(631) 765-1809 Southold Town Cler FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF SEPTEMBER 18, 2025 ZBA FILE: #8030 NAME OF APPLICANT: Vito Plaia PROPERTY LOCATION: 1020 Laurel Court, Laurel,NY SCTM No. 1000-126-13-1 SEQRA DETERMINATION:The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions,without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief,permit,or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a 37,230.14 square feet non-conforming parcel located in the Agricultural Conservation Zoning District. The property is part of the Laurel Links subdivision with a map filed on November 23, 2001. The property has road frontage of 84.84 feet along Laurel Court„then runs northeast 180.00 feet, turns northeast again 179.03 feet, then turns southwest 141.89 feet before returning southwest 180.00 feet back to Laurel Court. The property is improved with an existing two-story frame dwelling and attached garage with an attached wood deck and an accessory shed all as surveyed by Kenneth M Woychuk, Land Surveyor, last revised April 8, 2025. BASIS OF APPLICATION: Request for a Variance from Article XXXVI, Section 280-207; and the Building Inspector's April 16,2025 Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing single family dwelling; at 1) gross floor area exceeding permitted maximum square footage for lot containing up to 40,000 square feet in area; located at: 1020 Laurel Court, Laurel, NY. SCTM No. 1000-126-13-1. RELIEF REQUESTED: The applicant requests a variance for the increase in Gross Floor Area(GFA)to 6,456 square feet where a maximum of 5,100 square feet is allowed by the Town Code. ADDITIONAL INFORMATION: During the public hearing,the applicant's authorized representative testified that the owner would like to add another bay to make his two car garage a three car garage. He testified that pursuant to the covenants and restrictions imposed by the Homeowners Association, accessory garages are prohibited within the subdivision thus he is seeking to expand his existing two car.garage. The Southold Town Zoning Code does not apply Goss Moor Area requirements to accessory garages, but it does apply to attached i Page 2, September 18,2025 48030, Plaia SCTM No. 1000-126-13-1 garages. As a result,the applicant's only feasible method of expanding garage space is to construct an addition to the principal dwelling. The applicant submitted GFA calculations on five developed properties on Laurel Court which averaged 5,104 sq. ft. The applicant's representative was asked to collect GFA calculations on more homes based upon the ZBA's guidelines, that allows for a calculation to be based upon 21 adjacent neighboring properties. After conducting research, the representative informed the Board in email correspondence that averaging GFA "are [sic] not working in our favor." Thus, the applicant is unable to show the additional bay for the garage in keeping with the character of the neighborhood and the requirements for GFA expansion. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 7, 2025 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed attached garage addition both exceeds the GFA average for the immediate neighborhood and further increases the non-code compliant excessive GFA of the existing home. Permitting excessive GFA is precedent-setting and will have an adverse impact on the character of the neighborhood. 2: Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The Gross Floor Area requested is more than the average allowable by the Zoning Code. Any addition to the subject residence will require a Gross Floor Area (in excess of the neighborhood average) variance; however, the property improvements are already over the preexisting permitted Gross Floor Area. As such, it is not possible to further expand the residence. 3. Town Law 4267-b(3)(b)(3). The variance requested is mathematically substantial, representing 21%relief from the code. 4. Town Law 4267-b(3)(b)(4). Evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The Board finds that granting of the GFA variance will produce an undesirable change in the character of the neighborhood. By allowing the creation of an over-sized home in the area is in contravention of the spirit and intent of the Town Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect,and it is presumed that the applicant had actual or constructive knowledge of the limitations, as a result of the neighborhood covenants and restrictions, on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6.Town Law 4267-b. Grant of the requested relief is not the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an expanded garage. The applicant can address the Homeowners Association relative to granting an exception to their covenants and restrictions, or, alternatively, the applicant can rent storage space,as the applicants representative testified the space was.for more cars.
