SOUTHOLD TOWN BOARD MINUTES
February 10, 1976
A regular meeting of the Southold Town Board was held on Tuesday,
February 10, 1976 at the Town Board meeting room, 16 South Street,
Greenport, New York. Supervisor Martocchia opened the meeting at
3:00 P.M., with the following present:

On motion of Councilman Homan, seconded by Justice Suter, it was
RESOLVED that the minutes of the January 20, 1976 Southold Town
Board meeting be and hereby are approved as submitted.

On motion-of Councilman Rich, seconded by Justice Suter, it was

Board meeting room, 16 South Street, Greenport, N~w York.

On motion of Justice Demarest, seconded by Councilman Homan, it was
RESOLVED that the reports of Supervisor Mart0cchia, Town Clerk Boken,
Building Department and Justice Suter for the mont~ of January 1976, and
the 1975 annual report of Justice Demarest be accepted and placed on
file.

This resolution was declared duly adopted.
1. Supervisor MartoCchia thanked Councilman Homan for attending a
meeting at Stony Brook, on behalf of Supervisor Martocchia, with the
Conservation Department in reference to the different programs the
department has in force for 12 month, s The town is again going to
enter into the clam transplant program, on a supporting basis, the
town pays $2,000.00 and the state pays $2,000.00 enabling the town
Lo buy $4,000.00 worth of stock to keep So~thold Town waters'supplied.
2. Receipt of a letter from the Cutchogue Fire Department relative
to their annual functions.
On motion of Councilman Homan, seconded by Councilman Rich, it was
RESOLVED that the request of the Cutchogue Fire Department for the
exclusive use of the parking area opposite the'fire station in
Cutchogu~ on July 24, 1976 for their annual barbeque, and August 28,
1976 for their parade and drill be and hereby is granted.

On motion of Councilman Rich, seconded by Councilman Homan, it was
RESOLVED that the Southold Town Bicentennial Committee be and hereby
is granted permission to conduct a parade on July 10, 1976 from
Mattituck at 9:00 A.M. to Greenport; (Adolph Westerlund Chairman).

3. Letters from Burton Their and Godfrey High of Orient stating they
did not see proper notice of the report of the fe~my commission that
studied the location 9f the Long Island-Connecticut ferry.
4. Southold Town is one of the five eastern towns that ~upported a
resolution that the County of Suffolk should intervene in contesting
the increased fees by the Long Island Lighting Company.
5. Orient community has been selected as a historic district, and
they are trying to include the name in the National Register of
Historic Places.
6. Letter from the Department of Labor stating they have seasonal
jobs or types of jobs that the life of the ~ob isc~the life of the grant.
Theyyhave allowed five jobs to the Town of Southold.
7. ~everal letters have been received supporting the proposed leash
law, and one petition opposing it.
8. Notice from the County of Suffolk that the bikeway progra~ for
Southcld Town has been scrapped due to lack of funds.
9. Letter from Nature Conservancy, Paul Stoutenburg, asking the Board
to try to make transportation available for them to Fishers Island.
SupervIsor Martocchia will try to work out something for them, but
cannot make a commitment at this time.
10. Letter from Gladys Csajko demanding that the Town Board do
something about the bad weather~
11. In response to the question some time ago about how the Town Board
felt on the results of the s~u~y of the ferry committee, the Town Board
stated as long as it stays about the way it is there would be no
objection, however, if they were to expand to four lane highways, etc.
they would change their position. The committee would ~ow like t~
kno~ how the people feel about the Orient site' for the location'of
the ferry.
12. ~etter from the Greenport Fire Department asking for an emergency
generator similar to the one provided for the Orient Fire Department
by the Department of E~gency Preparedness.
13. Report from Jean Tiedke, intervenor at the LILCO hearings. Super-
visor Martocchia commended Mrs. Tiedke's fine coverage of the hea~ings
and reports p~esented.
14. In response to Thomas Jurzenia's request for better directions ~-~
at the end of the L. I. Expressway, Supervisor Martocchia has made ~
arrangements with the Department of Transportation, Auston Emory,
to make a study and report back to him.
~15. Notice has been received that the Town's hospitalization rate
will take a substantial jump in July. The amount stated is 27% increase.
16. The microfilming program will next include the historical records,
and then the Building Department. Completed are births, deaths,
marriages, highway books and most of the Town Board minute books.
17. Receipt of complete report of the duti of the town's records by
the New York State Department of Audit and Control for the years 1971
through 1974.
On motion of Justice Doyen, seconded by Justice Demarest, it was
RESOLVED that the Southold Town Board approves the action of the
Fishers Island Ferry District in recommending a 25¢ per hour raise
for Ione .Norton, secretary, increasing her salary from ~3.50 per hour
to $3.75 per hour.

'On motion of Justice Doyen, seconded by Councilman Rich, it was
RESOLVED that the Southold Town Board approves the action of the
Fishers Island Ferry District in accepting the bid of Bouton Services
in the amount of $5,259.00 for reSurbishing the ferry building at
F~sher's Island.

On motion of Justice Doyen, seconded by Councilman Homan, it was
RESOLVED that the Southold Town Board approves the action of the
Fishers Island Ferry District in accept the bid of Bouton Services
in the amount of $2,197.00 for tearing down building ~127 at Fishers
Island.

On motion of Justice Doyen, seconded by Councilman Rich, it was
RESOLVED that the Fishers Island F~rry District be and they hereby
are allowed to increase their petty cash fund from $20.00 to $26.00.

18. Report of a study being made on Fishers Island with the Fishers
Island Ferry District Commissionmrs as to whether a third passenger
ferry boat is needed.
Moved by Justice Demarest, seconded by Supervisor Martocchia,
WHEREAS, Richard C. Wilton, John J Clanton and Eastern Long Island
KampgroUnds, Inc. heretofore petitioned the Town Board of the Town
of Southold by amended petition sworn to on November 15, 1974 for a
change of zone of property located on the south side of County Route 27
and the west side of Queen Street northwest of the Incorporated Village
of Greenport by changing from "A" Residential and Agricultural District
to "M-I" General Multiple Residence District a parcel of land comprising
18.8717 acres and by changing from "A" Residential and Agricultural
District to "B" Light Business District a parcel comprising 5.1273 acres,
and
~REAS, said petition was referred to the Southold Town Planning
Board and the Suffolk County Planning Commission, and
~EREAS, the Suffolk County Planning Commission by letter dated
April 10, 1975 resolved that said changes of zone are to be approved
for local determination subject to compliance with the following
conditions:
1. Public water supply an~ sanitary sewage disposal will be
supplied by the Incorporated Village of Greenport;
2. The number of campsites will be limited to l~2in complignce
with "M-I" District requirements;
3. The buildings erected on Parcel II will be only those
used in connection with transient travel trailer campgrounds;
4. A 100 foot landscaped buffer zone comprising 0.4732 acres
will be provided on the northerly portion ~6 the premises as
it fronts on Middle Road (C.R. 27); and
5. ~ueen Street is to be widened and improved as per Town of
Southold specifications.

WHEREAS, the Southcld Town Planning Board by letter dated April
18, 1-975 advised this board that the Planning Board at a me~in9 held
thereon February 24, 1975 adopted a resolution recommendingTthiS
board theapproval of said application, and
WHEREAS~ a p~blic hearing was held by this board with respect
to said application on the 27th day of May, ~975,
John J. Clanton and Eastern Long Island Kampgrounds, Inc. be granted
a change of zone from "A" Residential and Agricultural District to
"M-i" General Multiple Residence District to the following-described
property, to wit:

ALL that certain plot, piece or parcel of land, with the
buildings and improvements thereon erected, situate, lying
and being at Greenport, Town of Southold, Suffolk County,
State of New York, bounded and described as follow~
BEGINNING at a monument located on the westerly line of

Eastern Long Island Kampgrounds, Inc. be granted a change of zone
from "A" Residential and Agricultural District to "B" Light
Business District with respect to the following described property,

lying and being at Greenport, Town of Southold, Suffolk County,
State of New York, bounded and described as follows:
BEGINNING at a monument at the intersection of thesouth-

westerly line of Queen Street two courses: (1) S. ll° 17' 10"

RESOLVED that the aforesaid changes of zone are subject to the
following conditions, to wit:
1. That public water supply and sanitary sewage disposal to
the premises which are the subject of this resolution be supplied
by the Incorporated Village of Greenport at the sole cost ~and
expense of the petitioners which said water supply and sewage
disposal systems shall comply with all of the requirements of all
agencies having jurisdiction thereof, and that said water supply
and sewage disposal systems be installed and in operation prior
to the occupancy of the premises for any purposes whatsoever.
2. That in the event that any portion of the premises located
within 100 feet of the land owned by the Village of Greenport is
utilized for campgrounds or trailer sites, a 6 foot chain link or
equivalent type fence shall be erected and maintained along the
boundary line of said land of the Village of Greenport.
3. That the portion of the premises adjacent to County Route
27 to a distance of 100 feet therefrom shall at all times be main-
tained as a landscaped buffer zone and that no buildings or
structures of any type whatsoever shall be erected or maintained
thereon. That the type and location of landscaping within said
buffer zone be approved by the Planning Board of the Town of
Southold; that in the event that County Route 27 shall be widened,
altered or relocated that said buffer zone shall be extended so
that said buffer zone shall at all times extend 1OO feet from the
said highway.
4. That to minimize traffic hazards that may occur by reason
of trailer vehicles entering and leaving said premises, suitable
turn-off or deceleration lanes or such other highway facilities as
the agency having jurisdiction of County Route 27 shall prescribe
shall be provided.
5. That in order to provide suitable access to the premises
over Queen Street, a 33 foot wide Town highway, the same will be
required to be widened to 50 feet. Prior to occupancy of the
rezoned ~premises by the owners thereof for trailer park purposes,
the owners shall at their.own~xpense improve and ~pa~e a 17~foot
strip along the westerly boundary of Queen Street in accordance
with the then Town highway requirements and when so improved and
paved, dedicate the same to the Town of Southold.
6. That the portion of the premises extending from a point
100 feet south of County Route 27 to a point 600 ,feet south of
County~ Route 27 be restricted to open 'recreational uses with no -
structures constructed thereon.
7. That any use of said premises as a campground as proposed
by Petitioners shall be on a seasonal basis only for the period
from .April 1st to November 30th of each year.
8. That said premises be used only 'for.the purpose of operating
thereon campgrounds franchised by Kampgrounds of America, ~Inc. in
accordance ~wi~h a~l of the :or_dinances,~ laws and regulations of the
Town of Southold and other authorities having j-urisdiction~thereof
and that no buildings or structures shall be erected on the
premises nOr.-shall the:premises be used~or any use except the
uses speci~iad herein and uses accessory a~d incidental thereto.
And IT IS FURTHER RESOLVED that
Pursuant to Section 1330 of the Suffolk County Charter that
the Town Clerk be and she hereby is directed to submit a certified
copy .of this resolution to the Suffolk County Planning Commission
for its approval~and
IT IS FURTHER RESOLVED that, pursuant to and in the manner
required by Section 265 of~the Town Law-, the Town Cler~ is hereby
directed to:
(a) Cause this smendment to be entered into the minutes of the
Town Board.
(b) Cause notice of this amendment to be published once in
the official town newspaper which is hereby designated as the
newspaper'for such publication.
(c) Cause said amendment to be shown and designated on the
Building Zone Map of the Town and file the same in a separate file
or filing cabinet in the Town Clerk's Office.
(c) Cause a copy of said Building Zone Map showing said
amendment to be filed in the office of the Building Inspector
for the use and benefit of the public.

Moved by Councilman Homan, seconded by Councilman Rich,
WHEREAS, the Town Board of the Town of Southold, New York
("Board" and "Town") is concerned with the need to provide street
lighting in the Town, having been informed that the Long Island
Lighting Company shall be discontinuing its street lighting
services in the Town; and
WHEREAS, in accordance with the provisions of Section 327
of the Highway Law, constituting Chapter 25 of the Consolidated
Laws of the State of New York, the Board has applied to the
Commissioner of Transportation for approval of the Board's plan
to install street lights in and along Town roads and highways as
defined by said Law;
RESOLVED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE
COUNTY OF SUFFOLK, NEW YORE (by the favorable vote of not less
than two-thirds of all the members of said Board) as follows:
Section 1. The Town is hereby authorized to purchase and
install street lamps in and along Town roads and highways in
accordance with plans approved or to be approved by theCommissioner
of Transportation. The estimated maximum cost of said specific
object or purpose, including preliminary costs and costs
inmidental thereto and the financing thereof is $100,000 and the
said amount is hereby appropriated therefor. The pl'an Of
financing includes the issuance of $100,000 serial bonds to
finance said appropriation and the levy of a tax upon all the
taxable real property within the Town to pay the interest on said~
bonds and the principal thereof as the same shall become due and
payable.
Section 2. Serial bonds of the Town in the principal amount
of $100,000 are hereby authorized to be issued pursuant to'~the
provisions of the Local Finance Law, constituting Chapter 33-a of
the Consolidated Laws of the State of New York (herein called
"Law"), to finance said appropriation.
Section 3. The following additional matters are hereby
determined and stated:
(a) The period of probable usefulness of said specific object
or purpose £or which the bonds authorized pursuant to this
resolution are to be issued, within the limitations of Section
ll.O0 a.35 of the Law, is five (5) years.
(b) Current funds are not required by the Law to be provided
as a down payment prior to the issuance of the bonds hereby author-
ized or of any notes issued in anticipation of the sale of such
bonds, in accordance with the provisions of Section 107.00 d.5
of the Law.
(c) The proposed maturity of the bonds authorized by this
resolution may not exceed five (5) years.
Section 4. Each of the bonds authorized pursuant to this
resolution and any bond anticipation notes issued in anticipation
:o£'~aid bonds, shal:l cont-a:in the rec&tal: of validity prescribed
by'~52~.O0 o£. ~he Law and said bonds and any notes issued 'in
anticipation o£ said bonds, shall be general obligations of the
Town, payable as to both ~principal and interest by a general tax
upon all the taxable real property within the Town-without
limitation o£ rate or amount. The £aith and credit o£ the Town are
hereby ~irrevoc~bly pledged to the punctual .payment. of the principal
and interest onsai~ bonds and provision shall be made annually
in the budget of the Town by appropriation for (a) the amortization
and redemption of the bonds to mature in such year and (b) the
payment of interest to be due and payable in such year.
Section 5. Subject to the provisions of this resolution and
of the Law~ pursuant ~o the provisions of ~30.00 relative.to the
authorization of the issuanc~e of bsnd anticipst~on notes, or,
the renewals of said Notes and of §50.00 and § §56.00 to 60.00 of
the Law~ the powers and duties of the Town Board relative to
authorizing bond anticipation notes and prescribing the terms,
form land,contents and as to the sale and issuance of the bonds
herein authorized and o£ any bond anticipation.notes issued in
anticipation of said bonds, and the renewals of said notes, are
hereby delegated to the Supervisor, the chief fiscal officer of
the
Section 6. The validity of the bonds authorized pursuant to
this resolution may be contested only if:
(a) such obligations are authorized for an
object or purpose for which the Town
is not authorized to expend money, or
(b) the provisions of law which, should be
complied with at the date of publication

and an-action, suit or proceeding contesting such validity, is
commenced within twenty days after the date of such publication., or
(c) such obligations are authorized in violation
of the provisions of the constitution.

On motion of Councilman Homan, seconded by Councilman Rich,
WHEREAS the Sacred Heart R. C. Church, Cut-ch:ogue;~Ne~York,.:has
applied to the Town Clerk for a Bingo License, and
WHEREAS the Town Board has examined the application and after
investigation, duly made findings and determinations as required
by law,
NOW, THEREFORE, BE IT RESOLVED that the Supervisor be and he
hereby-is authorized and directed to execute'on_behal£ ofc the Town
Board the findings and determinations required by law, and it is
further
RESOLVED that the Town Clerk be and she hereby is directed to issue
a Bingo License to the Sacred Heart R. C. Church, Cutchogue, New
York.

WHEREAS a petition was received from Walter R. Silleck requesting
a change of zone on certain property at Cutchogue, New York, said
petition for a change of zone from "A" Residential and. Agricul-
tural District to "B-l" General Business District.
NOW, THEREFORE, BE IT RESOLVED that the'Town Clerk of the Town of
Southold be and she hereby is directed to transmit this applica-
tion to thePlanning~Board in accordance with Article XV, Section
100-150 (B)~of the Code of the Town of Southold.

20. Supervisor Martocchia announced vacancies on the Conservation
Advisory Council and asked, if-auyone had a name the Board would be
glad to consider.them.

Mr. Lowell Logerwell,~a representative of the Mattituck Gun Club,
asked the Board to give considerable thought to the proposed Town
Law #130 legislation which was approved by the Senate and now is
before the Assembly. It would prohibit the discharge of firearms
in the Town of Southold and Shelter Island Town to enact their own
local law to prohibit the discharge of firearms if they should chose;
it would not be mandatory by the new legislation.
Mrs. Carlos T~jo,-Mattituck, expressed her dissa~is£a~tion with
the permission to hunt-in residential areas. Hunters have come
10 feet from her house.
Mr. Joseph:Fronhoefer, Southold, sta'~ed they are at the meeting to
determine what the intent of the Town Board will be if the 'state
legislation is enacted.--Supervisor Martocchia stated that such an
opinion would be premature.
Mr. Artie Schenard, Orient, Mrs. Sherley Xatz, and Mr. Ed Hanus
each discussed the proposed legislation.
Mrs. Sherley Katz asked if the existing code of construction of
the Town of Southold covers the Village of Greenport.--No.--Must
they then get a County license?--Yes.
Mrs. Gladys Csajko asked why the resolution was adopted for the
$100,000 bond.--Supervisor Martocchia explained that basically the
only extra money they have is for the town hall. Before they can
go to bid for street lighting they must have money set aside for
it.--Justice Demarest explained the amount of surplus remaining
in 1975 and how it affects the 1976 budget.--Considerable
discussion ensued.

Mrs. Csajko asked if the board hired a dog warden, and if not,
could they hire someone temporarily.--Supervisor Martocchia
stated they cannot wait much longer, and might possibly hire some-
one temporarily. There is only one name on the list so far.--
Mrs. Csajko asked about the dog pound, couldn't dogs be held
there?--Supervisor Martocchia stated they are held during the day
and taken at the end of the day in a single trip to Riverhead.--
Everything is in order at the pound except for the cages; new ones
having been ordered £rom Massachusetts.--Cost of the dog pound
was discussed with Mrs. Csajko.
The Board was asked if a decision has been made on the dog leash
law.--Answer - no.
Mr. David Driscoll addressed the board, stating that with reference
to the K.O.A. resolution and other resolutions and public hearings
on what he considered important, such matters take place when most
of the people of Southold Town are not in residence.-- He intends
to walk out of the meeting and demand a grand jury investigation
of the Town Board,' Planning Board and members of the Greenport
Board and County, or he will go to the State of New York.
Supervisor Martocchia asked if anyone else wished to address the
Board.
On motion of Councilman Rich, seconded by Councilman Homan, it was
RESOLVED that a recess be called at 4:30 p.m. for one hour, to
5:30 p.m. for the purpose of auditing the bills.-~
