AIgQ 1�IN "O .A�1ION: The subject residence currently exists with Certificates of Occupancy from•1960 (#Z5.55), and 2005 (#Z-30786). The current proposal to locate the accessory swimming pool and pool house was presented to the Board by the owner's architect at the public hearing, The agent noted that the proposed swimming pool location in the side yard is the best place,since cutting and filling of the hill located in the code conforming rear yard on this'very sloped property wtnuld create more land disturbance and drainage'problems. The applicarif's Page 2,February 20,2025 97983,Cambourakis SCTM No. 1000-22-1-4.1 architect/agent stated that the pool equipment will be placed under the existing deck,so as to mitigate noise from the equipment and that that evergreen screening will be planted for privacy from the street and adjacent properties. The adjacent neighbor and the neighbor across the street from the subject property both spoke about their concerns over possible runoff from the subject property onto the street and onto their properties caused by cutting trees and re-grading when installing the proposed inground pool,since:flooding is common in that area of Cedar Drive where many lots have very sloped topography. After listening to the explanation by the applicant's architect about his proposed on-site drainage solution,both neighbors were satisfied. _FIND ',—FOR RDARP ACTION. The Zoning Board of Appeals held a public hearing on this application on February 6,2025,at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. T n Law§g67-b(3).(1 I). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The existing house sits on the northern end of the site,and a rear yard location would require:massive cutting and filling,and the removal of trees. The side yard location would require the least amount of earth and tree removal. The placement of evergreen screening for privacy would also mitigate the side yard location. Due to these factors, this project will not produce an undesirable change to the character of the neighborhood. 2 awn Law§26",L-bDY_bJ(2_J._The benefit sought by the applicant cannot be achieved by some method, feasible 1 _ for the applicant to pursue,other than an area variance. There is a very large hill in the code required rear yard and locating an in-ground pool there would require massive land disturbance, tree removal and a large retaining wall which would exacerbate issues withonsite drainage and possible runoff into the street and other properties. Any other placement on the property other than the rear yard would require variance relief. 3. Town Law 267-b 3 (Iff3l. The variances granted herein are mathematically substantial. a) The proposed pool in the side yard would require 10011/o relief from the code. b) The proposed pool house in the side yard would require 1000%relief from the code. However,due to the contours of the site,and the hill in the rear of the property,the proposed location would be the least egregious of any location for a proposed accessory swimming pool,and pool house. The proposed location in the side yard would require the least amount of land clearing,cutting,and filling of the hill in the rear yard. it would also mitigate the need for massive retaining walls if the pool were placed in the required rear yard. 4. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the conditions imposed herein by this Board. Further, the applicant's architect submitted a well-designed and well-engineered plan for a stormwater retention system layout,and planting layout. 5. ][own Law 6267-b(3 b 5 . The difficulty has been self-created. The applicant purchased the parcel after the IffiLl Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of'purchase. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory swimming pool and pool house while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
