Pursuant to our discussion during field inspection of the above referenced property yesterday, please find three (3) project plans, still dated July 24, 2025, which have been revised to indicate the 15-foot width of the existing vegetated non-turf buffer landward of the bulkhead, which was originally established by Wetlands Permit 10635 and covenanted accordingly. As you noted, the initially submitted project plan indicated the presence and limit of the buffer but failed to note the width. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposal is CONSISTENT with the LWRP as outlined below. Policy Standard 6.3 Protect and restore tidal and freshwater wetlands The catwalk Is elevated at least four feet above grade in the intertidal zone and constructed with light penetrating open grate decking so as to not impede the potential growth of vegetation beneath it. Also the length of the dock as short as possible. These mitigation measures minimize adverse impacts to the tidal wetlands. Policy Standard 9.4 Assure public access to public trust lands and navigable waters The length of the proposed dock is landward of the neighboring docks on both sides, ensuring the creek remains open to public access. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. 2 Glenn Goldsmith,President qf SOUTy Town Hall Annex A.Nicholas Krupski,Vice President , 54375 Route 25 P.O.Box 1179 Eric Sepenoski J Southold,New York 11971 Liz Gillooly G Telephone(631) 765-1892 Elizabeth Peeples Fax(631)765-6641 ©yc®UNT`1 BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD This Section For Office Use Only D E C I V E- Coastal Erosion Permit Application _Wetland Permit Application 111 Administrative Permit EJUL3025 Amendment/Transfer/Extension Received Application: D ZS Received Fee: $ Board o Southold Trustees Board of Trustees Town go Q Completed Application: 0, Z'57 Incomplete: SEQRA Classification: Type I Type II Unlisted Negative Dec. For example, the proposed dock and associated tie-off pilings would maintain a greater than 15-foot clearance from the west and east property lines;the dock and associated watercraft would be positioned well landward of the"pier line"established by the neighboring docks to the west and east;the overall length of the dock would extend well less than '/o of the total width of the waterway;and the 6'x 20'floating dock is positioned in water deeper than 30 inches measured at mean low tide. And consistent with"Best Management Practices,"the catwalk would be elevated at least 4 feet above grade in the intertidal zone, and constructed with light-penetrating open-grate decking,so as not to impede the potential growth of vegetation beneath it.The project will thus not impact navigation or create a"fragmentation of ecological communities"along the developed shoreline;result in the physical loss, degradation,or functional loss of ecological components;or otherwise adversely impact the quality or function of the adjacent tidal wetlands or waters of Richmond Creek, consistent both with the standards for permit issuance set forth by Section 275-12 and the objectives of LWRP Policy 6. w 617.20 Appendix B Short Environmental Assessment Form Instructions for Completing Part I-Project Information. The applicant or project sponsor is responsible for the completion of Part 1.Responses become part of the application for approval or funding, are subject to public review, and may be subject to further verification.
