TERMS AND CONDITIONS
The Permittee ANDREW GROVER& DANIEL MAZZARINI, 90 The Strand, East Marion,
New York as part of the consideration,for the issuance of the Permit does understand and
prescribe to the following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
2. That this Permit is valid for a period of 36 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized,or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation,the said Permittee will be
required, upon due notice,to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. That the said Board will be notified by the Permittee of the completion of the work
authorized.
9. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.
10. No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others
in order to perform the permitted work nor does it authorize the impairment of any rights,
title, or interest in real or personal property held or vested in a person not a party to the
permit.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, September 17, 2025 regarding the above matter:
.WHEREAS, Taplow Consulting, Ltd. on behalf of ANDREW GROVER &'DANIEL MAZZARINI
applied to the Southold Town Trustees for a.permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated June
18, 2025, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be found
Consistent with the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
September 17, 2025, at which time all interested persons were given an opportunity to be
heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the proposal complies with the standards set forth in Chapter 275 of the Southold
Town Code,

WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent with the
Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees APPROVE the application of ANDREW GROVER &
DANIEL MAZZARINI to construct a new 16'x32' in-ground pool with a one (1) foot surround
(512sq.ft.); install pool enclosure fencing with gates, a pool drywell, and a-pool equipment area;
' and to establish and perpetually maintain a 30' wide vegetated non-turf buffer area along the
landward edge of the top of the bluff using native vegetation, with a 4' wide access path to bluff
stairs; all as depicted on the site plan prepared by Heidecker Land Surveying, received on
September 15, 2025, and stamped approved on September 17, 2025.
Permit to construct and complete project will expire three years from the date the permit is� .
signed. Fees must be paid, if applicable, and permit issued within six months of the date of this
notification.

Good Morning,
I was able to get three LWRP reports from ZBA's files, however, I have a couple of questions on whether some can be
used. All are attached to assist.
For the Estate of Thomas Eiring application, it appears to be for the exact same project (new house on vacant lot) with
the ZBA review except the Trustees added buffers. The LWRP is from September 2020. Given its age can we still use
it? The ZBA determination is still open and valid.
For the MDC Trust LWRP report was issued December 2024,the LWRP reviewed side yard and bluff set backs and to
construct additions and alterations. I am hoping the Trustees could use this for tomorrow's meeting?
Last is Grover/Mazzarini. I attached both the Trustees and ZBA's old LWRP report. Both were from a previous
application where the applicant proposed to demolish and construct a new dwelling along with a proposed new
pool. The current application is only for the pool,the owners are no longer doing any work to the existing house. The
proposed pool matches the previously approved pool from 2021.The 2021 Trustee LWRP report was Consistent for new
house/pool but the ZBA LWRP report was Inconsistent for same. Because these were pulled out of old applications that
were for a house and a pool, could we even use them?

The Zoning Board of Appeals issued a determination for the action with conditions on August
19, 2021. A 30' wide non-disturbance, landscaped buffer is required.
Michael Kimack on behalf of ANDREW GROVER & DANIEL MAZZARINI requests a Wetland
Permit to demolish existing dwelling and reconstruct a new single family dwelling (1,456.58
sq.ft.), new foundation for proposed addition (654 SF), addition to first floor bedroom (31.9
sq.ft.), new second floor (1,365 sq.ft.), new decks (784 sq.ft.), new covered porch (342 sq.ft.);
new 16' x 32' in-ground pool with one (1) foot surround (512 sq.ft.), with pool enclosure fencing
and pool dryweii; proposed gutters and leaders to drywells; and new I/A OWTS septic system;
proposed new dwelling footprint will be 2,484.48 sq.ft. Located: 90 The Strand, East Marion.

Note that the buffer shown on the survey dated September 29, 2021 is mislabeled as a
non-turf buffer.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is CONSISTENT with the LWRP policies and therefore CONSISTENT
with the LWRP.
The Zoning Board of Appeals decision approved the pool less than 100'from the top-of-bluff
and therefore complied with the 1975 Covenant and Restrictions (Liber 7969 Page 274).
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

Note that a 1975 filed Covenant and Restriction(Liber 7969 page 274)placed on the lot within the
subdivision known as Pebble Beach Farms prohibits the construction of any part of a dwelling northerly of an
approximate 100 foot bluff set back line unless approved by the Town of Southold. The text of the clause is
included below.

A. Minimize potential loss and damage by locating development and structures away from_ flooding and
erosion hazards.
Both Chapter 275 Wetlands and Shorelines and Chapter 280 Zoning of the Southold Town Code requires
a 100' setback from a pool and related structures to a bluff system. The intent of the setback is to
minimize impacts on the natural protective feature and protect structures from damage and loss due to
storms and erosion over time.
In the event the action is approved, a 30' wide landscaped buffer landward from the top of bluff is recommended.
The proposed side yard setbacks are EXEMPT from LWRP Coastal Consistency Review.
Pursuant to Chapter 268,the Southold Town Zoning Board of Appeals shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

Project Description for Grover & Mazzarino Pool Construction
The Trustee's issued permit# 10020 on October 20, 2021 to:
1) Construct a new in-ground swimming pool
2) Demolish and rebuild an existing, single family home
3) Install a new I/A septic system
After receiving the permit, the owners determined that the costs of demolishing and
constructing a new home exceeded their budget. So the existing home was renovated/updated
with only a new screened porch and a new pool being constructed. A new application was
made to the Trustees for the screened porch, and was granted. The pool, however, was
constructed under permit# 10020.
The language issued by the Trustees in permit# 10020 should be copied and repeated in the
new replacement permit that only addresses the new pool without the new home and new
septic system language; to wit:
"Wetland permit to (home demo and rebuild deleted) construct a new 16'x 32' in-ground pool
with (1)foot surround (512 sq-ft)with pool enclosure fencing and pool drywell (new I/A OWTS
septic system deleted) with the condition to establish and perpetually maintain a 30'wide
non-disturbance buffer landward of the top of the bluff; and as depicted on the survey
prepared by Peconic Surveyors P.C., last dated October 18, 2021, and stamped approved on
October 20, 2021:'
It should also be noted that the property owners were also issued another Trustee permit to re-
build a rock revetment at the base of the steep slope that fronts along Long Island Sound. This
permit required that a covenant be filed to "establish and maintain a vegetated 15' wide "non-
turf buffer" inclusive of the berm (with no substitution of sand or stone) at the top of bluff."
This covenant conflicts with the new house/new pool covenant contained in permit# 10020.
Both Elizabeth and Tom in the Trustee's office were made aware of this conflict, and they
advised that no covenants be filed until the matter can be sorted-out. So the Trustees will have
to decide which covenant should be applied to the property so it can be properly filed. Given
that a new home was not constructed and only a new screened porch built that is only slightly
larger than an existing patio it replaced, the owners believe that the 15 foot buffer is the
appropriate covenant. This will conform to all the other adjacent properties on The Strand. If
the Trustees agree, then the new covenant language on the pool permit would be as follows:
"Wetland permit to construct a new 16'x 32' in-ground pool with (1) foot surround (512 sq-ft)
with pool enclosure fencing and pool drywell with the condition to establish and maintain a
vegetated 15'wide "non-turf buffer inclusive of the berm (with no substitution of sand or
