Petitioner is seeking relief from the following section of the New York State Uniform Fire Prevention and Building code:. 19 NYCRR Part 1220,The 2020 Residential Code of New York State,Section AJ601.3, Exception 1, which states, Space created in basements may have a ceiling that projects to within 6 feet, 8 inches of the finished floor; and beams,girders and ducts in such space or other obstructions may project to within 6 feet,4 inches of the finished floor. Existing finished ceiling heights in spaces in basements shall not be reduced. [The petitioner wishes that ceiling heights less than required be allowed].
