In 2021 our client filled the minimally sloped area of 2,090 sf by approximately 15 cubic yards of sand to level up the lawn; the thickest fill area has approximately 2 inches. A sod was installed on the top of the sand. At the end of the grass area two untreated wood tie planters were installed; Planters have the following dimensions- 50'L x 3' W x 10"H and 32'L x 3' W x 10"H. A sod egress to the beach and two fireplaces were installed between the planters. At the time, the owner was unaware that such improvements might require permits, and he proceeded under an assumption that the proposed work was minor and in keeping with the existing neighborhood character. The modest improvement made the backyard more functional and aesthetically in line with adjacent lots. The wood tie planters are in place and the vegetation around them is well established, as is the lawn grass. The planters are placed nearly in line with the retaining walls of the adjacent properties. , No excavation took place. The design and alignment of the planters were deliberately chosen to match the orientation and elevation of neighboring lawns, preserving visual continuity and minimizing any appearance of disturbance or discord with the surrounding environment. If any impact on wetlands occurred during this project, it was incidental and minimal in nature. Since that time, the lawn and associated vegetation have become well-established and are now fully functioning as intended, contributing to soil stability and blending naturally into the landscape. It is our opinion that the removal of the planters and lawn area would be counterproductive, not only from a practical and aesthetic standpoint but also potentially harmful to the now-stabilized vegetation and soil conditions.As such, we respectfully request to consider issuing a permit for the work that has already been completed, in recognition of the following key facts: o The improvement has enhanced the usability of the property while maintaining harmony with the neighboring lots. o The vegetation has successfully taken root and is serving its intended ecological function. o There is no evidence of environmental harm or disruption to the surrounding area. We are currently seeking approval from other involved agencies to ensure compliance with applicable regulations. The information below is strictly preliminary. Once all revisions/paperwork requested below is submitted the application will be added to the current list of applications for a future public hearing date. Once the application comes up for a tentative public hearing date a full review of said application will be performed and if any other information is required your office will be contacted in order to try to keep the application moving forward. Upon initial review the following is needed: • As-Built Wetland Permit application fee in the amount of$2,500.00(check made payable to Town of Southold) • A copy of the completed Articles of Organization to show who is the owner/partner/member of said property in order to accept the various signed Authorization forms. This has been a long standing requirement for all initial applications under an LLC/Corp./Inc. Once on record it is not needed for any future applications under the same name,and will not be added to the public record. • The written project description is very insufficient. All as-built structures/lawn area/cleared area(s)of natural vegetation need to be described with approx. square footage and where natural vegetation has been cleared, what will be proposed to be used to re-vegetate. All as-built/proposed structures need to have dimensions(for the planters or if any retaining wall extensions were built, length by width by height is required for each). Details(including approx. square footage) of clearing natural vegetation/etc. and installation of sod and if any,top soil. Details regarding the path to the water. Basically everything that was installed or removed without a permit including dimensions and any areas to be re-vegetated (what type of native vegetation) needs to be described. Below is an example of a project description as a reference. The referenced description is more to show the requested information about the walls and how detailed a written project description should be. • EXAMPLE: to install gabion walls by removing a seaward portion of the non-pervious driveway, remove existing steps, wood benches and planters on the bank; install 3' wide gabion walls of varying height of 3' to 4.5' high, and 6', 12', 15', 21', 54' and 63' in lengths to be installed along the west side, along toe of bank, and two walls along the east side of the property; existing fill removed to install gabion walls to be used as backfill to level out the rear yard; install 3' wide vegetated buffers using native vegetation landward of the property lines along the west and east gabion walls; and install a set of 6'wide stairs to beach between walls. • The survey should have call-outs where re-vegetation is needed and the type of native vegetation proposed to be used. If there were any retaining walls/planters that were extended along the easterly and westerly side yards, call-outs of length and height of the extensions need to be added to the survey. • Using the Suffolk County GIS Viewer, it is clear in the 2023 aerial vs.a 2022 aerial that structures,gravel areas, etc.were removed that were located along the easterly side yard however,they are depicted on the"survey: If these structures were removed and replaced,these too need to be applied for and called-out on the survey'with dimensions. If they were not replaced then please update the survey with the removal of all said structures that no longer exist. 1 Again,this is a preliminary review. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposal be found INCONSISTENT. The proposal is inconsistent with the following policy standards: Policy Standard 4.1 A.1. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. Avoid development other than water- dependent uses in coastal hazard areas. Locate new development which is not water dependent as far away from coastal hazard areas as practical. The retaining wall/planter structure, fill, fireplaces and sod are located in the coastal erosion hazard area and are not water-dependent uses. Policy Standard 4.1 A.3. Move existing development structures as far away from flooding and erosion hazards as practical. Minimize losses of human life and structures from flooding and erosion hazards. The retaining walls, fill, sod and fireplaces are not as far away from flooding and erosion hazards as practical. Policy Standard 6.1 B Protect and restore ecological quality by adhering to the following measures.- 2. Retain and add indigenous plants to maintain and restore values of natural ecological communities. a. Protect existing indigenous plants from loss or disturbance to the extent practical Indigenous plants were removed to create the walls and add fill. b. Include use of suitable indigenous plants and the landscaping plants for new development and in redevelopment projects where loss or disturbance of existing indigenous plants could not be prevented during construction Loss and disturbance of the existing indigenous plants could have been prevented by avoiding altering land in the CEHA. Policy Standard 6.1 C. Reduce adverse impacts on ecological quality due to development 1. Reduce adverse effects of existing development. 2. Mitigate impacts of new development. 2 The subject property is located in a significant natural community that is listed by the NYS Department of Environmental Conservation as a high-quality occurrence of a rare community type: Maritime Beach. The retaining walls and fireplaces and addition of fill and sod seaward of the Coastal Erosion Hazard Area destroyed the natural community and native plants immediately adjacent, and in future storms will cause the potential for floating debris to enter the Sound. This could also lead to additional erosion when the retaining wall fails and there is no native beach-adapted vegetation to help hold the sand in place. To be consistent with the LWRP, construction and fill of any type should be landward of the Coastal Erosion Hazard Area line, and the land seaward of the CEHA should be revegetated with native beach vegetation. The need for using land in the CEHA is unclear because the available outdoor living area in the rear and side yards of the parcel that is landward of the CEHA is around 3600 sq. ft.
