We oppose the Trustees approving this application for construction of a side yard pool. We understand that Town Trustees in Southold are charged with administering permits for activities within 100 feet of wetlands, beaches, dunes and bluffs, in accordance with the town's wetlands code — Chapter 275. The home built on this environmentally sensitive fresh water wetlands is already oversized with 5 bedrooms and 2 laundry rooms. While finishing construction, the builder violated the rear non-disturbance buffer and now is requesting permission to exacerbate impervious surface on the north side of the property, which is close to the road. This addition of a recreational water feature will further degrade the site's ability to percolate runoff and result in the existing designated buffer to be insufficient. This home has created an unsafe pedestrian and vehicular experience. Cars slip up and down the gravel driveway as it is. Gravel continually runs off the driveway with rain and lands downhill at the traffic triangle. We are confident given today's more stringent environmental rules, this property would have never been permitted to be built. We understand approvals are decades old. However, this is clearly an instance of self-created hardship that should not be allowed to be further exacerbated. Thank you for this opportunity to provide comment. We will need the following in order to move forward: 1) A check for$1,250 made out to the Town of Southold; 2) The proposed patio is not on the plans you provided. It needs to be added to the site plan with dimensions; 3) A pool drywell needs to be added to the site plan; 4) The proposed fence and pool equipment area are not in your written project description. Either email us an updated project description or come in person to update the one you already submitted. We will need the height of the fence with approximate dimensions. Please get this to us in order to move the application forward. Sincerely, Thomas Hobson Administrative Assistant Town of Southold Board of Trustees Phone: (631) 765-1892 Fax: (631) 765-6641 1 so OFFICE LOCATION• MAILING ADDRESS: Town Hall Annex ' P.O.Box 1179 54375 State Route 25 Southold, NY 11971 (cor.Main Rd. &Youngs Ave.) Telephone:631 765-1938 Southold, NY 11971 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD To: Leslie Weismann, ZBA Chairperson Members of the Zoning Board of Appeals Cc: Julie McGivney, Assistant Town Attorney Glenn Goldsmith, President, Board of Trustees From: Heather Lanza, AICP, Planning Director LWRP Coordinator Date: October 10, 2025 Re: LWRP Coastal Consistency Review Town Creek Real Estate, SCTM# 1000-69-3-13 This application is for a pool in the side yard and with a front yard setback of 15'. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposal is INCONSISTENT with the LWRP. While the location of the pool relative to the wetlands is consistent with the policies of the LWRP, the location of the pool with respect to the zoning is not. Policy 1 is to foster a pattern of development in the town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location and minimizes adverse effects of development. This proposal is out of character with the community and does not minimize adverse effects of development. The pool is proposed in the side yard only 15' from the street. The front yard setback is 40' in the AC zoning district for non-conforming lots of this size. Similar to the subject parcel, the neighboring lots on either side have houses close to the road due to the headwaters of Jockey Creek running through the back of the parcels, but neither parcel has a pool. To minimize the potential adverse effects of this development of the pool, and thus be able to find this action consistent with the LWRP, consider the following options: 1. Remove the pool entirely. Construction of the pool was begun without a permit. The applicant has applied for permits in the past including on this parcel, and should have been aware that the pool would require a building permit, a wetland permit, would not be permitted in the side yard and 15' from the street without significant variances. 2. If the Board is inclined to give a variance, reducing the size of the pool and reducing the area that is fenced in around the pool could be an option. Pursuant to Chapter 268, the Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. 2 Glenn Goldsmith,President ®f S0/, Town Hall Annex 54375 Route 25 A.
