Supervisor Martocchia called the"meeting to order at 3~00 P.M. with the following present: Supervisor Albert M. Martocchia Councilman James H. On motion of Justice Suter, seconded by Justice Demarest, it was' RESOLVED that the next regular meeting of the Southold Town Board Will be held at 3:00 P.M., Tuesday, June 8, 1976 at the town board meeting room, 16 South Street, Greenport, New York. Vote of the Town Board: Ayes: Supervisor Martocchia, Council~a~ Rich, Councilman Homan, Justice Surer, Justice Demarest. This resolution.was declared duly adopted. Supervisor Martocchia reported: 1. Highway Superintendent Dean reports that the sanitary facilities at McCabes is 3/4 completed and the one at Southold Town Beach is 1/2 completed. The beaches will open the last Saturday of ~une. 2. Second announcement received for public hearing at the Greenport School on Wednesday, June 9~h, 7:30 P.M. relative to the dredging for the Thames River, Connecticut. 3. Hearings will be held at the Hau.ppauge Suffolk County Center on June 2, 1976 at 2:00 P.M. and 7:30 P.M.; the second hearing will be at the Riverhead County Center on June 4th at 2:00 P.M. and 7:30 P.M. On motion of Councilman Homan, seconded by Councilman Rich, it was RESOLVED that Wayne Grattan, Cutchogue, be-hired as a summer patrol- man at a ~alary of $3.50 per hour to be paid monthly; employment effective at such time as authorized by the Supervisor. Vote of the Town Board: Ayes: SuPervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. Supervisor Martocchia: "--~.~ Letter"from Thomas O'-Ne£11-relative to trespassings'over property he alleges to own-.at Goose Creek,.Southold~- I~'-is his--~ responsibility~to~prove ownership'and-post his Own'no-trespassmng signs. - ..... 5. Letter from Loris Pesce relative to poor workmanship on his building. Mr. Pesce feels the town should adopt the New York State Building Code. 6. Letter from Arthur Rausch urging the town to adopt the dog leash law. 7. Letter from Nelson Axien urging the tow~ to adopt the dog leash law. 8. Notiee from the AAA Club of.New York Citing Southold Town for a safety award, to be presented June 17th at New. York City, for no pedestrian fatalities in Southold Town during the year 1975. A similar award was received by the town for 1974. 9. Petition from residents of the Bailey Beach area, Mattituck, citing problems with fast traveling vehicles, wish a.15 mph sign, automobi~p_curfew at 10 PM, to 5 AM, signs stating children at play, no littering signs~Itrash recepticles,.guard rails. Petition contains 14 signatures. Highway Superintendent Dean will investigate the situation. 10. Notification from. Hospitalization that their rates will increase 33% next month.---Mr. Wright asked if there is any competition in this regard?---Supervisor~Martocchia stated it is Blue-Cross, Blue- Sh~ld, and the lowest increase_in competing companies is 30%. It costs the town approximately.S788.00 per employee for the family plan. 11. Petition for a road dedication, on North Bayview Road, Southold. It ~as been referred to the ~ighway committee, Justice Suter and Justice D~emarest for their recommendation at the next meeting. 12. Fishers Island Ferry District asks the town's approval of a consulting firm to design the layout of improvements they wish to do in Silver Eel~Cove. A~consulting.firm is~required uRder the terms of the federal grant they will receive. Fee for the firm is $5,000.00. 13. Letter from the Town. of Easthampt0n relative to a resolution they adopted re: striped bass. On motion of Councilman Homan, seconded by Justice Suter, it was RESOLVED that the low bidder of Aerial Line C~ntractors, Inc., Brookhaven, New York be and hereby is accepted to install approx? imately 250-150.watt high pressure Sodium luminaires in conjunction with the construction and maintenance of a street lighting system for the Town of Southold~and. that the Supervisor be and he hereby is authorized to enter into a contract for the same. Vote of the Town Board: Ayes-: Supervisor Martocchia, CounCilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolutionwas declared duly adopted. Supervisor Martocchia: 14. Letter from Paula Kisco, Lydia Wilson, Mr. & Mrs. E. Baylis relative to animals for experimental purposes. The~town is no~interested in p~r~uing.such~a proposal. . -15. Letter from Josephine and Joseph Faller, New Suffolk urging the town to adppt the dog leash law ........ On motion of ~Councilman Homan,.seconded by Justice Surer, it was RESOLVED that the Southold Town Board accepts the withdrawal of.the petition of Paul Kaloski for a grant of scenic and/or conservation easement on property at Cutchogue, New York, and cancellation of a pu~lic.hearing~to be~held on this matter.at 3:3,0 P.M..this~da~e~ May 25, 197~6. - ..... The Long Island Cablevision line extension policy has been approved as adopted. If anyone in Southold Town wishes a survey of ~b~r area~for extension of cablevision, they may call the toll, free number 4~7722500.---The microwave system is about to be completed momentarily and it was tested Sunday night for t/2 hour and proved to be excellent. 1976 17. Letter from Jean Tiedke, intervenor for Southold Town at the LI~O nuclear plant hearings, citing her opinions on how the town should act on the i~sue. There is a presentation today at the suffolk County ~enter, River~ead before the Board of County Legislators. The Board is still waiting for the-hearings to be complete before making their determination. 18. FOllow-up letter from the'Corps Of Engineers relative to a resident'who erected a float off of Skunk ~ane, Cutchogue. The ·own Board had entered objections as he had not obtained a permit from the Engineers before doing it. They now wish the reasoning for the tOWn~ objections. The applicant does have a town permit and the ~wn board will so state to the Engineers. 19. Notice of hearing by Department of Environmental Conservation on Rpplication of Edward Curcuru for permisszon to build a 60 ft. and 50 ft. timber groin perpendicular to an existing bulkhead. Hearing date June 11, 1976, 10:30 A.M., objections by June 7, 1976. 20. New Suffolk Ramp: extensive meetings have been held with Joyce Burland, County Legislator, to make the si~e operational. Superg~or Martocchia has taked with Albany and Stony Brook; has filed a hardship letter, and it is possible a permit will be issued within a month.' 21. Application of Robert Dier, Founders Landing area, Southold to build a commercial pier. This is a second application; the first one was opposed by the Town of Southold, and they also oppose the second application. On motion of Councilman Homan, seconded by Justice Suter, it was RESOLVED that Supervisor AlbertM. Martocchia be and he hereby is authorized to sign a contract on behalf of the Town of Southold with Bernard J. Annabel, Cutchogue, New York, as a part-time bay constable, for the purpose of patrolling the waterways in and about the Town of Southold for the summer season ending September 6, 1976 for the-total sdm of $800~00; ~aid Bernard~J] Annabel agreeing to supply a s~itable boat, eq6ipment, and be responsible for the repair amd maintenance of said equipment. Vote of the Town Board: Ayes: Supervisor Martocchia, CounCilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. On motion of Councilman Rich, ~econded by Councilman Homan, it was RESOLVED that Supervisor Albert M. Martocchia be and he hereby is authorized to signRa contract on behalf of the Town of Sout~old with Kenneth Edwards, Fishers Island, New York, as a part-ti~e bay constable, for the purpose Of ~atrolling the waterw&ys in and about the Town of Southold for the summer season ending September 6, 1976 for the total sum of $950.00; said Kenneth Edwards agreeing to supply a suitable boat, equipment, fuel, and be responsible for the repair and maintenance of said equipment. On motion of Councilman Rich, seconded by Councilman Homan, it was RESOLVED that Supervisor Albert M. Martocchia be and he hereby is authorized to sign a cQntract on behalf Of the Town of Southold with Joseph J~ Froh~hoefer, Jr., Southold, New"York,~ as a part-time bay constable, for the purpose ~f patrolling the waterways in and about the Town of Southold for the summer season endiMg September 6, 1976 for a sum not to exceed $3.50 per hour or not to exceed $800.00; said Joseph J. Frohnhoefer, Jr. agreeing to supply a suitable boat, e~uiP~ent, and be ~esponsible for~ the repair and maintenance of ~aid equipment. - ..... Has a copy of his hardship letter ~o the Department o~ Environmental Conservation, and they state a permit should be'granted withih a month. On motion of Justice Surer, seconded by Councilman Homan, it was RESOLVED that the resignation of Anthony J. DeMaula, Mattituck from the Board of Assessment Review be and hereby is accepted. Invited anyone wh6 wished to apply for Ehe p0sision on the Board of Assessment Review to please apply to the Supervisor or one of the Board members. Salary is $50.00 for Grievance Day and $25.00 for each day thereafter, when worked. On motion of Justice Suter, seconded by CoUncilman Rich, it Was RESOLVED that a bill in the 'amount of $231.83 from the New York-State Department of Social Services in settlement of a bill the town Defused to pay due to proo_f of fraud, be and'hereby is authorized for payment. Letter from the Southcld Town Baymen's Association requesting the town to go into the clam transplant program with matching funds from the State of New York. Town pays $2,000.00 and State matches $2,000.00. On motion of Councilman Homan, seconded by Justice Suter, ~ was RESOLVED that the Town of Southotd participate in the clam transplant program in the amount of $2.,000.00, With' ~ tching funds of $2,000.00 from the State of New York. York, said petition_for a change of zone from"A" Residential and Agricultura~ District to "C" Light Industrial District, now, therefore, be it RESOLVED that the Town Clerk©of the Town of Southold be and she hereby is directed to transmit this application to the Planning Board in accord- ance with Article XV, section 100-150 (B) of the Code of the Town of Southold. On motion of Justice Demarest, seconded by Justice Suter, it was RESOLVED that the plan prepared at the request of this Board for the i~rovement of town highways and covering all projects contemplated by it, pursuant to Article 8-A Highway Law, as filed in the office ofthe Town Clerk of the Town of Southold, County of Suffolk, on the 25th day of May, 1976 be and the same is hereby adopted, and be it further RESOLVED that copies of such plan be filed in the appropriate State a~d County offices in accordance with the provisions of Section 220, Article 8-A Highway Law. Martocchia be and he hereby is authorized to enter into a contract with Gerleen Contractors, the lowest~re~ponsible bidder for the general construction of the Southold Town!Hall addition at Southold, New York, in the amount of $227.400.00 plus $7QOQ00 for alternate ~1, the installation of carpeting in Assembly Hall No. 4 in lieu of Vinyl Asbestos Floor Tile as specified under the basic specifications. Martocchia be and he hereby is author%zed to enter into a contract with Frank Peterson, Corp., the lowest~responsible bidder for the plumbing installation at the S0uthg~dTown Hall addition at S0uthold, New ork, in the amount of $33',00D.'00, plus $12,000.00 for alternate P-l, the installation in acbord~noe with Division 15 B requirements the complete Sprinkler Syste~-as specified under Section 01100 of the specifications. The only bid in the town hall addition that remains to be awarded is the elect~Rcal work. The low bidder is Mineol~ Electric at $38,000.00 plus $1,800.00 for Alternate E-l, the installation of a lightning protection system as specified under Section 01100 - Alternatives; however there seems to be some question as to whether this bidder might withdraw so the board is awaiting word from the architect as to what steps shall be taken next. 26. Receipt Of ~ bill for retirement deductiohs which requires a transfer of funds to allow for a reduction in the whole town retire- ment account where there is $6,000.00 too much money budgeted. On motion of Justice Surer, seconded by Councilman Rich, it was RESOLVED that atransfer of $6,000.00 from Whole Town Retirement Fund and $4,000.00 Whole Contingent Fund be made to A1930.~ - Judgements and Claims Account~for the settlement upon court decision, of la~d hcquisit~ion of property of,John Rath, North Road to Bayview, Southold, New York. A0.9 signatures, showing deep concern in having their respective aueas properly, maintained and. improved consistent with the homes therein established and. that any buildings, and .s structures that shall be erected shall be of such sound construction, condition, and nature as to accord with those of the immediate neighborhood. 'They feel that there is serious need for imD~0ved housing and zoning laws-to-properly maintain and preserve their home.areas- and~therefore request the town to adopt such legislation for suchimprovement including adoption o~ ~he Coda State reco.mm~nded for municipaZities as to minimum, requirem~n~s~ Mr. Wright asked for the Boards' opinions on this matter.-.- Supervisor Martocchia stated the-code is being considered.-.~. Mr. Wright suggested ~an'~A~chitectural 5eview ~oardJThat'%he~ town s_hould get on with more up-to-date laws.---Mr-s~ Shirley' Bachrachprotested the '"physical and visual' deterioration 'ofi ~he corner of North P~rish'Drive, Southold"; that the town sh0ut~ /have bought the property for.parkingfor swimming,'.boating, £ishin~:_~and parking for the yacht club; as it will cause the need for low~ring the assessment on property in the entire area.-- Supervisor Martocchia stated the board is always unhappy with undesirable~ growth, but all construction mustmeet the requirements of 6h~' building zone ordinance and housing code of the Town of Sout~q!d.-; A lso, the town: cannot buy each and every pmece of vacant proPerty whichmight be a detriment to adjoining areas. In the Goose Creek Bridge area referred to, th~ town has tried everythingl possible to slow down activity as it is a hazardous area for;. boating and swimming, in fact the beach will not be open to the p~blic this year. The yacht club is Southold Park DistriCt. ., ,. property and the town would not be inclined to provide parking~ ~or their faciltiies at the expense of all the taxpayers of own. The house and propertY reffered to on the corner of N0~h Parrish Drive has not violated the zoning ordinance, housingl ~de,, or wetlands'ordinance of the town.--Mrs. Gladys Csajko s{atedi~he recalled the Council making a study and the board settingUp, al committee for studying the possibility of a building code.--. SUPervisor Martocchia statedthe board met with a state building code official ~two meetingsago, and the board will make a~de~9'~- mination soon.--Mr. Wright asked if the code had been turne~i-~wn two times?---The reply was no.--Councilman Rich stated that When Mr. Albertson was Supervisor a hearing was held but there was~ore opposition to it than in favor, and it was not turned down,, i~ was just not passed. Me. William Pell III asked if the County designed the Goo'se Cmeek Bridge and put it in, shouldn't the county pay if it does not coincide with the town roads?--Supervisor Martocchia stated the town must provide the right-of-way, and when the fence on th~ ~ath ~lt~ property was taken down to provide room for construction, it was ~ replaced somewhat on the property of Mr. Rath, therefore the co,urt found in favor of Mr. Rath and the town ordered to pay him $~,000.00 for encroaching on his property. Mr. Pell asked if the New Suffolk ramp filled in in November?-- Supervisor Martocchia stated he did not know.---Mr. Pall asked.,if anyone made periodic checks of the launching ramps to determin~ if they are clear?~-Supervisor Martocchia stated that once the season ends, the only boats using the New Suffolk Ramp is the launch going over to Robins Island and the police boat. Thee.boat to Rob~s Island did not mention of it to the town. Mr. Pell asked about the appointments of Steve Mazzaferro and Lois Mellas as dog wardens, who were appointed on March 9th, why did the board appoint Lois Mellas and JDhn~Hel£ on April 27th?--Supervisor Martocchia stated that Steve Mazzaferro passed the test, but did not pass'high enough, so his temporary appointment could not be made permanent, LoisMellas was appointed temporary dog warden on the 9th of March and permanent on the 27th of April, because her mark was high enough to be within reach on the civil service list. T~e question was asked why the Johnston matter was passed over; it appears on the agenda?--Supervisor Martocchia stated that the matter was discussed in the morning with the chariman of the Town Trustees AlvahGoldsmith, Town Attorney Tasker and the entire Town Board.-- Councilman Homart stated the town board should not go into the subject off-the Johnston property as it is a town trustee matter.-- Mr. William Nick~, Fleets Neck, Cutchogue stated that by granting Mr. Johnston a ~uit claim deed they would be opening the situation up to a law suit.---Councilmau Homan stated the subject of a quit claim deed is not under consideration by the town board at all. Mr. Wright asked if the town board recognized the urgent need for an improved zoning law or are they jus~ passive to it?--Supervisor Martocchia stated they recognize whatever laws that are put into effect are subject to review periodically, as conditions change.-- Mr. Wright stated it is high time to tighten up on the regulations. Is the Board opposed to the New York State Code?--Supervisor Martocchia stated no one is absolutely opposed. Copies of the Code have been ordered for each member of the board, and these copies will be studied individually before a decision is made.--Considerable discussion ensued.---Councilman Rich explained many phases of the Code,explaining it merely sets standards. It gives the b~ding inspectors the right to make about five inspections; more than they do presently under the zoning ordinance.--The question was~asked if the town has been beseiged to h~y vacant property?--Yes, numerous times. However, often the price doubles when the town becomes interested. Mr. William Pell asked if there is anything new on the property the town hopes to buy on Peconic Lane?--Supervisor Martocchia stated they are in contact to buy it. $3,000.00 w~a transferred for the 10% of the purchase price and a few hundred dollars for title search~etc. Mrs. Gladys Csajko, Greenport, asked if the board is anywhere near making a decision on~e leash law?--Supervisor Martocchia stated they are deadlocked.--Mrs. Csajko asked about Fainting the road area in front of the Greenport School; and about a sign showing a school area. There is a sign near the Catholic school, couldn't it be moved near the Greenport School?--Supervisor Martocchia stated the work should be done by the N.Y.S. Dept. of Transportation, but usually the town ends up doing it. It will prbbably Be done soon.-- Mrs. Csajko asked about unallocated insurance Which came to $29,000.00 in 1974 and $22,000.00 in 1975.---Eustice Demarest stated one of the bills came due near the end of the year and one bill might have been paid in the beginning of and end of the year.---Mrs. Csajko asked if the Supervisor had found the contract for the insurance?--Super- visor Martocchia stated it was not a bidding item.--Justice Demarest stated that many years ago the town had insurance with many companies, lo,ad they were lacking, and it was the board's decision to pick one c~mD~a~. They picked the Price Agency. He is solely Desponsible for all of the town's insurance. He sublet to the Reeve Agency. If the town has a problem they go to the Price Agency. It would be impossible to bid out insurance policies. They all come due at different times, and it would be impossible for companies to figure a rate for bid.--Mrs. Csajko asked if there is anything else you do not have to bid on?--Justice Demarest stated professiona~ services, such as an architect; and insurance would come under the heading of professional services. Mr. Pell asked what would come before the Board when they reconvene after the recess?---Supervisor Martocchia said they woul8 review the salary of one of their employees. On motion of Councilman Homan, seconded by Councilman Rich, it was RESOLVED that a one-half hour recess be called at 4:45 P.M. to reconvene at 5:15 P.M.
