The proposed pool in the side yard will be mitigated from street view and placed as far back as possible in relation to the dwelling 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance,because: The previously permitted flat roof is already at the 25' height with previously approved clerestory above that. Approvals extending above the allowable 25' height were granted prior to the code of 25' maximum height for flat roofs going into affect. The proposed pool in the side yard is the most feasible location on the property without encroaching towards the Wetlands or requiring more clearing of the natural wooded area. 3. The amount of relief requested is not substantial because: The amount of relief requested is not substantial because the size of the roof deck above the 25'height is less than the previous permitted roof deck above the 25' height#48463 (dated 11/07/2022)and will not contain any permanent fixtures besides the required railings. 4.
