The proposed footprint would maintain the existing rear yard setback of 41.6 feet where 50 feet is required under Town Code. The subject parcel is a non-conforming 37,561 SF lot in the R-40 zoning district located on New Suffolk Avenue in Cutchogue. The parcel is the northernmost parcel of 3 lots created by Martha Leibell and Herbert Henry in 1973 pursuant to variance relief obtained in ZBA #1784. The two parcels to the south are also improved with single family residences. In addition to rebuilding the residence, the Applicants intend to upgrade the sanitary system to a modern low-nitrogen system. For the following reasons, the Applicants submit that a variance from the rear yard setback requirements is warranted. I. An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: The existing home on this parcel is centrally located and, with the exception of the rear yard setback, is otherwise conforming to the bulk schedule. The house to the south is located farther south on that parcel and, as such, the granting of variance relief to permit the reconstruction of this home nearly 42' from the rear property line will not be a detriment to nearby properties and will result in an aesthetically pleasing home that is consistent with the character of other homes in the neighborhood. 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: Due to the pre-existing non-conforming rear yard setback, there is no way the Applicants can accomplish the proposed renovation within the existing footprint to minimize ground disturbance without variance relief. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: As stated previously, the existing rear yard setback is pre-existing nonconforming to the current requirements, and the degree of non-conformity is not being increased. Granting of variance relief will not have an adverse impact on the physical conditions in the neighborhood and, as a Type II action, there is no perceivable environmental impact stemming from the proposed renovation. In addition, the Applicants will be upgrading to an I/A low-nitrogen sanitary system, resulting in a net environmental benefit from this project. 5. Has the alleged difficulty been self-created? {) Yes, or(X) No Why: Previous owners built the existing residence in a location which is now non-conforming to modern zoning code, and the Applicants seek to only maintain this setback as they rebuild the structure. To any extent that the difficulty be deemed self-created, pursuant to New York Town Law §267-13 (3), a self-created hardship "shall not necessarily preclude the granting of an area variance."
