Lane, in Cutchogue SCTM#1000-97-8-31.2 & 31.4 Zoning District: R-80 Dear Mr. Krupski: The following resolution was adopted at a meeting of the Southold Town Planning Board on Monday, October 4, 2004: WHEREAS, this proposed subdivision is for 3 lots on 27.2 acres where Lot 1 equals 80,043 sq. ft., Lot 2 equals 80,294 sq. ft. and Lot 3 equals 24.19 acres inclusive of an 80,095 sq- ft. reserve area in the R-80 Zoning District; and WHEREAS, 21.23 acres of Development Rights were sold to the Town of Southold on March 3, 1986; and WHEREAS, the Planning Board classifies this subdivision as a Conservation Subdivision pursuant to Chapter A106; and WHEREAS, the Suffolk County Department of Health issued a permit for the action on July 24, 2003 and updated October, 2004; and WHEREAS, the Suffolk County Water Authority issued a letter of water availability on July 2, 2003 ; therefore, be it RESOLVED, that the Southold Town Planning Board grant final approval on the plat, last revised on May 3, 2002, and authorize the Chairperson to endorse the plat. Reasons Supporting This Determination: An Environmental Assessment Form has been submitted and reviewed. A 10,500 sq. ft. drainage easement exists on site dominated by common reed (Phragmite australis). The Town of Southold Board of Trustees required that a 100 foot buffer be established SEQR Negative Declaration - Page Two on the western boundary of the easement. A pervious driveway used for agricultural purposes transverses the easement within the 100' setback. All run-off will be retained on site through drywells. The determination was based upon the following: No substantial adverse change in existing air quality, ground or surface water quality or quantity, traffic or noise levels or a substantial increase in solid waste production or a substantial increase in potential for erosion, flooding, leaching or drainage problems are expected to occur if the proposed action is implemented as planned. The existing land use on the proposed lot locations is agriculture. The applicant states that no vegetation will be removed. Consequently, no substantial interference with the movement of any resident or migratory fish or wildlife species; impacts on a significant habitat area; substantial adverse impacts on a threatened or endangered species of animal or plant, or the habitat of such a species; or other significant adverse impacts to natural resources will occur. I No Critical Environmental Area as designated pursuant to subdivision 617.14(g) is located adjacent to property. The property is zoned R-80, low density residential; requiring 80,000 sq ft lots. Two lots and one building envelope greater than 80,000 sq ft are proposed adjacent to existing development. Consequently, the proposed action is not in a significant material conflict with a community's current plans or goals as officially approved or adopted. The proposed lot locations are currently in active agriculture. The proposed action is not expected to impair the character or quality of important historical, archaeological, architectural, or aesthetic resources or of existing community or neighborhood character. No major change in the use of either the quantity or type of energy will occur. No creation of a hazard to human health is expected to occur.
