On motion of Councilman Homart, seconded by Justice Surer, it was RESOLVED that the July reports of the building department, Supervisor Martocchia, Town Clerk Terry, Justice Surer be accepted and placed on file. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Surer, Justice Dem~est. This resolution was declared duly adopted. Supervisor Martocchia reported: 1. LeSter from The Civil Service Employees Association, inc., Albany, New York, parent organization of the local C.S.E.A. request- ing the names of all Southold Town employees, except police, who are not members of the C.S.E.A. 2. Letter from George G. DeLong, President of the Southold School Board of Education stating that due to austerity them are considering different busa pick-ups, and would like some changes in parking regulations on 0aklawn Avenue, Southold. This .would. entail amendment of the Code. 3, Letter from Citizens for East End Inc. relative to farm preservation asking for a letter in w~iting for support from Supervisor Martocchia. 4. Request £rom the Cutchogue Fire Department and Southold Town Fire Chiefs' Council relative to a new law allowing gambling by nonprofit organizations and asking £or the town's support o£ thislaw. ~. Letter from the Nassau County Department of General Services relative to an upcoming seminar on solar energy; and would like someone from Southold Town to attend. August 12th, 10 A.M. at the County Seat Drive, Social Serives Auditorium, Mineola. 6. Letter £rom John Wickham, Planning Board Chairman, setting forth his feelings and results of his study on flood plain insurance. He-is opposed to some parts o£ this program put £orth by the federal government. :7. Letter from Peggy Dow, Southold, q~esti~ning a rumor she has heard that the town will build'a massive parking lot in back of the town hall addition in Southold, which will eliminate a play area for ten to twelve children in the neighborhood. ~he board is not-aware of such a plan for a parking lot. Councilman Rich will speak to Mrs. Dow on this matter. Mrs. Dow also asked the town's support in paying for the fee for a yard sale for the y0u~h program, as the funds are used for the' town's youth and the $15.00 fee is excessive in her opinion. The town board personally contributed $15.00 to cover this permit. On motion of Councilman Rich, seconded'by Councilman Homan, it was RESOLVED that the Southold Fire Department is hereby granted a special license to hold a carnival on the fire department grounds, Main Road, Southold, New York from August 10, 1976 through August 15, 1976. This special license is granted in accordance with Article XI, Section 100-14, Subsection C of the Code of the Town of Southold. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homart, Justice Surer, Justice Demarest. This resolution was declared duly adopted. On motion of~Councitmmu Homan, seconded by Councilman Rich, it was RESOLVE~ that Supervisor Albert M. Martoochia be and he hereby is authorized to enter into a renewal lease for a launching ramp next to themarina on Narrow River Road, Orient, the only public access to Peconic Bay in the area,-with H. M. Demarest & Sons, at a rental' fee of $100.00 for the period of September l, 1976 through~ugust 31, 1977; property bounded north by Narrow River Road, east by now or formerly of John Brown, south by Hallock's Bay, west by now or formerly of George L. Edwards; Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Surer. Not voting: Justice Demarest. T.his ~esolu~on was declared duly adopted. On motion o£ Councitmau Homan, seconded by Councilman Rich, it was RESOLVED that Supervisor'Albert M. Martocchia be and:he hereby is 'authorized to enter into a contract with the Village of Greenport for police radio communication services at $6,000.00 per year for a five year term. - Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Bemarest. No: Justice Surer. This resolution was declared duly adopted. Supervisor Martocchia: 8. On July 26th the board received aproposal from the Southold Town Chapter of the Civil Service Employees' Association for the 1977-78 contract. The Board granted the Supervisor permission to set up a date for a meeting setting forth the board's counter propsals. 9._ Supervisor Martocchia reported the Mill Creek Bridge was closed at 4:00 P.M. on MOnday, August 9th i~mthe event of rising above normal tides doe to the impending hurricane. No damage was done and the bridge is now open again. The new bridge at Mill Creek should.be under construction by,late September as they will be taking bids this month. t0.-~ The clam transplant program is on schedule and are taking delivery now. On motion of Justice. Surer, seconded by Councilman Rich, WHEREAS W. Edgar Worthington has'applied to the Town Board for a single trailer renewal permit dated July 16, 1976'~ NOW, ~THEREFORE, BE IT RESOLVED that the application of W. Edgar Worthington to locate a single' trailer on his property on the south side Sound Avenue, Mattituck,~New York, be renewed for six (6)-months. Vote of the~ Town. Moved by CoUncilman Homan, seconded~by Justice Surer, WHEREAS the Sacred Heart R. C. Church, Cutchogue, New York, has applied to the Town Clerk for a Bingo License, and WHEREAS the Town Board has examined the application and after investigation, duly made findings and determinawtions as required .by law, NOW, THEREFORE, BE IT RESOLVED that the Supervisor be and he hereby is authorized and directed to execute on behalf 0f the~Town Board the findings and determinations as required by law, and it~,is further RESOLVED that the Town Cl'erk' be and she hereby is directed to issue a Bingo License to the Sacred. On motion of Justice Surer, seconded by Justice Demarest, itL, was RESOLVED that the SoutholdTown Board accepts the bond of $200',000.00 for roads and improvements in the subdivision known as_."Highland Estates" located on the northside 0f Route 25 Cutchogue, New York, owned by 75 Highland Road Corporation; bond in the ~me of Richard T. Mohring and Rita Mohring. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Surer, Justice Demarest. This resolution was declared duly adopted. On motion of Justice Surer, seconded by Justice Demarest, it was RESOLVED~that consent is hereby given to Raymond C. Dean, Super- intendent of Highways of the Town of Southold to abandon Channel Lane, a certain highway located at Mattituck, in the Town of Southold and more fully described in an Order Laying Out Highways dated October 25, 1949 and filed in the Town Clerk's 0££ice on October 25, 1949; said highway has not been traveled or used as a highway fo~ six years, prior to the date hereof, and said ~high~ay is hereby declared abandoned as a highway and a public right o£ way, pursuant to the provisions of Section 205 of the Highway Law. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Surer, 'Justice Demarest~ This resolution was dec-lared duly adopted. On motion of Councilman Rich, seconded by Councilman Homan, it was RESOLVED that consent is hereby given to Raymond C. Dean, Super- intendent of Highways of the Town of Southold to abandon Harper Road, a certain highway located atSouthold, in the Town of SOuthold and more fully described in an Order Laying Out Town Highway dated April 9, 1968 and filed in the Town Clerk's 0££ice on April 9, 1968; said highway has not been traveled or used as a highway for six years prier to the date hereof, and .said highway is hereby declared abandonedas a highway anda public right of way, pursuant to the provisions of Section 205 of the Highway Law. Vote of the Town Board: Ayes: Supervisor Martoochia, Councilman Rich, Councilman Homan, Justice Surer, Justice Demarest. This resolution was declaredduly adopted. On motion of Councilman Rich, seconded by Councilman Homan, it was. RESOLVED that the following audited bills be approved and ordered paid: General fund bills in the amount of $39,899.37; Highway Department bills in the amount of $25,191.88; Fishers Island Ferry District bills in the amotrat of $28,992.53; and Street Lighting Installation bills in the amount of $1,996.17. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Surer, Justice Demarest. This resolution was declared duly adopted. Super~i'~or Martocchia stated that a£ter the public ham:had a~shamce to talk to the Board, a recess will be called for the purpose'of discussing some amendments to the code, and possibly set a date for a hearing. Mrs. Hardy spoke to the Board about a new house built in Southwood owned by four brothers. Mrs.~Hardy estimates 30 to 35 people Will be occupying this house.--Supervisor Martocchia, Councilman Rich and Councilman Homart became aware of this situation~only the day before and have not had an opportUnity to look into the matter. Mrs. Hardy stated the house calls for five bathrooms. Supervisor Martocchia said they have been issued a temporary certificate of occupancy~ which is permissible, although it is only one-half finished on the outside. The Building Department and Environmental Department have looked at the house, and a determinatipn will be made iff there is a violation of the Housing Code where more than the required number of people are sleeping in one bedroom. Mrs. Marie Johnson asked about' a large house on Main Bayview Road, Southold, formerly owned by Edson, which has been turned into apart~ ments. The Board 'is' aware~o£ this house in question and is certain it is a'legal operation by reason of a variance by the Board of Appeals. Mrs. Gladys Csajko inquired about the 48 unit housing plan for the BohackVillage in Mattituck.--Supervisor Martocchia stated that a plan fpr that complex ~was received from HUD last week, whereby the ~o~ner~s applying for financing and HUD asked for the Town's recommend- ation On this situation~ The Board has asked~the Planuing Board to look it over and reply to them by the 24th of August. The~ Board must reply to HUD by the 27th of August.---There was a public meeting scheduled by the Chamber of Commerce of Mattituck for the Previous evening, but due to the hurricane it was postPoned to next Monday. Mrs. Sherley Katz asked about the Hellman and Ahlers proposal on Youngs Avenue, Southold. Supervisor Mart0cchia stated the property in question was rezoned to "M" zone and they have now applied to HUD for financing.---Andrea .Aurichio stated she had spoken to HUD this morning and was told the Hellman-Ahlers application was not for financing; all they are askingfor is a right of subsidy. Supervisor Martocchia'was asked if he has an overall assessment of the hurricam damage to Southold Town, and he replied he did not as yet. Mrs. Marie Johnson asked if the Supervisor will comply with the request of the State branch of theCSEAfor the names of non-CSEA to~wn-employees?-r-S,upervisor Martocchia stated he wQuld seek a legalopinion on this question from the town attorney. · On motion of'coUncilman Homan, seconded by Councilman Richj' it was ~ESOLVEDthat a recess be called at 4:I0 B.M., meeting to reConvene following the public hearing which is scheduled for 4:30 P.M.
