Supervisor Martocchia opened the meeting at 3:00 P.M. with the following present: Supervisor Albert M. Martocchia Councilman James H. Rich, Jr. Councilman James Homan Justice Martin Suter' Justice Louis M. Demarest Town Attorney Robert W. Tasker Highway Superintendent Raymond C. Dean Town Clerk Judith T. Doyen On motion of Councilman Homan, seconded by Councilman Rich, it was RESOLVED that the June 22, 1976 minutes of a regular meeting of the Southold Town Board be and hereby are approved. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homart, Justice Suter, Justice Demarest. This resolution was declared duly adopted. On motion of Justice Suter, seconded by Councilman Rich, it was RESOLUED that the next regular meeting of the Southold Town Board will be held at 3:00 P.M., Tuesday, June 27, 1976 at the town board meeting room, 16 South Street, Greenport, New York. On motion of Councilman Rich, seconded by Councilman Homan, it was RESOLVED that the June reports of Supervisor Martocchia, Town Clerk Terry, Justice Surer, and Building Department be and hereby are accepted and ordered place on file, Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Surer, Justice Demarest. This resolution was declared duly adopted. Supervisor Martocchia reported: ~. Item # 4 on the agenda - auditing bills - will be completed following a recess of this meeting. 2~Applications for dredging projects: Thomas L. Blankley, Jockey Creek, Southold, objections by August 5th, hearing August 11th. Leopold Stein, East Marion, objections by August lOth, hearing August 16th. Paul Capron, East Marion, objections by August 4th, hearing AUgust 10th.---All hearings by the Department of Environmental Conservation, State of New York. 3. Applications before the U.S. Army Engineers: Edmund H. Curcuru, Paradise Point, Southold, objections by July 29th. Matt-A- Mart, Inc., Mattituck, objections by July 29th. William Gardner, Nassau Point, Cutchogue, objections by July 29th. Donald Finnerty, Cutchogu~ Harbor, Cutchogue, objections by July 15th. 4. On Thursday, July 15th, at 2 P.M. and T:30 P.M. there will be information meetings on the wetland regulations at the Suffolk County Center, Riverhead, Maps will be available at that time. 2O 5. At the last meeting the Board approved the figure of ~35,000.00 for subdivision known as Peconic Knolls; There will be a waiver on construction of part of that roadway and a new bond estimate will be submitted in the near future. On motion of Councilman Homan, seconded by Councilman Rich, it was RESOLVED that upon a submission of a proper voucher, the Town Board authorizes payment to C.S.S. Testing Lab. Inc. the fee of $55.00 per day and $40.00 per half-day for concrete batch plant inspection, and $60.00 per day and $45.Q0 per half-day for concrete field inspection in connection with testing and inspection services regarding the controlled concrete at the Southold Town Hall addition site, fees for which the Town of Southold is responsible for payment. .Vote of the Town Board: Ayes:. Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Surer, Justice Demarest. This resolution was declared dq~y adopted. Supervisor Martocchia: 6. The Board has received a series of maps and study books on the Flood Insurance Program for the Town of Southold. The Town Board will study them and has submitted a set to the Planning Board for their study and recommendation. 7. A request of the Planning Board f?r a joint meeting on cumulative zoning will be considered for the near future. 8. Receipt of a ~uestionnaire relative to self insurance in con~unction with a county Study which is being made. 9. Dredging proSeCt at Conklins Point, Greenport - The Town Board is uncertain whether to recommend such a plan or not, as two years ago the town supported the project, but-was objected to by some people in the area, therefore it was defeated; however, now some people in the area want the project. The Supervisor has asked a county survey team to study the plan.-- Mrs. Oladys Csajko stated that three years ago the taxpayers Went on record as opposing the proje6t as it is all private property and would set a precedent. The Department'of Environmental Conservation turned the ~roject- down completely. Mrs. Csajko recommends that the Psopie involved pay for the Project themselves and not expect the 10. Nuclear Regulatory Commission indicating the pre-hearing conference will be reeonvened at 9:00A.M. July 15, 1976 at the Holiday Inn, Riverhead. 14. Notice relative to new non,profit organiz~tiOnj~ambting law. The town attorney will examin~ the law as it pertains~0-the Town of Southold. 15. Letter from the Southold Town Baymen's Association, Inc. requesting inclusion in the town ordinances putting'them on the same level as an agricultural farmer. They ask that a change or addition to Article III, Section 100-30 : "the right to make and store fish nets, lobster pots, and other necessities of o~r~ work on our own property or the property we lease. We also request that our boats be permitted at our owndocks or docks which we-rent. We base this request on the assumption'that mariculture and agriculture are one ~d the ssme,'i.e; that f~ming~of the land~ and farming of'the sea are identical in our f~shing and agriculture eommunity." The request will be studiedbetween the Planni~gBoard and Town Board and should have some sort of determination within a month. 16. Thank you lette~=~from the Nassau Farms Association relative to dredging of Little Creek, Cutchogue. On motion of Justice Surer, seconded by Co~nciiman Homart, it was RESOLVED that the Southold Senior Citizens be granted permission to contract roy one.additional bus to go to Shirley on July 1~, 1976 at a cost of $90.00. On motion of Justice Surer, seconded by Councilman Rich, it was RESOLVED that the resignation of' Marjorie McDermott as secretary to the Board of Appeals and Building Inspector of the Town of 'S0uthold effective August 2, 1976 be accepted with regret, and it is further RESOLVED that a letter o£ thanks and appreciation be sent to Mrs. McDermOtt for her years of dedicated service to the town. Letter from Mattituck Chamber of Commerce requesting the town tO d&tcontinue draining silt and sand ±nrc W01f Pit Lake. The Mattituck Park Commission has authorized the town to fill the adjacent parcel which should resolve the drainage problem. A letter was also received from Mr. Murphy pertaining to this same subject. The matter has been referred to the Highway Superintendent to work out a Solution to the problem. 18. Notice from the Department of the Army regarding the implementation of the-second phase of a three-phase program to protect the quality of the waters of the United States against harmful discharges of dredged or filled materials which will be implemented on July 1, 1976. ' 19; Copy of a notice from the State of New York, Department of Pub%ic Services, Board on Electric Generation Siting and the Environment relative to the proposed Long Island Lighting Company Jam~spdrt G'enerating Station; Nuclear Units I and 2 whereby the Towns of East Hampton and Southampton wish to become the late intervenors at the hearings. - - 20. Thrusday, July 15, 1976 there will. be a meeting at the Southold Presbyterian Church, 7:30 P.M. relative to setting up a town,wide blood program to cover the blood needs of all residents in all.villages of the Town of Southold. 21. Letter from the Suffolk County Department 0£ Transportation requesting information for a study they are making of special transportation services; to identify the level of transportation, existing services, develop and evaluate alternative plans and programs, end'recommend specific programs of action. 22~. Acknowledgement letter from the New York State Division of Ho~sing andCommunity Renewal relative to the Town o£ Southold's adoption of the State Building Construction Code. 2~i. Letter from the Suffolk County Department of Civil Service informing the town that the time period for Veteran's preference during the Korean conflict has been extended from July 27, 1953 to JanU~ 31, 1955. On motion of-Justice Demarest,' seconded by Councilman Rick, it was RESOLVED that the Orient Fire'Department Ladies Auxiliary be and hereby is granted permission to close off the portion of Orchard Street, Orient, between Village Lane and Navy Street on August 21, 1976~between the~ hours of 9:00 P.M. and 1:00 A.M.; and provide the necwssary insurance coverage to hold the Town of Southold free from damages. Letter from Assemblyman Duryea statingrelative to the exempt status of Nassau and Suffolk County's exemption from the Navigation Law~ Thisyear the Assembly passed legislation removing this exempt status, however., the Senate did not passthe~legislation thereby continuing us in the exempt classification. 25. Not~ce from the Long Island Lighting Company stating Classi£icatio~ # 5 and Classi£ication #8 will have auinOrease in its electric service rates. Classi£ication # 5 pertains to traf£ic signal lighting and Classi£ication #8 pertains to street lighting. Oni-motion of Councilman Homart, seconded by Councilman Rich, it was RESOLVED that the Superintendent of Highways of the Town of So'uthold ~ authorized t'o advertise for bids and to purchase from the lowest respobsible bidder, the following more or less, as needed: Item No. t:.~ 15,000 lin. feet of snow fence with pickets 1½ x 3/8 inches, spaced 2 inches apart, 4 feet high stained red, with five C5) double starnds, of 12½ gauge galvanized wire in 100 lin. foot rolls. I:tem No. 2. 1,000 - 6 ft. studded steel T posts with' flanges or anchorplates on posts, posts shall net be less than 8,65 lbs. each. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Surer, Justice Demarest. This resolution was declared duly adopted. Supervisor Martocchia: 27. Receipt of a letter from the residents of the Rocky Point Road area East Marion. There has been the problem of the steps to the beach which have been destroyed time after time~by vandals, so the beach has been closed and steps r~moved. A chain link fence was installed, but it was destroyed two days after it was placed there, including the no parking and no trespaasing signs. The residents of the area feel they are being penalized, and have offered to police the area on shifts. The board appreciates their interest but Feels there would still be problems in that area, therefore the beach mus~--remain closed for the present time. 28. At the last~meeting the board tabled a request by the Mattituck Senior-Citizens to go to Monticello for four days and five nights, involving$560.O0 for buses. The.board met with the president and representatives of that group this morning and were enlightened by the discussion as to their rules and regulations. the trips taken by the senior citizens are Voted on by the membership and-~s a groupdecision. On motion of Justice Surer, seconded by Justice Demarest, it was RESOLVED that a decision on the senior citizen trip to Monticello be tabled until the next meeting of Julys27,' 1976 to give the board an opportunity to'discuss the proposal, and to make it possible for Justi-ceDoyen, Fishers Island, to be present to vote on the proposal. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, ~Justice Surer, JusticeDemarest. This resolution was declared duly adopted. Supervisor Martocchia opened the moating for discussion by the public, explaining first that the board'will recess toaudit bills and meet with Chief of Police ~atal'do. Mrs. Mar$~ejo, Mattituck complimented the board on the dog pound, the high ~ate of adoption, it is well run and very clean.--She has learned, however, of an idiviidual-in Mattituck who has two dogs in a house without food. A letter was sent to Justice Surer by Raffe and Raffe, attorneys from Riverhead, indicating this situation. Mrs. Tejo is concerned with the case of neglect of the dogs who ~ppear to her to be abandoned; they were there from June 23rd through July 9th. The warden was~oa!led, but he did not act,~since the dogs were licensed and being fed by someone who was aksed by the owner to care fro them.---Justice Surer stated he received a copy of a letter f_rom Raffe and Raffe representing a Mrs. Naugl~s in Matt~tuck who repossessed certain property upon which rhode were two dogs which were being fed by relatives of thw owner of the property. Mrs. Naugles admits the dogs were being fed, and Justice Suter contacted Town Attorney to ask if the town has any right to go'on-to private property to~s'eize those dogs since they werenot technically abandoned at this time since someone was taking care of them according to Mr. Raffe~s~ow~ letter~ It was not a complaint about thedogs 'not being cared for as being the purpose of the letter; the letter concerned the repossession o£ the property only. She wished tO know wh~t progress, there is on ~he senior-citizen-teen center up~o the present time?--S~pervisor Martocchia stated they did enter into a program £or three grants for such l~center. $2~,76.0.00 was granted, it has not been received yet,,as the first:phase. Mrs..Sherley Katz asked~if anything has been done by the town,board on the X0A change in cutting back.the buffer strip_ from 600 f~ to 300 ft.?4~-Supervisor Martocchiastated. there was a oointmeeting between the attorney for~the appli'cant, the planning boa~d,..a~d boardo£ appeals and it will. be on':'the agenda for the 27th. M~_~. C~E~-Allen, Mattituck spoke to the Board re!arise to dredging of James Creek by. the County of Suffolk, the application for Which was-made about 2½ years-ago, and the fill must be placed to the West, where the Salt Lake~Village property owners will not gi~e permission.---Supervisor Martocchia stated_~he dredging of Ja~es Creek should be started in the very near future. A suggestion wa~directed to:t~e board re!~ive toone-way-park~ing on the Main Street in Greenport.---Supervisor Martocchia state~ the matter is one for the Vil!.~e of Greenport, not the Town of Southold. Mr. William Po!lert, Southold, read a letter to the Town Board relative to a canoe renting enterprise which has been operating at the foot of Pine Neck Road, Southold. The matterwas made~known to various town officiatsand police and ~building departments. Action was taken by the~polio~ departmen~,~but the canoe business continued. He urged a review of ~perti~ent town'ordinances by ~the town attorney and town bOard and if additional ordinances or~ '~ regulations are necessary they should be enacted at the earliest possible time. He did state the business has not'been operat'ing during the-last fewdays..---Supervisor Martocchiastated the m~tter was discussed between the town attorney,'building department~d town board to try to resolve the situation. This business operator, Austin Burr, could rent a parcel of business property and.then operate~his business;however,:he was directed to discontinue the business in the former~manne~ of.parking on certain residential streets. .Mr. Peter Frumenti of the Southold Town MarineRescue Unit of' Civil Defense~thanked-Supervisor MartocChia and.~the town board for all th~.~~ help they have given them. SupervisOr Martocchia thanke~them for their efforts. Mrs. Gladys Csajko asked for the answer to the X0A question.-, SUpervisor Martocchia stat~d~the Appeals Board will hold a hearing on July 22nd.~---Mrs. Csajko spoke about the problem directed'to the Board by Mrs. Tejo; stating the owner of the property if. fro~ ou~ of state; and possibly the wardens could be given better instructionsin handling matters of this nature. The abandonment' case can be covered under three'or four different sections of the state law. Mrs. Csajko did~talk to D~. Zitek who stated the animals are definitely in bad health. It is a serious abandonment' problem.---Justice Demarest stated the wardens cannot be ordered, on the strength of a letter, to go out and pick up those animals. ---Mrs. Csajko asked then why did they not go out and observe.--- Justice Surer stated they did go out a~d observe, and determined the animals were all right, in fact in such good shape, if they were to be picked up,'they would have to use a~tranqualizer gum to get near the dogs. -If a complaint for a dangerous dog is filed, a hearing will be held, mad a determaination c~a be made. --- Mrs. Csajko stated Mrs. Tejo has a list of people in the neighborhood who are willing to tes%ify the dogs are abandone~.---Super¥isor Martocohia stated the matter will be looked into and if there are any corrections to be made on the part of the town, it will be done. Mr. William Pell III asked what the advantages of purchasing a seCond-hand 1975 truck to' purchasing a new one?---Supervisor MartocChia stated the highway superintendent has probably spotted something at a good price, but he still has to go to bid.- On motion of Councilman Rich, seconded by Councilman Homan, it was RESOLVED that a recess be called at 4:45 P.M., to reconvene at 5:30 P.M. On motion of Councilman Homan, seconded by Councilman Rich, it was RESOLVED that $53.44 be and hereby is transferred from the Fishers Island Ferry District office to Fishers Is~land Ferry D~strict property Tax. : Vote~ of the Town Board: Ayes: Supervisor MartOcchia, ~ouncilman Rich, Councilman Homan, Justice Surer, Justice Demarest. This resolution was declared duly adopted. On motion of Justice Surer, seconded by Councilman Homan, it was RESOLVED that the following audited bills be and hereby are approved for payment: General Fund bills in the amount of $39,595.03; Highway Department bills in the amount of$24,705.3~; Fishers Island Ferry District bills in the amount of $23,704.32; Street Lighting Installation bills in the amom~t of $699~51; and Federal Revenue Sharing bills in the amount of $163.14.~ Vote of the Town Boar~: Ayes.: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Surer, Justice Demarest. This resolution was declared duly adopted. Supervisor Martocchia asked for the board's permission, and"w~s granted same, to write a letter to the Village of Greenport relative to :the renewal of the police radio 's~rvice. Supervisor Martocchia spoke to Mayor Townsend some timeback, stating the ~cost o£ service will be $6,000.00 per year, with an escella~or clause of'$1,000.00 per year and was. supposed to have an answer by July 1st. Mayor Townsend stated tha~. Village does not have the money to pay such an amount for the police radio service, but would take the matter up at a special village meeting on July 12th, and reply immediately. At this time, 6:15 P.M., no reply has.been received. The board directed the supervisor to seek a reply 'before their next meeting of July 27th, Or to send a second letter by registered mail stating that if there is no .contract by August 1st service will be terminated. On motion of Justice Surer, seconded by Councilman Rich, it was RESOLVED that there being no further business be come before this town board meeting, adjournment be called at 6:30 P.M.
