Dear Mr. Goldsmith:
Pursuant to our discussions during the public hearing held on the captioned application on
September 17, 2025,please find enclosed three (3) copies of a survey/site plan prepared by
Nathan Taft Corwin III Land Surveyor, last dated September 30, 2025, which has been revised as
follows:
1) Addition of a proposed 10-ft wide vegetated non-turf buffer adjacent to the landward
side of the existing 30-foot wide non-disturbance buffer;
2) Relocation of the proposed pool equipment farther from the neighboring dwelling to
the northwest and close to the landward corner of the proposed pool; and
3) An amended notation that six (6)rather than three hardwood trees are to be planted
within the non-disturbance buffer.
Although I trust you will find the site plan revisions consistent with our discussions, please let
me know if the Board has any questions or additional requirements.

NATURAL RESOURCE PERMIT CONDITIONS - Apply to the Following
Permits: TIDAL WETLANDS
1. Regulated Activities Authorized By This Permit This permit authorizes only those regulated
activities/structures identified under the section "Authorized Activity". DEC does not issue after-the-
fact or as-built permits. This permit does not authorize activities, or legitimize the existence of
structures, which would have required a permit but for which no pen-nit or other authorization has been
,ranted DEC.
2. Notice of Commencement At least 48 hours prior to commencement of the project, the permittee
and contractor shall sign and return the top portion of the enclosed notification fora certifying that they
are filly aware of and understand all teens and conditions of this permit. Within 30 days of completion
of project, the bottom portion of the form must also be signed and returned, along with photographs of
the completed work.
3. Post Permit Sign The pennit sign enclosed with this permit shall be posted in a conspicuous
location on the worksite and adequately protected from the weather.
4. Failure to Meet Permit Conditions Failure of the permittee to meet all the conditions of this permit
is a violation of this pen-nit and grounds for an order to immediately cease the pennitted activity at the
project site.
5. Accessory Structures Must Be At Least 75 Feet Landward Of The Wetland Boundary This
permit authorizes the construction of new accessory structures located in the adjacent area at the
prescribed minimum setback only. Structures located in tidal wetlands, or structures (except fence) in the
adjacent area but located less than 75 feet from the wetland boundary, are not authorized.
6. Conformance With Plans All activities authorized by this permit must be in strict conformance
with the approved plans submitted by the applicant or applicant's agent as part of the permit application.

7. Straw Bales or Other at Tidal Wetland A row of staked straw bales or approvable erosion control
devices shall be placed at the landward edge of the buffer area as per the NYSDEC-approved plan. prior
to commencement of any regulated activities and remain in place and in <good. functional condition until
the project is completed and all disturbed areas are stabilized with vegetation.
8. Storage of Equipment, Materials The storage of construction equipment and materials shall be
confined within the project work area and/or upland 'areas (Treater than 50 linear feet from the tidal
wetland boundary. 5
9. Area of Disturbance for Structures Disturbance to the natural vegetation or topography greater
than 25 feet seaward of the approved structure is prohibited.
10. Contain Exposed, Stockpiled Soils All disturbed areas where soil will be temporarily exposed or
stockpiled for longer than 48 hours shall be contained by a continuous line of staked haybales/silt
curtains (or other NYSDEC approved devices) placed on the seaward side between the till and the
wetland or protected buffer area. Tarps are authorized to supplement these approved methods.
11. Concrete Leachate During construction; no wet or fresh concrete or leachate shall be allowed to
escape into any wetlands or waters of New York State; nor shall washings from ready-mixed concrete
trucks, mixers, or other devices be allowed to enter any wetland or waters. Only watertight or
waterproof forms shall be used. Wet concrete shall not be poured to displace water within the forms.
12. No Pool Discharges to Wetland There shall be no draining of swimmin, pool water directly or
indirectly into wetlands or protected buffer areas.
13. No DnNvells in or near Wetland Dry wells for pool filter backwash shall be located a minimum
of 100 linear feet landward of the tidal wetland boundary.
14. Vegetate All Disturbed Areas The permittee shall revevetate all exposed faces and disturbed areas
to prevent soil erosion prior to the project completion or expiration date of this permit, whichever comes
first.
15. Clean Fill Only All fill shall consist of clean sand, gravel, or soil (not asphalt, slag, flyash. broken
concrete or demolition debris).
16. No Disturbance to Vegetated Tidal Wetlands There shall be no disturbance to vegetated tidal
wetlands or protected buffer areas as a result of the permitted activities.
17. No Construction Debris in Wetland or Adjacent Area Any debris or excess material from
construction of this project shall be completely removed from the adjacent area (upland) and removed to
an approved upland area for disposal. No debris is permitted in wetlands and/or protected butter areas.
18. Precautions Against Contamination of Waters All necessary precautions shall be taken to
preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents,
lubricants. epoxy coatings, paints. concrete, leachate or anv other envirommentally deleterious materials
associated with the project.

19. State May Require Site Restoration If upon the expiration or revocation of this permit, the
project hereby authorized has not been completed, the applicant shall, without expense to the State, and
to such extent and in such time and manner as the Department of Environmental Conservation may
lawfully require, remove all or any portion of the uncompleted structure or till and restore the site to its
former condition. No claim shall be made against the State of New York on account of any such
removal or alteration.
20. State May Order Removal or Alteration of Work If future operations by the State of New York
require an alteration in the position of the structure or work herein authorized, or if, in the opinion of the
Department of Environmental Conservation it shall cause unreasonable obstruction to the free navigation
of said waters or flood flows or endanger the health, safety or welfare of the people of the State, or cause
loss or destruction of the natural resources of the State, the owner may be ordered by the Department to
remove or alter the structural work, obstructions, or hazards caused thereby without expense to the State,
and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other
modification of the watercourse hereby authorized shall not be completed, the owners, shall, without
expense to the State, and to such extent and in such time and manner as the Department of
Environmental Conservation may require, remove all or any portion of the uncompleted structure or till
and restore to its former condition the navigable and flood capacity of the watercourse. No claim shall
be made against the State of New York on account of any such removal or alteration.
21. State Not Liable for Damage The State of New York shall in no case be liable for any damage or
injury to the structure or work herein authorized which may be caused by or result from future operations
undertaken by the State for the conservation or improvement of navigation, or for other purposes, and no
claim or right to compensation shall accrue from any such damage.
GENERAL CONDITIONS - Apply to ALL Authorized Permits:
1. Facility Inspection by The Department The permitted site or facility, including relevant records, is
subject to inspection at reasonable hours and intervals by an authorized representative of the Department
of Environmental Conservation (the Department) to determine whether the permittee is complying with
this permit and the ECL. Such representative may order the work suspended pursuant to ECL 71- 0301
and SAPA 4010)).
The permittee shall provide a person to accompany the Department's representative during an inspection
to the permit area when requested by the Department.
A copy of this permit, including all referenced maps. drawings and special conditions, must be available
for inspection by the Department at all times at the project site or facility. Failure to produce a copy of
the permit upon request by a Department representative is a violation of this permit.
2. Relationship of this Permit to Other Department Orders and Determinations Unless expressly
provided for by the Department, issuance of this permit does not modify, supersede or rescind any order
or determination previously issued by the Department or any of the terms, conditions or requirements
contained in such order or determination.

3. Applications For Permit Renewals, Modifications or Transfers The permittee must Submit a
separate written application to the Department for permit renewal, modification or transfer of this
permit. Such application must include any forms or supplemental information the Department requires.
Any renewal. modification or transfer granted by the Department must be in writing. Submission of
applications for permit renewal, modification or transfer are to be submitted to:

4. Submission of Renewal Application The pertnittee must submit a renewal application at least 30
days before permit expiration for the following permit authorizations: Tidal Wetlands.
5. Permit Modifications, Suspensions and Revocations by the Department The Department
reserves the right to exercise all available authority to modify, Suspend or revoke this permit. The
;rounds for modification, suspension or revocation include:
a. materially false or inaccurate statements in the permit application or supporting papers.-
b. failure by the permittee to comply with any terms or conditions of the permit;
c. exceeding,the scope of the project as described in the permit application.
d. newly discovered material infonnation or a material change in environmental conditions, relevant
technology or applicable law or regulations since the issuance of the existing permit;
e. noncompliance with previously issued permit conditions, orders of the commissioner, any
provisions of the Environmental Conservation Law or regulations of the Department related to
the permitted activity.
6. Permit Transfer Permits are transferrable unless specifically prohibited by statute, regulation or
another permit condition. Applications for permit transfer should be Submitted prior to actual transfer of
ownership.

The pennittee, excepting state or federal agencies, expressly agrees to indemnify and hold harmless the
Department of Environmental Conservation of the State of New York, its representatives, employees,
and agents ("DEC") for all claims, suits, actions, and damages, to the extent attributable to the
permittee's acts or omissions in connection with the permittee's undertaking of activities in connection
with, or operation and maintenance of. the facility or facilities authorized by the permit whether in
compliance or not in compliance with the terms and conditions of the permit. This indemnification does
not extend to any claims, suits, actions, or damages to the extent attributable to DEC's own negligent or
intentional acts or omissions, or to any claims, suits, or actions naming the DEC and arising under
Article 78 of the New York Civil Practice Laws and Rules or any citizen suit or civil rights provision
tinder federal or state laws.

The pennittee is responsible for informing its independent contractors,employees, agents and assigns of
their responsibility to comply with this permit, including all special conditions while acting as the
permittee's agent with respect to the permitted activities, and such persons shall be subject to the same
sanctions for violations of the Environmental Conservation Law as those prescribed for the pennittee.
Item C: Permittee Responsible for Obtaining Other Required Permits
The pennittee is responsible for obtaining any other permits. approvals, lands, easements and rights-of-
way that may be required to carry out the activities that are authorized by this permit.
Item D: No Right to Trespass or Interfere with Riparian Rights
This permit does not convey to the pennittee any right to trespass upon the lands or interfere with the
riparian rights of others in order to perform the permitted work nor does it authorize the impainnent of

Please be advised that DEC has documented the summer occurrence of the ,

Northern Long Eared Bat (NLEB) (Myotis septentrionalls), a species listed r;:
as "endangered" by both New York State and the US Fish & Wildlife
Service, within 3 miles of your property.
Northern long-eared bats (NLEB) are primarily forest-dependent insectivores. Bats
consume approximately 3,000 insects per day, including mosquitos and crop pests. They use a variety of
forest habitats for roosting, foraging, and raising young. In general, any tree large enough to have a
cavity or that has loose bark may be used by the bats for roosting or rearing young.The dramatic
population decline has been caused by white-nose syndrome; a disease caused by an invasive fungus
that ultimately causes hibernating bats to starve to death over the winter. A 98% decline in the
abundance of NLEB has been observed since 2006.
DEC has determined that tree cutting at your property between March 1 and November 30 of any
calendar year may impact the bats in your area and may result in the direct killing or injury of individual
members of this protected species, interference with critical breeding, foraging, migratory or other
essential behaviors, or adverse modification of the species' habitat (these activities are defined as a
"take" by the Environmental Conservation Law). The "take" of a species listed as endangered or
threatened is prohibited in the absence of an incidental "take" permit. An incidental Take permit is
subject to additional Department review and approval and must establish a Net Conservation Benefit to
the species which will contribute to its recovery in New York State.
To avoid the possibility of an Endangered Species "take", no tree cutting activities,
except for removal of hazardous trees presenting an immediate threat to human life or
property, may be conducted at your project site between the dates of March 1 and
November 30 of any calendar year.
Depending on site conditions, an individual tree or very small trees may be cut at any time of the year
without resulting in a "take" of endangered /threatened species or their habitat. Regardless of time of
year, any proposal for large-scale tree clearing (10 acres or more) will require coordination with the DEC
and US Fish and Wildlife Service. If you have questions about the presence of protected species on or
near your property,the potential effects of activities on these species, your responsibilities as a
landowner or project sponsor under the Endangered Species Regulations, or the need for an incidental
take permit, please contact the Regional Wildlife Manager at(631) 444-0310.

DECLARATION AND COVENANT`
SOUTHOLD TOWN PLANNING BOARD
THIS DECLARATION made the 141h day of November, 2011 by Joseph
Battaglia and Heidi Battaglia, residing at 28 Wilton Road, Cold Spring Harbor NY 11724,
hereinafter collectively referred to as the Declarant, states as follows:
WHEREAS, Declarant is the owner of certain real property situate at Hobart
Road, in the Town of Southold, Suffolk County, New York, more particularly bounded
and described as set forth in Schedule A annexed hereto; and
WHEREAS, for and in consideration of the granting of subdivision application
entitled, "Standard Subdivision of Joseph and Heidi Battaglia" prepared by Nathan Taft
Corwin, III, Land Surveyors, dated August 1, 2011 (hereinafter"Filed Map") and as a
condition of granting said approval, the Town of Southold Planning Board has required that
the within Declaration be recorded in the Suffolk County Clerk's Office; and
WHEREAS, Declarant has considered the foregoing and determined that same
will be in the best interest of the Declarant and subsequent owners of said parcel;
NOW, THEREFORE, THIS DECLARANT WITNESSETH:
1. That Declarant, for the purpose of carrying out the intentions above expressed
does hereby make known, admit, publish, covenant and agree that the said premises
herein described shall hereafter be subject to the following covenants which shall run
with the land and shall be binding upon all purchasers and holders of said premises,
their heirs, executors, legal representatives, distributees, successors and assigns, to
wit:
(a)Thirty (30)foot non-disturbance, non-fertilization buffer landward of the edge
of the wetlands as shown on the Filed Map. The 30 foot buffer shall remain undisturbed
in perpetuity except for permitted activities. Permitted activities within the buffers are
limited to the removal of known exotic invasive weeds and invasive vines, removal of
dead and/or diseased trees that are hazardous to life or property and the buffer may be
supplemented with plantings of native and drought tolerant species and a 4'access path
to Town Creek on lot 2, subject to Board of Trustee approval.
(b) Trees that are greater than 18 inches in diameter at breast height are shown
on the Approved Final Plat map and shall be preserved in perpetuity. Maintenance of
said trees is permitted and shall include pruning and removal of dead and/or diseased
trees that are hazardous to life or property and may be replaced.
( c) The Planning Board is requiring the replacement a, .,rd tree by June, 2012.
The tree located immediately north of the driveway on lot 2 shall be replaced with a
minimum 4" caliper'street' tree selected from the Southold Town Planning Board Native
Tree List. The tree was approved to be removed due to the poor health and condition of
the tree.
This tree together with the vegetation located within the natural/landscaped
buffer satisfies section 240,17. Technical requirements. Item H,2(n) and section 161-
44.Street Tree Requirements of the Town Code. The planted tree shall be guaranteed
to survive for a three year period from planting date. In the event that the planted tree
dies within the three year period, the tree shall be replaced with a minimum of 4"caliper
tree of similar species. A letter shall be provided to the Planning Board indicating the
planting date, species and size of the tree
(d ) Pursuant to chapter 240-49 Clearing of the Southold Town Code, clearing
limits on lot 1 and lot 2 are restricted to 50% of the total lot area. Clearing limits shall be
clearly staked and approved by a New York State licensed engineer or surveyor prior to
any new clearing or grading of the lots. All planted vegetation installed within the clearing
limits as established by the Planning Board on the approved Filed Map shall be
guaranteed to survive for a period of three years from final acceptance of the planted
vegetation by the Planning Board. In the event that any of the planted vegetation dies, the
landowner shall replace such vegetation at their expense.
(e)The driveway on Lot 1 shall be constructed of pervious material or if non-
pervious material is used, drainage shall be provided which complies with Chapter 236,
"Stormwater Management of the Southold Town Code and the construction of the
driveway to lot 1 shall be excluded from the buffer conditions outlined herein.
(f)There shall be no further subdivision of lot 1 and Lot 2 in perpetuity.
(g) Except for the driveway to Lot 1, a 20'wide natural/landscaped buffer running
along the property boundary described as S. 26 degrees 25 minutes 00 seconds E for a
distance of 282.61 then S. 43 degrees 14 minutes 50 seconds E. for a distance of
156.80 feet shall be established. The 20' natural/landscaped buffer is established in
perpetuity. The current and all subsequent landowners of lots 1 and 2 shall be
responsible for maintenance of the perpetual 20' natural/landscaped buffer area. All
planted vegetation within this area shall be guaranteed to survive a period of three
years. In the event that any of the planted vegetation dies, the landowner shall replace

such vegetation at their expense. Any changes to trees and shrubs require Planning
Board approval.
(h)As to Lot 1, prior to issuance of a Certificate of Occupancy the following
landscaping will be planted and maintained in perpetuity:
(1)the 20'wide natural/landscape buffer running along.Hobart Avenue will be
planted with such plant species, density and size as was planted on Lot 2 along Hobart
Avenue.
(2) along the northern boundary of lot 1 a row of 6-T tall white pines, T-8'on
center will be planted to achieve winter screening.
(1) Pursuant to a recorded "Grant of Drainage Easement", there shall be
established a 50'wide X 145.18' long drainage easement running along the property
boundary described as S 35 degrees 05 minutes 00 seconds W and as illustrated on
the Filed Map
0)The use of synthetic herbicides, pesticides and/or fertilizers capable of
entering surface or ground waters is prohibited on Lots 1 and 2
(k)All utility connections shall be constructed underground
(1) If applicable, prior to construction activity on any of the lots within the
subdivision, the project may require a General Permit for storm water run-off from
construction activity administered by the New York State Department of Environmental
Conservation Under Phase II State Pollutant Discharge Elimination System or a
drainage approved under Chapter 236
• (m) Concrete property boundary monuments shall be required. Monuments shall
be set on the inside corners of outside boundaries of the land subdivided at each point
where there is a change of alignment . Except.where the boundary is a watercourse, the
monuments shall be offset in the line of adjacent traverse.
2. Declarant grants the continuing right in perpetuity to the Town of Southold,
any of its designated representatives or any owner of property within the subdivision to
enforce the conditions and restrictions of the covenants and to take any legal action it
deems necessary to enforce the conditions and restrictions of the covenants. These
rights of inspection and enforcement shall be binding upon declarant, their heirs,
executors, legal representatives, distributees, successors, assigns and transferees.

3. These covenants and restrictions shall run with the land and shall be binding
upon the Declarant, his successors and assigns, and upon all persons or entities
claiming under them, and may be terminated, revoked or amended by the owner of the
property only with the written consent of the Town of Southold Planning Board granted
by a majority vote plus one following a public hearing.
4. If any section, subsection, paragraph, clause, phrase or provision of these
covenants and restrictions shall, by a Court of competent jurisdiction, be adjudged
illegal, unlawful, invalid or held to be unconstitutional, the same shall not affect the
validity of these covenants as a whole or any other part or provision hereof other than
the part so adjudged to be illegal, unlawful, Invalid, or unconstitutional.
5. The aforementioned restrictive covenants are intended for the benefit of and
shall be enforceable by the Town of Southold, State of New York, by injunctive relief or
by any other remedy in equity or law. The failure of said agencies of the Town of
Southold to enforce same shalt not be deemed to affect the validity of this covenant nor
to impose any liability whatsoever upon the Town of Southold or any officer or employee
thereof.
6. The within Declaration is made subject to the provisions of all laws required
by law or by their provisions to be incorporated made a part hereof, as though fully set
forth herein. That the within Declaration shall run with the land and shall be binding
upon the Declarant and his successors and assigns and upon all persons or entities
claiming under them, and may not be annulled, waived, changed, modified, terminated,
revoked or amended by subsequent owners of the property unless and until approved
by a majority plus one vote of the Planning Board of the town of Southold or its
successors, after a public hearing.

This application is to construct a 16'x32' in-ground swimming pool and a 506sq.ft.
grade-level masonry pool patio; install 4' high pool enclosure fencing, a pool equipment
area, and to connect to an existing drywell for pool backwash.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency
Review of the Town of Southold Town Code and the Local Waterfront Revitalization
Program (LWRP) Policy Standards. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records
available to me, it is my recommendation that the proposal is CONSISTENT with the
LWRP as follows:
Policy 4.1. A. Minimize potential loss and damage by locating development and
structures away from flooding and erosion hazards.
The proposed pool is located as far from the Special Flood Hazard Area as practical.
There is a pool drywell proposed, and an existing 30' non-disturbance buffer that is
required to remain by Planning Board covenant on a filed subdivision map, both of
which help make the project consistent with Policies 5 and 6 by helping to protect water
quality and protecting coastal habitat.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

The proposed swimming pool and associated patio would be located partially within Chapter 275 jurisdiction,with the
swimming pool located a minimum distance of 76 feet from the wetlands boundary associated with Town Creek,and the
patio located farther landward. Both structures would thus well exceed the minimum 50-foot wetlands setback required for
pools and related structures pursuant to Section 275-3(D)(1)(a)(5)of the Town Code.The patio would be constructed at
grade level,and the pool would be constructed in-ground but elevated above the groundwater table.A pool drywell and
pool equipment would be installed more than 100 feet from wetlands and thus outside Chapter 275 jurisdcition;and a
project-limiting silt fence would be installed between the work area and wetlands to control and contain site disturbance
and potential runoff during construction.And the existing covenanted 30-foot wide non-disturbance/non-fertilization
would be maintained adjacent to the wetlands boundary,continuing to provide a sink an filter for stormwater runoff and
any chemicals potentially contained therein.Therefore,the project would protect groundwater and would not result in the
physical loss,degradation,or functional loss of ecological components or otherwise adversely impact the adjacent tidal
wetlands or surface waters of Town Creek,consistent with the Chapter 275 standards for issuance of a wetlands permit
and with the goals of LWRP Policies 5 and 6.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
l, All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its'si ni�ant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained, in detail, listing both supporting and non-

The proposed pool would be located a minimum distance of 76 feet from wetlands and the patio located farther Ian ward,both exceeding the required 50-foot wetland
setback for pools and related structures pursuant to Town Code Section 275-3(D)(1)(a)(5).The patio would be constructed at grade level,and the pool would be
constructed in-ground but elevated above the water table.A pool drywell and pool equipment would be installed more than 100 feet from wetlands;a project-limiting silt
fence would be installed to control and contain site disturbance and potential runoff during construction;and the existing covenanted 30-foot wide non-disturbance buffer
would be maintained adjacent to the wetlands boundary,continuing to provide a sink an filter for stormwater runoff and any chemicals potentially contained therein.
Therefore,the project would not result in the physical loss,degradation,or functional loss of ecological components or otherwise adversely impact the quality and
function of the adjacent Town Creek tidal wetland ecosystem,consistent with the goals of LWRP Policy 6 and Chapter 275 standards for issuance of a wetlands permit.
