Supervisor Martocchia opened the meeting at 3:00 P.M. with the following present: Supervisor Albert M. Martocchia Councilman James H. Rich, Jr. Justice Martin Suter Justice Louis M. Demarest Justice Francais T. Doyen Town Attorney Robert W. Tasker Highway Superintendent Raymond C. Dean Town Clerk Judith T. Terry Absent: Councilman James Homan On mo~ion of. Justice Suter, seconded by Justice Demarest, it was RESOLVED that the minutes of the Southold Town Board meetings of September 27, 1977 and October 4, 1977 be and they hereby are approved as submitted.' Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Justice Suter, Justice Dsmarest, Justice Doyen. This resolution was declared duly adopted. On motion of Councilman'Rich, seconded by Justice Demarest, it was RESOLVED that the next regular meeting of the Southold Town Board will be held at 3:00 P.M., Tuesday, October 25, 1977 at the Southold Town Hall, Main Road, Southold, New York. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Richt Justice Suter, Justice Demarest, Justice Doyen. This resolution was declared duly adopted. On motion_of Justice Suter, seconded by Councilman Rich, it was RESOLEED that the September 1977 reports of the Dog Wardens, Build- lng Department, Supervisor, Town Cl~rk be and hereby are accepted and ordered placed on file. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Ri6h,~-Justice Suter, Justice Demarest Justice Doyen. This resolution was declared duly adopted. Supervisor Martocchia: 1. Receipt of ~ letter from Town Attorney Tasker indicating that the Department of Agriculture and Markets has approved the dog contract between the Village of Greenport and Town of Southold and the Town Dog Wardens can commence enforcement in the Village of Greenport on October 1, 1977. 2. At last weeks Board meeting the Town Clerk presented the Supervisor's tentative budget to the Town Board for review. The tentative budget indicated the tax increase would be about 11¢. After review of the budget and reduction in appropriations, such as lighting fund reduction by $10,000, contingent account from $40,000 to $30,000, increased unexpended balances to being the tax increase down to 1.8¢. Last years rate was 3.385 and this years proposed rate will be 3.403, a difference of 1.8¢. If the town did not have revenue sharing funds to work with, these reductions would not have been accomplished. It is impossible to hold down the e~ployee contracts, the PBA is a two year which specifies the 1978 salaries, the CSEA has a two year contract which specifies the 1978 salaries. The appointed and elected officials did not receive raises last year, therefore raises have been included for 1978 amounting to 12 to 15% Qver a period of what would amount to a three year period. Another factor causing the slight tax increase is the raise in insurance premiums. One policy along tripled in premium. Fuel oil and gasoline for all town equipment has risen, electricity rates have increased. Copies of the budget will be made available for the pub!~c to take home by the end of this week. The budget hearing will be November 10th and its adoption will be some time after that date.---Mr. William Pell III asked how much new assessment and re- assessment since last year is the budget based on?---Supervisor Nartocchia stated approximately $1,700,000. and that is a very tentativ~ figure as stated by the Assessor's Office.---Mr. Pell stated in the Building Inspector's report of $600 000 for September, and one month last year of $900,000, if this were averaged out, the assessment raise should be over $9,000.---Justice Demarest stated that is 100% value, and not assessing ~alue, but appraisal value. The Town's equalization rate is around 12% and if yo~ take the appraisal value shown in the repor'ts of the Building Inspector and take 12% of that and there was $10 000,000 assessed valuation you would only pick up $1,200,000 in actual aasessment.---Supervisor Marto¢chia discussed the various exemptions and losses of assessment by fire and purchase of property by exempt organizations.---Mr. Pell asked how much land went off the tax rolls in 1976?---Supervisor Martocchia said that figure would have .to be gotten from the Board of Assessors.---Mrs. Gladys Csajko questioned the statement relative to no raises for town officials for three years.---Supervisor Martocchia stated there were no raises last year for appointed and elected officials. The Board makes a practice of asking for a raise on an election year, therefore there was no raise last year, there will be none in the 1979 budget, so the raise for the 1979 budget covers a period of three years.---Mrs. Charles Hickey asked how the Board bases their figures?---Supervisor Martocchia stated it is worked out so public officials receive approximately the same percentage as the contract employees. Nine years ago when he became Supervisor the salary was $18,000.---Mr. Pell asked how Southold Town compares with the other towns?---Supervisor Martocchia stated°that'on the east end perhaps he is the highest or one of the highest. He only has one job, that of Supervisor. In other towns the Supervisor has other jobs as well as that Of Supervisor. The Riverhead supervisor is also an attorney, the Easthampton supervisor gave up the job as he cannot make enough at it, on Shelter Island the supervisor also runs a store.--- Mr. Pell asked, regardless of how many. other jobs a supervisor has, isn't the responsibility the same for each supervisor?---Supervisor Martocchia stated many other towns have a deputy supervisor which they utilize heavily, and he has a staff Presently the Deputy for Southold Town has been nonsalaried until Supervisor Martocchia became ill and it was only just to compensate him for working full time as Deputy Supervisor. Supervisor Martocchia stated he puts in 24 hours as Supervisor. After he leaves the office he tours the town and keeps an eye on all areas possible. He attends sometimes tw~ and three civic association functions and meetings a day, including weekends. On motion of Councilman Rich, seconded by Justice Demarest, it was RESOLVED that a recess be called, and meeting be reconvened following a public hearing at 3:30 P.M. relative to an application for a wetland permit. Vote of the Board~ Ayes: Supervisor Martocchia, Councilman Rich, Justice Suter, Justice Demarest Justice Doyen. This resolution was declared duly adopted. (It was discovered the wetland hearing is scheduled for October 25th rather than October Llth.) Meeting reconvened at 3:35 P.M. Supervisor Martocchia: 3. Letter from the Department ~of Labor,State of New York stating that as. of January 1, 1978 aL1 units of local government will be cove~ed under the New York State Unemployment Insurance Law. They ask to be informed by January ~lst whether the Town of Southold wishes to elect the b~nef£t reimbursement or the contribution method of financing their participation in the program.---Town Attorney Tasker explained that under the unemployment a certain percentage .of the payroll is paid as an unemployment tax. Municipalities have an option. They can either do it~that way, or they can actuall~ pay the amount of unemployment fun~s~paid out to unemployed people. Th~ Town of So~thold is electing to take the latter course, to pay the unemployed person the amount .the agency pays unemployed persons rather than a percentage of tax on the payrolls---The question was asked how many unemployed ~the town would have?---Supervisor Martocchia stated that what could cause the most in payments would be school crossing guards. ~ It is necessary to work a certain amount of weeks before collecting unemployment, and school crossing guards come under the category. ~- On motion of Justice Demarest, seconded by Councilman Rich, it was RESOLVED that the New York State Department of Labor be notified that the Town of Southold elects to follow the Benefit Reimbursement Option method for financing unemploymnet insurance. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Justice Suter, Justice Demarest, Justice Doyen. This resolution was declared duly adopted. On motion.of Councilman Rich, seconded by Justice Suter, it was RESOLVED that the following audited bills be and hereby are ordered paid: General'Fund bi-l~s in the amount of $30,376.09; Highway Department~bills in the amount of $40,811.18; Fishers ~sland Ferry District bills in the amoun~ of $48,563.19. This resolution was declared~duly adopted. - On motion ~ Ju~id~S~t~ .seconded by Justice Demarest~ ~it~was RESOLVED~that this Town Board does hereby, prepare.and-approve as the preliminary budget of this Town for the fiscal year beginning. on the 1st day of January 1978, the itemized-statement of estimated revenues and expenditures hereto attached and made part of this resolution, and.~be it FURTHER,RESOLVED that.such preliminary budget shall be filed in the offic~ of the Town Clerk where it shall be available for inspection by any interested person during office hours, and be it FURTHER.RESOLVED, ~hat. the Town Clerk be and~she,hereby-is directed to cause sufficient copies of said~preliminary budget to be reproduced for public distribution, and be it FURHTER RESOLVED, that .this Board shall meet at 3:15 o'clock P.M. on the 10th day of November , 1977, for the purpose.of holding-a .public hearing upon such preliminary budget, and that after all persons attending ~s'aid hearing shall have had an opportunity to be heard in favor of or against the preliminary budget as compiled or for or against any item or items herein contained, that said hearing be then adjourned and thereafter be reconvened at.8:00 o'clock P.M. of said day for the same purposes, and-be 'it' FURTHER RESOLVED that this Board shall meet at 3:30 o'clock P.M. on t~e 10th day of November, ~977, for the purpose of holding a public hearing'on the intended use of Federal Revenue Sharing Funds, and that after all persons attending said hearing shall have had an opportunity to be heard in favor or against the intended use of Revenue Sharing Funds, as compiled or for or against any item or items therein contained, that said.~hearing be then afjourn~d and thereafter be reconvened at 8:15 o'clock P.M~ of said day for the same purposes, and be it FUR,~14ER RESOLVED that the Town Clerk give notice of such hearings in the manner provided in Section 108 of the Town Law and that such'~ notice be published in substantially the following form: 326 NOTICE OF HEARING UPON PRELIMINARY BUDGET NOTICE IS HEREBY GIVEN that the preliminary budget of the Town of~ Southold, Suffolk County, New York, for the fiscal year beginning~ January 1st, 1978, has been completed and filed in the office of the Town Clerk at Southold, New YorK-,-where is is available for~ inspection and where copies may be obtained b'y any interested person furing business hours. Considerable correspondence has been received relative _. to Goldsmith's jetty, as well as telephone calls from Joyce Burland~ County Legislator, who is unable to devote time at the present toward solving the problems at Goldsmith's inlet. She will have more time after the 15th of November to study the problem. Mrs. Burland has been cooperative in the past and they are sure she will be~ooperative again. 10. An application has been received for Fire Inspector; however at the present time the Town does not have a Fire Prevention Code. 341 11. More correspondence ha,s~been ~e~ived relative to the cut-back by the State of New York on snow~removal on Route 25. The Town has exhausted most of their contaats.~, including the County, who will not enter into a contract with the State of New York, as Suffolk ~County must go into loans to pay contracts to remove snow. The only co~ra~t the State of New York signed is with Shelter Island Highway Departm~ent. The Town is still trying to get snow fencing and to keep the local contractors, but the State has just about made up their mind to buy new equipment and store two pieces of equipment in Greenport and one' in Rivet'head.. This is going to be a problem as the only service the S~ate has in in Riverhead, and there is no backup equipment. The Yown will try to keep up with what the State can't handle, but there are many Town roads to look after. A letter has been received from the Orient Fire Department written to Givenor Carey asking that the problem be rectified~ 12. Notification has been received that in the matter of Patrolman Crimi vs. the Town of Southold, the attorney for Patrolman Crimi has withdrawn the appeal. Mr. Hartofelis asked the Board about the application he submitted at the last meeting for an addition to his snack bar at his tourist camp in East Marion, requesting a determination.---Supervisor Martocchia stated it was submitted to the Building Department for review as far as density is concerned. Mr. Terry's report says that Mr. Hartofelis would not be increasing the density because he is requesting a slab with a canopy roof and he has no disagreement with the application. It is now up to the Town Board. The Board has not discussed it as yet and will do so after this meeting. Mr. Wein~eimer asked to ~at extent the new HUD resolution going to change the requirement of low cost housing?---Supervisor Martocchia stated that originally HUD wamted to by-pass local zoning. Hud has indicated they have taken out that stipulation.---Town Attorney Tasker stated his concern is that it requires unanimous agreement of a~l members of the consortium. The basic objection that was raised by most of the municipalities was the form of the resolution that they required all municipalities to adopt, which really said that we agree to change our zoning ordinance without any regard to our master plan in order to permit low cost housing, and we are bound by State Law which requires us to ~ezone according to comprehensive zone and the a.f~fe~ts it has on the community, and we can't agree to give them a blank check to permit any type of use be located any where in the town, and that is the objection of all the other towns. Now, ~hey have removed the reference to Z~ning ordinances. The question is whether the remaining towns and villages are agreeable to go along with the new form of resolution that has been submitted and they do require all of the municipalities to agree. Mr. William Pell asked Mr. Tasker where he can get a copy of the master plan? .... Mr. Tasker stated we already have a master p~an. ~e is not going to find the master plan in one little document. The masterplan c~nsists Of all of~ t~e studies, surveys reports submitted by Raymond & May consisting of four volumes, study, and report of Malcolm Pirnie, two stUdies and report Of Cornell, the~study an~ report by Mr. Sullivan on agriculture, the zoning ordinance of the town and the zoning map of the town. Ail of these together constitute the master plan. Ail of are filed here in the Town Clerk's office. The Raymond & May. master oplan fs filed in all of the local ~ibraries, the Malcolm Pirnie Study is also filed in the local l~braries~ The zoning map is filed here and the zoning ~ode is in the code book. All of these compr±se the master plan or comprehensive plan or comprehensive plan ~or future development or development plan~---Mrs. Csajko stated some of~ the things in the matter Mr. Tasker referred to were highly objectionable. ---Mr. Tasker stated that when you hire a planning consuktant to do the study he-is hired to make recommendations, we are not required to accept every single recommendation he makes. A,form of zoning code was proposed by Raymond & May and was rejected out of hand and the town drafte~ their own. The proposed zoning map proposed by Raymond & May was not accepted totally, _changes~were.made.---Mrs. Csajko asked Mrs. Brush pr%or to this meeting iftshe could find the original zoning map that was accepted by the Pl.anning Board by resolution, and on that map there is~a big industrial area near where she lives; on subsequent ma~s that. disappeared. Mrs. Brush showed here that as the original map that was accepted.---ME. Tasker-stated that to begin-with the Planning Board does not accept or approve the map, the Town Board does. Here again, the Plannin~ Board could submit 50 maps.that in· the course of the evolution of the plan the maps were constantly being .changed, ultimately the map got to' the point that was acceptable to the Town Board and that is th'e map that was accepted in 1971 by--~ the Southold TowD Board.-:--Mrs.- Csajko stated Mrs. Neville could only find an adoption by the Planning Board.---Mr. Tasker stated they could have a map before ~them and decide to approve it and the Town Board disapprove it. The adoption of the map by the Town Board : is right.in the zoning code on the first page. The zoning map ~ actually-signed by members of the Town Board.---Mrs. Csajko stated she was trying to determine whether the original map was still in ~ tact and available to look at.---Town Attorney Tasker stated it is, and each time a change of zone is made the map is updated, but the original map signed by. the Town Board members is retained in its original state in the Town Clerk's Office.---Mr. Tasker stated that John Wickham brought to his office a couple of weeks ago a compilat.ion of everything that was ehcompassed in the process of preparing and putting into effect the master plan studies. It is believed the Board plans to have that printed and circulated so you can read a summary of what took~ place and what the various studies were and what they sh©wed.---Mrs. Csajko a~ated that they are still not saying what pa~ts of the reports they are accepting and rejecting.---Mr. Tasker stated they don't really accept o~ reject ~ study You have a study made f~rcthe purpose ~f steering you in the right' direction in the future development of the town. It is called a maste~ plan or develg~ment plan. Alt of these things combined could be called the master plan study. You do not have to actually implement. You can implement parts of Lt and .re~use to implement other partes of it.--- M£s. Csajko asked ~ho and how do you de'¢~de which pa~ts: you are goi~ to impelm~nt?---Mr. Tasker stated ~that if you looked at the s,~dies~ and they said we think the whole of Orient should be two acre zonin~ and when the. map is finally adopted is is one acre, I think you. could - conclude ~~2~ accept the master plan as suggested at two ~c~e~ zoning, because they zoned it o~e acre. So ~ou could follow the studies through and compare the %ultimate result in determining whether they particularly accepted this.recommendation or that they didn't. the Basic change the Town did not accept was the proposed ordinance that was submitted. The entire ordinance that was in existence before 1971 was redrafted. Some of the Raymond & May suggestions were embodied and others were rejected.---Supervisor Martocchia state'd that the study and summary being prepared by John Wickham will be examined by the Town Attorney and Town Board and other interested parties and when the Board feels it is ready it will be printed for distribution.--- Mr. Walter Kohnle asked whether the master p~an does not ever becoms actually a master plan until the Town Board adopts it/---Town Attorney Tasker stated that is right. The law permits the Planning Board to conduct studies provided they receive the funds from the Town Board, and one of the studies th~ Planning Board conducts is future develop- ment plans or master plans and that is what our Planning Board did To assist them they retained planning experts, water experts. When the plan is completed they submit it to the Town Board for implementation. There is nothing in the statute that says you adopt a master plan. The ~lanning Board may prepare a master plan, but they do not adopt it. They submit it to the Town Board for their consideration. He thinks that by the time the final submission to-the Town Board by the P~a~ning Board took place they pretty well impelm~nted everything that they ultimately suggested.---Mr. William Pell asked if what Mr. Tasker is saying is that we never will have a fixed master plan because every time the Board adopts a resolution for another ~m~e~dm%nt~,% what they have already voted on is amended.---Mr~ Tasker said not necessarily, 343 the Town already does have what he refers to as thick books, there are three or four of them. The r~Comm~ndations of the planners is a broad bursh recommendation. It may say, for i~ tance, that they recommend low density development along the north shore of our town- ship and a higher density along the south shore, and business uses be confined to the hamlets. Take Schriever for example - the planners said we recommend business and industry ~e.confined to the hamlets, raises a question in his application, does this conform to what they suggested, where is the boundary of the halmet? or is the proposed .property separated from the hamlet, so they don't necessarily, every time you make a change, conflict with the recommendations, most of the time you are in conformity with them. They don't go out and look at every single peice of property and suggest how it should be used, they take areas.---Mr. Pell brought Up the Norris property on the opposite end of town.---Mr. Tasker stated the master planners recommended and the courts have determined that the change in the Norris property was in confommity with what the master plan suggested.---Mr. Pell asked what Master Plan?---The Board stated they had just explained that.--- Justice Suter stated that just as in the Norris case, the people who feel the master plan has not been followed have a right to appeal to the County Court. The judge will review it to see if the Town Board stayed within the guidelines, if the judge ways you went way out, he can reverse that decision. If you are not satisified with the judges decision, you can do as they did in the Norris case, go to the App--]ate Division ans ask them to review that judge's decision, and the Appellate Division said unanimously, yes, they did follow the plan, they did conform to all the rulss and regulations and upheld us five to nothing° If you are not satisfied with that decision, you go to the Court of Appeals, the highest court in the State of New York, and they will review it to see that what was done was done properly, and legally. Therefore, the Town Bc~rd is not final there are three courts to sit over us to determine we acted properly. Mr. Hartofelis asked when he could expect a.dicision from the Town Board on his snack bar?---Supervisor Martocchia stated h~ will know at the next board meeting.
