On motion of Justice Suter, seconded by Councilman Rich, it was
RESOLVED that the minutes of the April 27, 1976 Southcld Town_ Board
meeting be and hereby are approved.

Rich, Justice Suter, Justice Demarest.
This resolution was declared duly adopted.
On motion of Justice Demarest, seconded by Justice Suter, it was
RESOLVED that the next regular meeting of the Southold Town Board
will be held at 3:00 P.M., Tuesday, May 25, 1976 at the town board
~eeting room, 16 South Street, Greenport, New York.

This resolution was declared duly adopted.
Supervisor Martocchia reported:
1. Superintendent of Highways Dean reported to Supervisor
Ma~tocehia that the sanitary facilities for McCabes Beach and
Southold Town Beach have pas~ed inspection of the Health Department,
Suffolk County, and are under 6onstruction.
On motion of Justice Demarest, seconded by Councilman Rich, it was
RESOLVED that the April 1976 reports of Supervisor Martocchia,
Justice Suter, Building Department and Town Clerk Terry be and hereby
are received add placed on file.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Justice Suter, Justice Demarest.
This resolution was declared duly adopted.
Supervisor Mattocchia:
2. Receipt of a letter from the North Fork Environmental
Council, including the Congressional Record, pertaining to their
opposition to the Jamesport nuclear plant, and asking the Town
Board to adopt a resolution similar to Easthampton and Southampton
Towns asking LILCO to postpone the development of the plants, as
being detrimental to the development of the north fork. Letter
signed by President of the North Fork Enqironmental Council Merlon
Wiggzns.---The Town Board is staying neutral for the time being as
the Town of Southold is being represented by Mrs. Jean Tiedke as
intervenor.
3. Letter from the Southold Town Planning Board with recommendation
for changes in the zoning ordinance. The muggestions will be taken into
consideration and studied.
4. Notification of federal hearings about to be held realtive
to ~he proposed nuclear plant and request by the town for permission
to appear at a later date and submit town statements and/or questions,
and asking any appearance the~town would make become a part of the
official record.
5. Letter from the Fishers Island Ferry District notifying
the town of the dismissal of one of the ferry district employees
with reasons.
6. Request of the Nature Conservancy to visit Fishers Island
to review some of the land le£t to the Nature Conservancy at Fishers
Island. Supervisor Martocchia is working on a plan for such a visit.--
The senior Citizens of Fishers Island wish to take a tour of Southold
Town and a possible dual trip can be arranged.
7. Notice from the office of Assemblyman Perry B. Duryea stating
a proposed bill is being drafted regarding the taking of lobsters in
the State of New York; a problem Fishers Island is now having with
Connecticut residents.
8. ReCeipt of a letter from Assemblyman Perry B. Duryea stating
Route 25 between the Brookhaven-Riverhead town line and Orient Point
has now been designated a scenic and historic corridor in Suffolk
County, and an amended bill adding Route 27 between the Brookhaven-
Southampton town line and Montauk.
9. Announcement from the U. S. Army Corps of Engineers and
U. S~ Navy stating there will be a public hearing relative to the
dredging of the Thames River, Groton - New London, Connecticut.on
Wednesday, June 9, 1976, 7:30 P.M. at the Greenport High School.
- lO. Upon request of the Mattituck Fire Department, there will
be a new traffic signal at the intersection of Route 27 and Wickham
Avenue. The Mattituck Fire Department have asked that controls for
the light be placed in ~h~ fire'bouse, and it received the approval
of the Department of Public Works, but was denied by the Department
of Traffic Safety. There wiI1 be a meeting May 12th at ~:00 P.M.
at the Mattituck Fire House with the Traffic Safety Director and
Deputy of Suffolk County. Commissioners and Chief have ~een notified
to be there.
il. The Board has reviewed the matter of aged exemption, and
finds there are 409 applications on file receiving the benefit, and
64 receiving the maximum benefit of $6,500.00 re~nesenting County
and State taxes. In checking with Albany, the-Board finds there
are many bills on file, and they do not know where t6 turn; howeVer,
in view of the many bills, and uncertainty of what will be adopted,
time does not allow ~he exemption to be passed by the town for the
76-77 'tax roll. -The board~would like to meet with th~ senior citizens
again after~ the leg'islative session is over and review What can be
done for the following tax year.---Mr. Joseph Gleason, Southold,
addressed the Board and pointed out he has a list of bills from Ronald
Stout, Chairman of-the legislative-committee r~lative to aged exempsions,
indicating much of what has been said by-the Supervisor.- Mr. Gleason
als0 read from a proposed bill whic~ Would exclude from determination
of income ~Iigibility-th0se increases in social security benefits
and other federally approved retirement plans pp to such increases
in social security benefits granted after January~l~ 1976. There will
be a meeting at.the Southold School on Tuesday, May 13, 1976 to discuss
the matter.
Moved by Justice Suter, _seconded by Councilman Rich,
WHEREAS Charles J. ~Zahra has applied to the Southold Town Board for
a p~rmit bopeperate a transient travel trailer p~rk on the north
side of School House Road, Cutchogue, New York, and
WHEREAS a Public hearing was held on said application On the 27th
day of April 1976, at which time all interested persons ~e~ ~i~en
an opportunity-to be heard, now, therefore, b8 it
RESOLVED that Charles J. Zahra be granted permission to opeaate a
transient travel trailer park on the north side of School H~mse Road,
Cutchogue, New York, bounded north by Leisure Green, east by Buace
and another, south by School HQ~se Road, and west by MundarQ and Town
of Southold, SUBJECT TO THE FOLLOWING CONDITIONS:
1. The number of trailers presently situated ~n the property
under the former permit held by Clifford and Edwina TyLer, namely
twenty-three sites, shall not be increased.

Supervisor Martocchia:
12. :Letter fro~ Burton Potter Post, Greenport, hosttown
for the Memorial Day parade and they invite the town board to'attend.
13. Letter from Gerard L. Urban, Pine Neck Road, Southold
relative to his feelings on the proposed leash law.
14. Letter fro~ LILCO whereby they have modified their plan
for seasonal subscribers to 85% demand clause at the end of five
years.
15. Receipt of a copy of the LILCO contract relative to the
separation of service. There will be bid openings for the installation
of street lights on May 18th.
16. Report from audit of Fishers Island Ferry District stating
their books have been reviewed and everything is in order.

On motion of Justice Demarest, seconded by Councilman Rich, it w~s
RESOLVED that St. Peter's Lutheran' Church be denfed permission %o use
the S. Wentworth Horton Park on the north side of Route ~25, Greenport
as a site for their German Festival in July. The park has been
refurbished at considerable expense as a park and picnic area and
allowing hundreds of people to use the site for the proposed festival
would estroy the area.

Supervisor Martocchia:
17. Notification from the Department of Environmental Conservation
on the following applications: Raymond Akscin, Southold - hearing
June 7, 1976 - objections by June 1, 1976. Gardiners Bay Estates -
proposal to dredge a canal. Frank Nowak, hearing May 20th - Peters
Creek west of Wickham Avenue, Mattituck objections by May 14th.
William Johnston, Fishermans Beach, Cutchogue, Haywaters Cove -
objections by May 12th. Ernest Guettinger - hearing May 18, 1976 -
reconstruct a .timber dock. Anton Zuvicic - hearing June 13th -
10 foot bulkhead, dredge. William Smith east of Meadow Lane,
New'Suffolk - one family residence, - objections by June I7th.
(Justice Demarest stated that Irving Latham, Orient, stated a
representative of the Corps of Army Engineers had requested a map
of areas in the town that require maintenance dredging, and it is
possible a blanket permit could be issued for those areas.)
18. Communication from 8~orge Mellas, Receiver of Taxes
expressing concern relative to possible changes in'the Suffolk County
Tax Act wher.eby there would be longer collection periods, basically
concerning schools. This could require year-round staffing of the
tax office. The town attorney recommended to the town board that
there be some provision in the bill whereby the town could bill the
school for the separate bill and additional services required.
Mr. Plackis suggested that the whole bill be paid by January With a
discount. Mr. ~Joseph Gleason concurred.
19. Letter from the Bank of New York stating they would li~e ~
to release security of the Town of Southold to another bank. ~The
board does not approve of such a release without prior consent.
On motion of Justice Suter,.seconded by Councilman Homan, it was
RESOLVED that Mattituck Senior Citizens be granted permission' to
contract for the use of one bus at a fee of $175.00 for a trip to
Shea Stadium on June 3, 1976.

On motion of Justice Suter, seconded by Justice Demarest, it was
RESOLVED that the Mattituck Senior Citizens be granted permission
to contract'"for the use of two buses at $140.00 each for a trip
t610~d Bethpage on June 8~ 1976; and two buses at $290.00 each for
a trip to Lake Waramang, Connecticut on September 9, 1976.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.

Mrs, Sherley Katz asked how much is left in the senior ci~zen account
after the aforementioned deductions?---Mr. Wesley Simcich stated he
does not approve of the money allocated to the sen~or citizens, that
the~ money dould be put to a much better use; it is limited to a certain
group.---Mrs. Bonnie Gordon stated the money set aside by the Riverhead
budget is for the elderly, not for any specific group.---Supervisor
Ma~tocchia stated $16,000.00 is set aside for youthl which is far more
than the senior citizens. He further stated the town is ready now to
go into contract on the land for the senior citizen-youth center at
Peconic - the land to cost $23,7D0.00.---Mr. Gleason stated the senior
citizen trips are not limited to members, any senior citizen may go.---
Supervisor Ma~occhia spoke about the Nutrition Program which is open
to everyone over a certain age. It is a program to get people out of
th~'house and among other people their age.
Supervisor Mart0cchia:
20. There w~ll be a public hearing on the wetlands moratorium
on June 2, at 2 PM and 7~30 PM at the Hauppauge County Center, and
on June 4, 1976 at 2 PM and 7:30 PM at the Riverhead County Center.
21. CATV has notified the Town that within the next two weeks
the microwave system w~ll be activated in Southold Town; and the pay
TV program will be available for the home at $9,95 per month
for the first outlet and $5.00 for additional outlets.---The question
arose as to why channel 2 has not been f~nctioning lately.---Mrs.
Bonnie Gordon stated that there have been private tests on that channel
for the microwave system.
22. Letter from Claire Sauer, Suffolk County Legislator
relaiive to the possibility of Southold Town becoming self-insured.
The supervisor stated their insurance program was put out to bid
a~d Roy H. Reeve. Insurance Serviee had the towns insurance. Each
agent in Southold Town received a com~sslon. ~The Price Agency-now
handles thg_insurance and the town therefore only has to deal with
one agent.---Marie Johnson questioned the fact as to whether if other
agents did not receive a commission, the rate might be lower for the
town.---Mr. Joseph Gleason expressed bis views on the policy of
splitting commissions.---Mrs. Gladys Csajko asked how much ~he
i~surance runs for a year; and when it was pu~ out to bid?---Supervisor
Martocchia stated several years ago, possibly ten. The cost per year
is in the budget.
23. Letter from the Town of Shelter Island including their
navigation ordinance. There 'is a proposal to have a uniform'Suffolk
County navigation ordinance.
24. Request from Value Management Consultants, Inc. for
consideration of its professional labor negotiation service. The
town board is satisfied with its present arrangement of negotiating
themselves, but wilt study th~ proposal.
25. The Department 6f Environmental Conservati0n requests ~he
specific 0bjections of the town board to-the application of Craig
Lehman.---CounCilman Homan state~ Mr. Lehman has a Town Trustee permit
and had been assured by the D.E.C. he did not need a permit.

Moved by Councilman Rich, seconded by Councilman Homan,
WHEREAS the Burton Potter Post ~185, American Legion, Greenport,
New York, applied to the Town Clerk for an amended Bingo License, and
WHEREAS the Town Board has examined the application, and after
investigation, duly made findings and determinations as required
by law, now, therefore, be it
R~SOLVED that the Supervisor be and he hereby is authorized a~d
directed to execute on behalf of the Town Board of the Town of
Southold the findings and determinations as required by law, and
it is further
RESOLVED that the Town Clerk be and she hereby is directed to issue
an amen/ded Bingo License to the Burton Potter Post ~185~ American
Legion, Greenport, New York.

Moved by Justice Suter, seconded by Councilman Homan,
WHEREAS George McCarthy applied to the Town Board for a single
trailer permit, now, therefore, be it
RESOLVED that the application of George McCarthy to locate a single
trailer on his property at the south side Main Road, Laurel, New
York, be and hereby is granted for a period~f six months.

Moved by Councilman Homan, seconded by Councilman Rich,
WHEREAS Minnie Wilson applied to the Town Board for a single
trailer permit, now, therefore, be it
RESOLVED that the application Of Minnie~Wilson for a single trailer
renewal on her property on the west side of private road, off t~e
north side of Middle Road (CR27), Cutchogue, New York, be and hereby
is granted for a period of six (6) months.

On motion of Councilman Homan, seconded by Councilman Rich, it was
RESOLVED that Superintendent of Highways Raymond C. Dean be ~nd he
hereby is authorized payment of $35.00 for cable purchased from the
SuffOlk County Department of Emergency Preparedness. This billing
will be received momentarily and has to be paid on receipt.

On motion of Councilman Rich, seconded by Councilman Homan, it was
RESOLVED that Superintendent of Highways Raymond C. Dean be and he
hereby is authorized paymsnt of $250.00 for one (1) stake truck to
be purchased from the Suffolk county Department of Emergency
P~eparedness. This truck and the billing will be received momentarily
and has to be paid on receipt.

Mr. Vincent Bialecki addressed the Board, asking that some action be
taken in opening the ramp at the end of Jackson Street, New Suffolk,
which has filled in.---Supervisor Mattocchia stated he and Councilman
Homan have spent many hours with the Department of Public Works, the
Department of Environmental Conservation and other agencies, but
cannot o~der work done without the required legal permits. The town
T~edoing everything in their power, including calling Albany, to
spe~.d up approval for dredging out the launching ramp area. Supervisor
Ma!r~dhia stated there are 47 different agencies that must give their
appr~v~l.---A suggestion was made to have a .ramp in Mattituck at the
end of Bay Avenue; however this'~is ~4attituck Park District property.---
Mr. John Case was of the opinion the Board assur2ed the public they
would open the ramp.

Mr. John Case submitted to the Town Board an application for a change
of-zone by the Cutchogue Polish Democratic Club.---The application is
incomplete as it lacks~the survey map of the property.---Mr. Case was
to go directly to Van Tuyl Surveyors to attempt to secure the map.
Mrs. Gladys Csa~ko stated the Allied Council requested that the to~n
look into provisions for removing unsafe buildings.---Supervisor
Martocchia stated the ~own does not have such an ordinance.
Mrs. Csgjk~ asked if t~e town knew when the white lines would be
painted along the sides of the road by the state?---Supervisor
Mar~occhia stated they are working in the area now.
Mrs. Csajko, on behalf of the Animal League, commended the board on
the two people hired as dog wardens. They have been working quite
closely with them and they are doing a fine job, keeping the place
clean, and cooperating with the League members.
Mrs. Marie Johnson asked why the light~rn the monument at the triangle
park is on in the day-time?---Supervisor Martocchia stated that is
Southold Park DiStrict property; that when a flag flies twenty-four
hours there must be a light on it constantly.
On motion of Justice Suter, seconded by Justice Demarest, it was
RESOLVED that a recess be called at 4:40 P.M., meeting to reconvene
at 6:00 P.M.

On motion of Justice Demarest, seconded by Justice Suter, it was
RESOLVED that the sum of $3,000.00 be t~nsferred from A1990. Contingent
Whole Tow~ Account to A7140. Recreation Program-Land Acquisition Whole
Town Account.

Rich, Councilman Homan, Justice Suter, Justice Demarest.
This resolution was declared duly adopted.
On motion of Justice Demarest, seconded by Justice Suter, it was
RESOLVED that Supervisor Albert M. Martocchia be and be hereby is
authorized to enter into an agreement with Lillian Gozelski for the
acquisition of land on the east side of Peconic Lane, souhh of the
Southold School District property, Peconic, New York, at a total price
of $23,760.00 for 2-1/3 acres of land.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.
This resolution was declared duly adopted.
On motion of Justice Demarest, seconded by Justiee Suter, it was
RESOLVED that the following audited bills be approved for payment:
General Fund bills in the amount of $16,131.11; Highway Department
bills in the amount of $16,332.85; and Fishers Island Ferry District
bills in the amount of $44,031.47.

Rich, Councilman Homan, Justice Suter, Justice Demarest.

On motion of Justice Demarest, seconded by Council~ n Rich, it was
RESOLVED that the following individuals be hired as summer patrolm~n:
at a salary of $3.50 per hour to be paid monthly: William N. Beebe,
Jr., Cutchogue, Gary Claudio, Greenport, Robert Reyer, Mattituck,
Steven Witherspoon, Southold, Stanley Becker (relief), Mattituck.
Employment shall be effective at such a time as a~thorized by the
Supervisor.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.
