SCTM# 1000-115- 12-13 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposal is INCONSISTENT with the LWRP. This proposal is inconsistent with Policy 4, and in particular the following: Policy Standard 4.1 Minimize losses of human life and structures from flooding and erosion hazards. The installation of a timber retaining wall on the property line creates an open unvegetated length of exposed soil on the neighboring property vulnerable to erosion, with potential to erode into the adjacent tidal wetlands. To minimize the erosion hazard and thus be consistent with the LWRP, the wall would ideally be situated far enough away from the property line to have room to revegetate on both sides with native species. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. 2 r�. The work stopped on the landscape wall when directed to stop. The completed wall will include a landscape bed matching the native vegetation used in the front yard. On the survey you will notice that there is an underground drainage pipe which crosses this and the neighbor's property. The underground pipe drains the road runoff from Deep Hole Drive directly into the Creek. There is no recorded easement for the drainage pipe. I spoke with Michael Collins, Town Engineer, on June 24, 2025 to be sure that the landscape wall does not interfere with the Town's underground drainage pipe. Michael Collins said the landscape wall does not impact or interfere with the Town's buried drainage pipe and the drainage on Deep Hole Drive will be changed in the near future. The pipe which drains directly into the creek will no longer be needed(obsolete). When alternative drainage for the road is designed and built by the Town this pipe will be capped by the Town(cut at outflow end) and the pipe can remain and deteriorate over time.
