Peconic Bay Gardens, Inc. Dear Mr. Raynor: We recently secured a copy of a letter dated PLy 8, 1981, addressed to you from the Suffolk County Planning Commission with respect to the above-captioned minor subdivision. There is no serious objection to any of the conditions set forthlin that letter 'by the Suffolk County Planning Commission with the exception Of Items 4 and 6. As concerns the former, I think it quite arbitrary on the p'art of the Commission to fix the s~tback line at a minimum of 100 feet. I am not.even sug- gestihg that it is inappropriate to do so in this case; my ob3ec~zon, ms, kowever, that mn every znstance where there is property bordering on waterway.s, the Suffolk. County PlAnning Commission arbitrarily imposes this 100 foot setback without giving any reasons as to the need and necessity thereof. If the S~u~hold Tbwn Planning Board feels it is necessary to have the lO0.foot setback, we wild accept the decision of-that Board; however, if t:he Board feels it unnecessary in this instance, then ! would ask that they override the Planning' Commission with respect to this particular condition. ~s '.to Item 6 of the conditions set forth by the Commission, ~e deem .this highly .inappropriate and unnecessary particularly mn tk~ Light of Item .4.
