Deputy Supervisor Demarest opened the meeting at 3~00 P.M. with the following present: Deputy Supervisor Louis M. Demarest Councilman James H Rich7 Jr. Councilman James Homan Justice Martin Suter Justice F~ancais T. Doyen Town Clerk Judith T. Terry Absent: Supervisor Albert M. Martocchia On motion of Councilman Homan, seconded by Justice Suter, it was RESOLVED that the minutes of the August 25, 1977 Southold Town Board meeting be and hereby are approved as submitted. Vote of the Town Board: Ayes: Deputy Supervisor Demarest, Councilman Rich, Councilman Homan, Justice Suter, Justice Doyen. This resolution was declared duly adopted. On motion of Justice Suter, seconded by Councilman Rich it was RESOLVED that the next regular meeting of the Southold Town Board will he'held at 3:00 P.M., Tuesday, September 27, 1977 at the Southotd Town Hall, Main Road, Southold, New York. Vote of the Town Board: Deputy Supervisor Demarest, Councilman Rich, Councilman Homan, Justice Suter, Justice Doyen. This resolution was declared duly adopted. Moved by Councilman Homan seconded by Councilman Rich, WHEREAS, the Town of Southold has received an offer of Grant ssued pursuant to Southold~Town's appl$csti~n for Federal assistance under the provisions of the'Lo~al Public Works Capital Development and Investment Act o~ 1976, as amended by-the Public Works Employment Act of 1977 in the total amount of $250,000.00 for the construction of road improvementS, WHEREAS, to comply With the requirements to receive the Off,st of Grant; (1) an individual must be authorized to sign the Offer of Grant, (2) an individual must be authorized to certify the authorized signature, (3) a bank must be authorized to hand~M the funds, (4) individuals must be authorized to withdraw funds from the bank, (5) an enginemr must be authorized to prepare the plans and specifications for the pr0je~t, and (~) anindividual must be designated as project coordinator, NOW, THEREFORE, BE IT RESOLVED by the Town of Southold: 1. that Deputy Supervisor Louis M Demarest is authorized to sign the "Off&r 'of Grant". 2. That Town Clerk Judith T. Terry is authorized to certify the Deputy Supervisor's signature on %he "Offer of Grant". 306 3. That the Valley Bank of New York be authorized as the bank to handle all transactions involving the line of credit for this project, 4. That the following two (2) individusls be authorized to withdraw funds from the Valley Bank of New York for this project: 1. Louis M. Demarest, Deputy Supervisor 2. Albert M. Martocchia, Supervisor 5. That Greeman-Pederson Associates, P.C. be authorized to prepare plans, contract documents all necessary engineering,and inspection of construction in eonnection with this project. 6. That John Robson of Greenmen-Pederson Associates, P.C. be designated as project coordinator: His duties will include quarterly reports, forms, correspondence meetings with the Economic DeVelopment Administration and all necessary work required to administer the project. (Deputy Supervisor Demarest stated that the next resolution pertaining to Offer of Grant for the Southold Town Hall addition is premature; they have ~t received the Offer of Grant yet, but it is one of the projects approved and the reason it is being offered.is there is a deadline when these Offers of Grant must be signed and submitted, and should the board not have a meeting scheduled before the deadline and the resolution is not submitted by the deadline the grant will be lost.) Notification from Department of the Army, New England Division, Waltham, Massachusetts relative to application of Richard I. Purnell, Equestrian Avenue, Fishers Island, for permission to con- struct and maintain a pile and timber pier, ramp and floa~ in Little Hay Harbor, Fishers Island. Comments must be submitted 'in writing by OCtober 11, 1977. Notification from the Department of the Army, New York District relative to application of Suffolk County Department of Public Works for maintenance dredging ahd beach nourishment 'at Cedar Beach Harbor, Little Peconic Bay, Southold. Criticisms or protests regarding the proposed work must be submitted by September 27, 1977. Notification from the Department of the Army, New York Distric{ relative to application of Albert J. Moyse, 120 Rabbit Lane, East Marion, for permission to construct groin extension at Orient Harbor, Gardiners Bay, East Marion. C~itieims or protests regarding the proposed work must be submitted by September 24, 1977. 2. A m~tter of the Town Beach concession insurance has been discussed and will be further discussed with the insurance agent. 3. Request for dredging at Jockey Creek, Southold by Charles Wissemann, Wells Avenue, Southold ~ent to the Suffolk County Depart- ment of Public Works. The DPW asks for instructions, and the Board instructed~ Deputy Supervisor Demarest to request the DPW to look into the project. 4. Communciation from the Department of Emergency ~reparedness, County of Suffolk, containin~ correspondence from people who had charge of the Southold Town Marine Rescue Unit who requested funding. The Department of Emergency Preparedness suggested the Town take care of the matter. It will be discussed before the budget is drawn up, and perhaps allocate ~ome money fo~ that p~mpose~ 5. Receipt of report from the Suffolk County Department of Health Services with results of their testings of town bathing beaches. In e~ch case. the rating is e_xcellent. ~ 6. Let~e~ from the Suffolk County Department of Labor stating the CETA Titie ~VIiI Young Adult Conservation Corps which was in operation this summer, they now intend to carry it on the year round. 7. Letter from the Suffolk County Department of Labor concerning public works projects. The Town had people working for t~m this summer under that category, and they now will return to the prior system under t~he Department of Social Services whereby they work out their gran~s a~ they did in the past. 8. Notification from the New York State Department of Environ- mental Conservation 'informing the Board of a Mariculture Symposium to be held October 22, 1977 at the Fine Arts Building, Southampton College. 9. Communication from the Department of Environmental Conserva- tion, State of New York, indicating that under a new law the Town will be required to obtain a license to operate the disposal area. (It is~only a matter of time before the Town will notCh.be permitted open dumping as they have up to the present time. Perhaps this year out of' the Federal Revenue Sharing monies, some money may be all0cated~for a capital account to eventually put in a campa~tor. Everything would be done inside ~of a building. Hopefully by that ime Long Island Lighting Company will have ~a plant that will ~burn the solid wastes so there will be~a market for them. There ~il! be several grants available from.various areas One 'now from the State which is a 50% grant. Federal grants may be even .greater. Under the new law on Federal Revenue Sharing it now allows it to be used as the town's share of matdhing funds. It is felt if the Town starts putting some mo~e~ aside it can be used for something we eventually have to have, and if the money is not available at that time it will have to be raised from taxes.) 10. Recently the 'Town made appli_catioh to acquire surplus government property on Fishers Island, known as the Fishers ~land Statio~ Quarters and' now find ~he General Services Administration will only make the property available for recreation purposes. The Board cannot imagine how they can use three houses, a warehouse and apartment building for recreation. The Fishers Island School interested in the three houses, so as of now they will notify the Bureau of Outdoor Recreation, Department of the Interior that they are hot interested, but at the same 'time they will write to the' Real Property Division-and indiCa'te as far as ~he~three houses are - concerned they are glad not to make any request for them, But the other buildings the Town can use, and if there is some other means for makin~ appli~&tiOn they will do so. 11o Request for release of ~the performance bond on inlet East Estates. The report of the engineer redommending release of' the road construction bond,' but the highway committee and highway superiD~nd~t would like to look at the roads first. On motion of Councilman Rich, seconded by Councilman Homan, it was RESOLVED that the following proclamation be issued designatin~ th~ . week of October 2 8 1977 as National 4-H Week: h~tEREAS, the 4-H program' of Cooperative Extension since its beginning 75 years agg has contributed m~e.~ to the health and welfare of the Nation and has encouraged many young people'_~o choose careers which help improve family and community living; and WHEREAS, during this week 4-H members, leaders, and families Will observe National 4-H Week with the theme: "4-H Freedom-to Be". WHEREAS, 4-H members put into practice the skills and science they learn as they develop their talents through 4-H projects and strive to "learn for living;" WHEREAS, in these changing times young people', who are the citizens of tomorrow, must discover and acquire the virtues of responsibility, thoughtfulness, morality and understanding; WHEREAS, the more than 500 volunteers adult 4-H leader~ are organizing their 4-H clubs for the 1977-78 year, many others are organizing clubs for' the first time; and WHEREAS, the nearly 74,000 boys and firls participating in programs throughout Suffolk County soon will be taking their places in socisty by establishing homes of their own and joining the ranks of community leaders. On motion of Councilman Homan, seconded by Justice Suter, it was RESOLVED that the request of the North Fo~rk Taxpayers Association, Inc. be' and hereby is denied permission to use the SouthOld Town Hal~for'a general meeting during the week of October 24-28; which. meeting would be a "Meet Your Candidates" night. This type of a meeting has political overtones and a precedent should not be set in this respect. Receipt of a letter from.Peter E'.-Lynch, Jr., relative dredging West Lake in Cedar Beach,. Deputy SuPervisor ~emarest has informed Mr. Carl Eisenschmeid of the Suffolk Cgunty Department~.qf. Public Works and he will follow up the request. 16. Receipt of a letter from Sunset Motel, Route 27 A, G~eenport complaining about the mgsquito problem that exists in their area. The mosquito control is no longer under the jurisdiction of the Suffolk County Mosquito Commission; it now handled by Suffolk ~ County Vector Control which is very ineffective. However, Deputy Supervisor Demarest will get in touch with them and advise them of Sunset Motel's problem. 17. Letter from M~s. Gilda (Lawrence) Dodge, Mattituc~, sta~ing the sandy beach in front of the home she and her husband purchased five years ago i~ Do longer there, and the retaining wall which was buried in the sand is now exposed to a height of five feet. She asks if the T~wn could again dredge Brushes creek as they'~id $0m~ years in the past and put the sand back on' the beaches.---Justice Suter stated there is an application on file with the County to ~re~ge Brushes Creek. 18.: Letter- from Dorothy Auer, Mineola, New York, complaining about the number of people who sre liniqg both sides of Route 25 along 'the seawall between E~st Marion and Orient.---Deputy.Supervisor Demar'est stated he,has witnessed this himself. Most of this la~d at the shore is owned by the State, a little by the Town, and some narrow pieces by individual property owners. More and more people are co~.~ng to the east end ofr a day on weekends and seeking beach areas. If the regulated beaches are fil,~ed, the people search for o~h~e~ beach area to hold a.picnic or swim. The ~qad across the camsewaY is State Route 25; signs have been erected but they are pulled down as fast as they are erected. Deputy~Superv~sor Demarest stated they had not discussed it as,~yet.as they.were waiting for Dr. Slater to submit cost figures. He suggested Dr. Slater talk to the building mnspector Howard Terry to see if he has any suggestions.--- Dr. Slater stated since a newspaper article appeared on this proposed project they have had considerable interest. He suggested individuals might be employed through the CETA program to work on the project.w-- Deputy Supervisor Dema~est stated they have several CETA employees workSng for the town at the present time.---Dr. Slater asked what had happened in consideration of making the town hall addition and removal of the existing old building?---Deputy Supervisor Demarest stated they are waiting for an offer of grant to replace it.--- Dr. Slater asked what needs to be done for a non-profit organization to be considered for receiving the old building for a cultural arts center in the area?-,-Deputy Supervisor Demarest-stated if there were several organizations (non-~rofit) who wishes the building, the Board would have to make a choice of who it would go to. It is an historical building and consideration would be given as to whether the building would be maintained in its present state of completely changed.- Steve Katz asked whether the County is going to pay for buying the 12 passenger bus or are they also going to pay for the modifications?--- Deputy Supervisor Demarest stated the modifications would be put into the specifications when the bid is released and the cost would ha~e to be within a certain range. Mr. Katz asked what is happening with the recreation center? .... Deputy Supervisor Demarest stated that right now the money the Town was supposed to get in the third grant is tied up because none of the participants in the consortium signed to give away their right to control the zoning of la nd in their townships. The feeling is amon~ the people who are knowledgable of the law that it would be illegal to pass a resolution which would in fact allow income multiple housing anywhere the county wished to have it placed. It would be granting zon~ing without a hearing.---Mr. Katz asked if the Board if rejecting the proposed resolution the county sent down or are you waiting to see what happens next?---Deputy Supervisor Demarest stated that as far as the resolution is concerned, he can state for all the members of the Town Board, and every'.~her member of the consortium except perhaps Riverhead, they will not sign it. He has met with most of the members of the consortium in Mr. Klein's office ~n Hauppauge, and they will not sign it, and if they did sign it, it wou~d lead to law suits, because the min~te a change of zone ~as granted based on the res91ution, there would'be a law s~it, and the lawyers felt no court in the State of New York would alt~o~w,~the change of zone.~--Mr. Katz asked if anything was being done_to p~ess the issue?---Deputy Supervisor Demarest stated the proposal a~ the meeting was that they contact some one in authority at the Housing a~d Urban Develppment in Washington and send a delegation there to see if it can be changed.
