SCTM# 1000-90-2-19 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is CONSISTENT with the LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. INSTRUCTIONS l, All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency: *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its si nib beneficial and adverse effects upon the coastal area (which includes all of Southold Town). See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable r LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR 920 CEDAR POINT LLC 920 CEDAR POINT DRIVE EAST SOUTHOLD,NY SCTM#1000-90-2-19 POLICIES 5& 6 The additions and renovations to the existing dwelling structure have been designed over/within or landward of the existing dwelling footprint;and the proposed swimming pool and surrounding raised patio are proposed landward of the seaward limit of the existing dwelling, thus avoiding any new encroachments on existing wetland setbacks. All of the proposed construction is compliant with Town zoning, including building height, sky plane, and GFA; and Town-defined lot coverage will increase only to 13 percent. And all construction would occur outside the flood zone (FEMA Zone X) and landward of the bulkhead and retaining wall that stabilize the embankment fronting Hog Neck Bay. Nevertheless, several mitigation measures are proposed to ensure compliance with the standards for permit issuance set forth in Section 275-12 of the Town Code and consistency with the goals of LWRP Policies 5 and 6,particularly the protection of water quality and the quality and function of the surrounding Hog Neck Bay beach and tidal wetland ecosystem. 1) The existing conventional, nonconforming septic system, which is located less than 60 feet from mean high water, would be removed and replaced with a low-nitrogen, I/A sanitary system located at least 100 feet from mean high water, thus creating an immediate potential improvement to the quality of groundwater and surface waters. 2) A proposed stormwater drainage system is designed to capture and recharge runoff from the proposed dwelling additions and patio; and a separate, dedicated drywell is proposed to contain pool backwash. 3) Except for the footprint of the previously permitted deck adjacent to the bulkhead, the entire area between the bulkhead and top of bank is proposed to be permanently maintained as a vegetated non-turf buffer. 4) An additional 5-foot wide non-turf buffer is proposed to be established and permanently maintained in place of existing lawn landward of the top of bank. 5) A project limiting fence would be installed to contain site disturbance and potential surface runoff during construction.
