The recommendation of the LWRP at the time was that the action be found inconsistent. The Board, in its decision, found the action consistent. Charles Cuddy, Esq. on behalf of NICHOLAS ALIANO requests a Wetland Permit and a Coastal Erosion Permit to construct a proposed two-story dwelling (885sq.ft. on each of the two floors) with a 91 sq.ft. front covered patio, 3'x8' and 4'x8' second story balconies; install an I/A OWTS sanitary system; install water and electric services; install a stone blend driveway; install gutters to leaders to drywells to contain storm-water runoff; construct a 209 linear foot long rock revetment from neighbor's bulkhead to west to the edge of property line to the east; there will be a small area of excavation along toe of bluff; install filter fabric, 18" of blanket stone 10 to 15 lbs., toe stones 3 to 5 tons each, top and face stones 2 to 4 tons each; place sand backfill raising the finished grade seaward and over new rock revetment; a project limiting fence installed prior to construction along limit of clearing; any disturbed areas to be re-vegetated with beach grass; to establish and perpetually maintain 28,127sq.ft. Non-Disturbance Buffer areas along both bluff faces, and a 3,022 Non-Turf Buffer along the landward edges of the Non-Disturbance Buffers. Located: 3705 Duck Pond Road, Cutchogue. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is CONSISTENT with LWRP Policies and, therefore, CONSISTENT with the LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Cuddy, Esq.,the following is an assessment of the slopes within the building area of the above referenced site, based surveys and site visits performed by us,as well as our office records,and other available data. PropeM Description The property is known as Lot 5 of"Map of Vista Bluff'subdivision,filed in 1968. Since that time, all but two of the lots in the subdivision have been improved with residences, including the subject parcel. When the subdivision was created, all the lots along the bluff,and Duck Pond Road, exhibited slopes in excess of 20%. Lots 1 thru 4 exhibiting standard bluff face slopes,with lots 5 thru 9 exhibiting gully and outwash slopes, largely in excess of 20%for portions of each lot. Lots 6 thru 9 are currently improved with residences. The subject parcel contains a partial foundation constructed circa 2006. Planning Engineering Land Surveying w Interior Slopes The slopes present within the area of the proposed improvements are predominantly less than 20%. Some slopes of 20%or more,were created as a result of foundation construction. The currently existing foundation was only partially constructed before activity terminated,and the slopes have remained since. Upon completion of the construction of a residence,there will be no slopes of 20%or more. Based on office records,the slope prior to construction activity was approximately 15% or less,consistent with the upland portion of the property and surrounding topography. It should be noted that since the patrial construction of the existing foundation approximately 18 years ago,the upland area,and the area surrounding it, has become heavily vegetated, confirming there has been no erosion to the bluff, gully, or the building site, as a result of its placement, even without the benefit of the completion of proper grading and drainage efforts. In summary, it is our opinion that any slopes of 20% or more,present within the immediate proposed building area, are the result of ceased construction activity,and are not naturally occurring.
