This photo is what the space looked like after his clearing. 1 41 E CC; EI ' L .,: S E P 3 2025 �'`-� Southold Town Board of Trustees t On Saturday July 5tn, • the floors were curing inside the house, preparing to be installed, so I could not be on site. • Charlie, the excavator, likes to work on the week-ends, and decided to create the driveway the same day because it was easier to work when the carpenters are not on site. • When I came back on Monday morning, July 7tn, I found the area across the street cleared and leveled. • Why move the equipment across the road? o To make room to work/ build the driveway, also trying not to hurt the newly seeded grass on the property, Charlie chose to temporarily move the tools, wood and other large items across the road knowing that I owned that property as well. • 1 immediately called Charlie to ask for Charlie's help remediating the situation, but Charlie could not return until later in the week; So, we had no equipment with which to move the heavy pieces until he returned. On Wednesday July 9tn • Mike drove by unexpectedly, saw the equipment, and told me that I had until he returned the next day, to clear it OR he would give me a summons. Sam Fitzgerald - architect-was with me at the time and can confirm this message is accurate. • Approximately 3 hours later, , the below photos were then sent to both Mike and Sam Fitzgerald to show Mike that the men and I had moved the equipment by hand, thereby fulfilling his demand, and therefore, a summons was not needed. • To comply, I personally had to attach the heaviest "rake attachment" to the hitch of my Audi, and drag it across the road because no contractor could move it. • The photos were sent with the following text message: o Just sharing photos that all debris is already moved onto our driveway o Charlie will bring key to backhoe in the am o And seed and hay to recondition the dirt on the side of the road. o He is sorry he did not get it moved back sooner and understands your concerns. • By 8:30 am, Thursday July 10th, Charlie got to the island, and all was moved, seeded and hayed by the time Mike arrived. • Mike proceeded to hand me 4 summons anyway. Q zs PI I I a I n n�t Pertaining to Run off and 100' wetland buffer remediation: • We were assigned to build the home at 24'. • We installed the silt fencing as required. • As you can see from the plan below, we decided NOT to install the driveway where it was assigned, because we felt that a 100' + retaining wall, and the large amounts of unnatural material, would create a negative impact on the land, the wetlands and the community. • In his preparation of the hill, Charlie -the excavator- measured carefully, and must have cut a little too close to the 100' wetlands boundary line. I watched him out there carefully measuring, and reminded him regularly to be attentive to the boundary. I thought he had done a good job, and I know he worked really hard. • To help with the run off, at the end of June, we hired David Burnham, Race Rock landscaping, to hydro-seed the property ...Then... • We had a heat wave, as you know, and my daily watering, while it eventually took root, added to the run off which you could see as some sand in the road. nr•� 1 •M•tl u...x... nin / •� a .-�"-':.., •vim :8: 1. ��..0 e.' Mike's drive by and frustrations with the site were within 10 days of the new seed and daily, (sometimes 2x a day, watering) and before the seed had germinated with roots strong enough to hold. The final phase of preparing that hill side in summer just got dusty and difficult, to say the least. But it eventually worked. We have some grass that will need to be over-seeded this month. We have a beautiful yard instead of a 100+ retaining wall that the dock beach and water community would have had to look at every day, and the space is 100% natural. We have presented a plan to remediate the 10' buffer up from the road, along the 100' wetlands buffer line. Again, no malice, the exact opposite. The irony of this hearing is that we were only trying to create a more natural, beautiful street and water scape, one that was without the more "solid" and less natural materials, It was a true attempt to make the most natural yard we could in order to be visually pleasing to the neighborhood, the water community, the land community. We also worked to keep the space between the 100' wetlands, and the yard, as natural as possible. We just ran into a few unforeseen and un-asked for weather and excavator related hurdles, and Mike drove by before either of them had time to be remediated. In summary: I apologize for these mistakes and promise that there was no malice, just mistakes that are 100%fixable. 1. We have already remediated the run off on both properties with the grass, hay and the approved driveway. 2. We have spent time and money to prepare a plan for remediation of the clearing that is both healthy for the environment and the community. In your deliberation of these mistakes, I ask that you consider that we have already paid a huge price tag for this mistake: Even though the house has passed all safety CO requirements,and is safe for occupancy, this summons, and its connection to the trustee's acceptance of our proposed plan for remediation,which is scheduled for tomorrow,Thursday Sept 3'd, has delayed my CO by a month, a month that costs me and my family dearly in the following ways: 1. Application fees to the trustees: $ 3000 2. Plant material to remediate the vegetation on both properties: $2000 3. 4 Landscapers to plant the material: $ 2000 4. The delay of the CO a. Carrying costs: $ 6,000 L I cannot get a loan to pay off my debts without the CO. ii. The carrying costs of the heloc's, line of credit, and cash out mortgages we had to take out on other family member's properties to complete this home, are costing me over 6K a month. b. Conservative missed Rental income for September/shoulder season: i. $ 10-20K/month, badly needed to repay the debts. 5. Personal/Familial; a. August was the time my mom, who is 89, was to gather with 4 generations in her new home, which she has waited 28 years to build. b. $$$ priceless and missed. That brings the dollar value of impact from these summons to a total of: 1. $13,000, not including rental income 2. $23,000-$33,000 including lost rental income I hope you agree this is an excessive price to pay for run off from watering to improve the design,seed a lawn, and remediate the excavator's completely fixable mistakes that professionals have confirmed,would ironically grow back more naturally without our remediation. But most importantly, I am one of the home owners who truly cares about the beauty of and importance of caring for the natural environment. Our site is extraordinary, and we actually erected an old barn from Ohio to reflect these qualities, leaving the land more naturally landscaped",and intentionally placing every window and door to appreciate the site lines of Fishers Island West Harbor Community. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposal is; CONSISTENT with the LWRP with the following condition: Policy 6.1 B (2) Retain and add indigenous plants to maintain and restore values of natural ecological communities. To be consistent with the policies of the LWRP, only native drought-tolerant species should be planted. The plant list is not specific as to two of the species, lupine and iris. Require only the native species be used, and prohibit the invasive species as described below. • Lupine — prohibit the use of Lupinis polyphyllus (Bigleaf Lupine) • Iris — prohibit the use of Iris pseduacorus (Yellow iris), Other species of iris and lupine are acceptable. We met with professionals,ordered native plants,created a landscaping/revegetation plan for the area that was cleared,and used the plants named below to create the requested 10' non-turf buffer within the 100-foot Trustee jurisdictional area,as well as an additional ten (10)foot wide vegetated non-turf buffer area along the landward edge of the 100-foot jurisdictional edge/line.
