Mr. Martell is applying to replace the bulkhead in front of his house along the entrance to Schoolhouse Creek.A portion of the present bulkhead is located within the underwater lands associated with our property. We support Mr. Marteli's proposed project and give permission for the project to include the in place replacement of the existing functional, but failing bulkhead which is partially located on our parcel. Because the majority of the proposed work is being performed on someone else's property an original signed/notarized authorization letter from the underwater land owner(s) must be submitted stating that they have been shown the proposed work and are allowing the Martell's to perform all of the proposed work. Also,as I cannot find a permit under multiple tax map numbers,Schultheis or Tuthill for the floating dock. The only thing I found was a file named Tuthill, Lawrence (3) in which nothing in the file illudes to any public hearing/resolution for anyone to install the dock. I have to say that at this time this entire dock(deck on bulkhead to float) is unpermitted which would then be required to be added to this application so that it can be permitted along with all dimensions added to the plan, and comments about the dock in the letter from the underwater land owner. If by chance you/the property owner have documentation of said floating dock,you would still need the underwater land owner's permission to temporarily remove/replace but you can submit a copy of what you found for the record. Another question that needs to have the site plan updated. What type of wood is proposed for the 110' long walkway? The type of wood needs to be called-out(cca/IPE/untreated/etc.). The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposal is CONSISTENT with the LWRP as follows: Policy 10.5 B. 3. Maintain existing and, where necessary for water dependent uses, construct new shoreline stabilization and engineering structures such as piers, wharves, jetties and bulkheads. The project is consistent with overall Policy 10 which is to protect Southold's water- dependent uses, and the sub-policy listed above. This project is to remove and replace a failing bulkhead & jetty that protects active marina uses. Consider reducing the length of the proposed 100' boardwalk on the bulkhead. It should be as short as practical, and should not extend into Flood Zone V, where it would be more likely to be destroyed by wave action in a storm.
