Approximately 227 cubic yards of earthen fill material will be sourced from proposed on- site construction of a new home proposed to be located more than 100' from the top of bluff, to create a more level rear yard by raising (max. 4ft.) or lowering (max. 2ft.) existing grade elevations. Also proposed is a 50-foot-wide non-disturbance buffer along the landward edge of the top crest of the bluff, and a 25-foot-wide non-turf buffer area between the 50-foot and 75-foot setbacks. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposal is INCONSISTENT, based on the following: Policy 6.1 A. Avoid adverse changes to the Long Island Sound and Peconic Bay ecosystems that would result from impairment of ecological quality, as indicated by item 1. Physical loss of ecological components, including the clearing of upland forest. This parcel is currently undeveloped and wooded. The clearing and grading within 100' of the top of bluff is proposed for a use that is not water-dependent (having a level back yard). This is inconsistent with this policy to avoid physical loss of woodlands when possible. The parcel has sufficient depth to avoid having to do any clearing within 100' of the top of bluff, and still have room for a back yard. Policy 4.1 A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 1. Avoid development other than water dependent uses and coastal hazard areas. Locate new development which is not water dependent as far away from coastal hazard areas as practical. The proposal is not a water-dependent use, and should be located as far away from the top of bluff and coastal hazard area as practical. This parcel is currently undeveloped, providing the opportunity to be consistent with this policy by moving the house farther away from the top of bluff, thus allowing for a rear yard that could be cleared and graded without impacting the woodlands that will be stabilizing the bluff for years to come. The R-40 zoning district allows for a front yard setback of as little as 50'. Currently the house is proposed to be set back from the front at 109'. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
