WEDGE request a Wetland Permit and a Coastal Erosion Permit to reinforce and enhance±250 linear feet of existing armor stone with new±1ft to 3.5' diameter stone (approx. 403 tons of new stone, finished stone <2.5 tons/linear foot, top elevation = 6.5' NAVD, seaward toe of finished stone to be located at, or landward of existing seaward toe); install±16 linear foot long westerly armor stone return; and restore, as needed existing ±20-ft. wide vegetated non- turf buffer along the landward side of the stone armor with Cape American beach grass (18" on-center). Located: 100 Harbor Road, Orient. SCTM# 1000-27-4-3.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with Policy 9 Provide for public access to, and recreational use of, coastal waters, public lands, and public resources of the Town of Southold of the LWRP. A. Provide free and substantially unobstructed passage along public trust shorelands. C. Where public access is substantially impeded, provide passage around interferences on public trust lands through adjacent upland easements or provide other mitigation. 1. The continuation of adding hardened structure along the foreshore decreases the ability of the public to access it. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. WEDGE 100 HARBOR ROAD ORIENT,NY SCTM#1000-27-4-3.1 POLICIES 4 & 6 The subject property and its shoreline along Orient Harbor have been protected from flooding and erosion by a combination of shore-parallel armor stone and/or shore-perpendicular stone groins since prior to 1977. During the past several years,however, the beach has narrowed and dropped in elevation;the naturally occurring gravel/shell beach sediment that covered much of the stone for many years has been disappearing; the upland at the west end of the property is eroding and receding landward with the adjacent unprotected shoreline to the west; and the increasingly exposed armor stone has been undermined during more frequent and severe storms, resulting in the seaward edge of the stone being pulled farther seaward onto the beach. Thus, for the purpose of restoring and maintaining the property's historically established means of erosion and flood protection, and stemming further upland erosion at the west end of the property,the applicant proposes to reinforce and enhance the existing armor stone by reconfiguring the existing stone, adding new larger stone, and installing a westerly return, all as depicted on the engineering plan prepared by RACE Coastal Engineering, dated December 20, 2024. Proposing to maintain and enhance the existing armor stone versus proposing a vertically faced bulkhead structure, for example, is consistent with New York State's recently adopted legislation encouraging use of more nature based solutions for stabilization of tidal shorelines;the construction and operation standards set forth for shoreline structures in Section 275-11(B)of the Southold Town Wetlands Code; Section 111- 15 of the Town's Coastal Erosion Hazard Area Code; and the objectives of Policy 4 of the Town's Local Waterfront Revitalization Program. Specifically,the finished structure will maintain a sloped face and will encroach no further seaward onto the beach than the existing structure to ensure that while it effectively stabilizes the natural protective feature, it does not cause a measurable increase in erosion at the site or adjacent properties. In fact,portions of the existing armor stone will be pulled landward of its current location on the beach. Given the significant fetch of Orient Harbor and the high storm energy potential associated with the property's location in the Coastal Erosion Hazard Area, which have already begun to alter the long term stability of the property's shoreline,the efficacy of the existing armor stone must be increased in some manner, and there are no vegetative or other non-structural solutions that could enhance or replace the stone and sufficiently protect the site from continued and increasingly severe erosion. Rather,the site cannot be protected over the long term without enhanced structural stabilization, and maintaining and enhancing the existing armor stone is the only design consistent with the above regulatory standards that can reasonably be expected to effectively achieve that goal. However, vegetative enhancement also remains part of the long-term protection plan, as the existing, approximately 20-foot wide buffer situated landward of the armor stone,which is currently vegetated with Cape American beach grass,will be restored as needed and permanently maintained. --SEE ATTACHED ADDENDUM-- Attach additional sheets if necessary Policy 7.
