SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions,without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. REQUESTED RELIEF: This is a request under Section 280-146D for an interpretation of the Town Code,Article I, Section 280-4, which defines HOTEL OR MOTEL,TRANSIENT appealing the Building Inspector's October 17, 2018,Notice of Disapproval of the proposed construction on this 76,230 square foot lot in the RR District, is not permitted pursuant to Article I, Section 280-4,which defines HOTEL OR MOTEL, TRANSIENT as"A building or group of buildings,whether detached or in connected units, containing individual guest units consisting of a room arranged or designed to be available for use as sleeping and living quarters for transients on a daily rental basis,provided that one such unit may connect directly with not more than one other such unit and that no cooking facilities shall be available...". The proposed plan indicates kitchen facilities. PLANNING BOARD OF THE TOWN OF SOUTHOLD: This application was referred to the Planning Board for review and comments. In a memo dated April 25, 2019, the Planning Board Chairman offered no opinion whether or not kitchens should be permitted in these units, but did indicate two issues of concern which included: (1) waste water generated by these units, and (2) the need to support resorts and transient rental uses in the zoning district. ADDITIONALBACKGROUND INFORMATION: In 1973, a building permit application was filed by then owner Jack Levin, Shortly thereafter a permit dated April 4, 1973 was issued by the Southold Town Building Department. The original permit application was for construction of a new two-story building on the subject property containing "8" motel units. Such building permit application, which was accompanied by detailed building plans clearly showing a designated "kitchen" facilities in the "typical unit" also designated the proposed eight (8) units of which we now known is ten (10) units as "dwelling units." At the time of building permit application, and thereafter, both "motel" units and "multiple dwellings" were permitted uses on the subject property. As appears from the annexed 1973 building permit application, a site plan for the subject property was approved by the Planning Board on May 9, 1073, and'the 1973 building permit application was itself approved by issuance of Building Permit No. 6463Z on May 10, 1973. i Following the construction of the proposed units and their associated kitchen facilities, the Town Building Department issued a Certificate of Occupancy No. Z6709 dated September 25, 1975, which specifically states that the building constructed on the subject property "conforms substantially to the Application for Building Permit filed April 4, 1973 pursuant to Building Permit No 6563Z and also "conforms to alI of the requirements of the applicable provisions of the law." Certificate of Occupancy No. Z6709 also states: "The occupancy for which this certificate is issued is [illegible number] (Apartment) Motel units (Multiple Residence). The new current Town Code Section 280-4 defines"hotel or motel,transient,"as: "A building or group of buildings,whether detached or in connected units, containing individual guest units consisting of a room arranged or designed to be available for use as sleeping and living quarters for transients on a daily rental basis, provided that one such sleeping unit may connect directly with no more than one other such unit and that no cooking facilities shall be available. Each such unit shall have a door opening on the exterior of the building or on a common hallway leading to the exterior..."(emphasis added) Section 280-4, which does not prohibit cooking or kitchen facilities in "resort" motel units, is much more applicable to the units on the subject property, given the fact that the units on the subject property have historically been used for much longer than a "daily rental basis," which short-term daily occupancy specifically defines "transient"motel units. The proposed renovations to the existing units and their kitchen facilities for which the Applicant has sought a building permit does not involve any change in use or intensity of use from the use that has been continuously conducted since the units were first constructed in the 1970's . No parking, loading, access, drainage, open space, or utilities characteristics of the property will be affected by the proposed work. Therefore, there is no basis, under the plain terms of Town Code Section 280-127, for requiring site plan approval for the proposed work. FINDINGS OF FACUREASON FOR BOARD ACTION The Zoning Board of Appeals held a public hearing on this application on May 9.2019, at which time written and oral evidence were presented. While signage may help, there is more that must be done to improve the safety for pedestrians. To facilitate this discussion, the Planning Board is requiring a traffic and pedestrian flow and safety plan to be submitted at your earliest convenience. This plan is being required in accordance with Town Code §280-128, which references the need for development to proceed with due regard to the public interest, including the construction and location of parking areas, whether or not accompanied by new building construction. In addition, Town Code.§280-129 requires the Planning Board to take public health, safety and welfare into consideration with respect to traffic and pedestrian access to roadways and interior circulation. The change in the parking area location for the hotel is a matter of public interest and public safety. In a meeting with the Planning and Building Departments in the past, when the idea of moving the parking for the hotel to the other side of the road was introduced, it was represented to us that all the parking would be valet and no guests would have to cross this busy street. In practice we have seen that many, if not all hotel guests are parking their own cars and crossing the street. We have witnessed guests climbing the berm and crossing at random locations (not in the crosswalks). We have received phone calls from the public with concerns about pedestrian safety here. Finally, the Town Transportation Commission and the Suffolk County Department of Public Works traffic Southold Town Planning Board Page 2 February 14, 2022 engineers have expressed concerns about pedestrian safety here, and the need for additional measures to be taken. The plan being required by the Planning Board should include the site as it exists today, on both sides of the road, and must include a description of how valet parking will function. Arrows indicating traffic flow, existing crosswalks, pedestrian paths and flow must also be included, as well as any proposed or existing exterior lighting intended to facilitate safety.
