporation, Warren, Rhode Island, shipbuilders and licensed naval architects, a~d that said T.own hold a publichearing to consider said increase.. and improvement of the facilities of said.Ferry District and~to make. funds' available pursu~ant to.Chapte~D 699 o£ the Laws of 1'947,_ as amended, and the Local Finano~ Law, to finance said incr.easg~ and imprlovement Of the facilitiss and-to-take other action"~n connection therewithJ -- : -- -- ...
