SOUTHOLD TOWN'BOARD
August 25, !977
A regular meeting of the Southold Town Board was held on Thursday,
August 25, 1977 at the Southold Town Hall, Main Road, Southold, New
York. Deputy Supervisor Demarest opened the meeting at 3:00 P.M.
With the following present:

On motion of Justice Suter seconded by Councilman Homan, it was

1. Receipt of letters from the North Fork Volunteer Fireman's
Associat~ion and the Long Island Gasoline Retailers Association, Inc.
relative to self-service gas stations. The Board discussed the matter
at some length. The Chairman of the Board of Appeals has accumulated
quite ~ bit of information on th~ subject and the Board will ask Mr.
Gillispie for that information and then try to come up with .,some
decision as to how self-service gas stations will be handled'.
2. A resolution has been received from the Fishers Island Ferry
District requesting permission to make a change in the existing ferry
boa% ramp to accomodate the proposed new vessel. A dock builder is
at the Island now installing new dolphins, but before he can make
the cha_nge to the ramp permission is required from the Town Board.
The wo_r~k~ will be done for.under $2,500. which does not necessitate a
bid.
On motion of Cguncilman Rich, seconded bY Justice Su~er, it was
RESOLVED, that the Fishers Island Ferry District be.and hereby are
authorized to engaqe_a contractor to install a three p~le cluster
on the east side of the ferry bbat ramp ~nd one p~le be replaced on
the south end of the existing pier to accomdoda~ the proposed new
vessel which will replace the M/V Olinda.

3. Receipt of a letter from~Robert L. Fraser, author and
publisher of Town Law for Town ~fficials. The town ha~ approximately

10 copies of the publication. An annual supplement is received each
year containing changes made by the legislature. Formerly Mr. Fraser
had General Code Corp. furnish the book and supplements, however, they
no longer have a contract ~nd Mr. Fraser is going to supply them himself.
The supplements will be sent to the Town Clerk and then distributed to
the book holders.
4. A report has been received from Chief Cataldo relative to the
sale of various items on August 13th. A memorandum of sale for each
item is included in the report; total monies collected was $345.00.
5. Notification has been received of a legal ~o~i~ against one
of the police officers for alleged police brutality. The matter will
be turned over to the insurance company.
6. Receipt of a letter from John T. Beck, Sr. r~portin~ a~
bicycl~ a:~cide'nt h~s ~0~ h~ on Pequash Avenue, Cutchogue'i~'al'leqedlY
caused by ~soft grav~l~'in the~ro~d. Mr.'Beck is interested ih having

7. From the Office of the County Exechtive has been receiged a
copy of an agreement whereby the County will install traffic control
signals on Route 27 A/' ~i~le Road, ~i~h wi~kham Avenue,Mattituck
8. Receipt of a lette~ frOm'Wiedersum Ass~dia't~s stating
Morchel Heating & Air Conditioning ~ c~mpleted its work on the
addition to the Southold Town Hall and final payment is now in order.
9. Notification from"the 'Department of Env'ironmental Conservation
of a hearing Se~tember 14, i977~at 10~00 A.M., Suffolk County Legis-
lative Meeting Room, County Center', Riverhead, upon application of
Ralph T. Preston, Inc. for Albert J. Moyse for permission to extend
an existing 9etty by additional 2~~ lin. ft. at Mr. Moyse's property

11. Receipt of a petition from residents around James Creek,
Mattituck, stating all of the necessary permits and paperwork have
been approved for the' dredging of the entrance to James Creek.. Deputy
Supervis6r~Demarest has ch~6~ed On ~he ma'tter, an~ all that~i'~ needed
now to accomplish the dredg~n~ is for a resolution to be~a~opted by
the Suffolk 'Cou~t~ Legisi~ture for funding.
12. Letter from the Long island Lighting'Company asking what
services the Town will-require Of them with regards to the prop6ged
community center on Peconic Lane, Peconic. At the present time that
information is not available.
13. Letter from the Automobile Club ~f New York stating the --~
Town of Southold has been awarded a Pe'dest~ia:n Safety citation for
achieving a record 'of having no pedestrian fatalaties in the last
three years. 'There w'ill'*be a ldncheon on s~ptemb~r 19th at the'
Tavern-'on-'th~e-Green, Central ?ark West, New York City to honor the
the Town of Southold and other award-winning communities in this
area. There is also a press release which will be released next
month. It is not believed anyone W~ll attend the ~un~heon.
14. Receipt of a letter from the Suffolk County office for the
Aging stating any program which the Town initiates for sen~or
citizens must be readily accessible to handicapped persons, except
where structural changes are necessary.

15. Receipt of a letter from County Legislator Joyce Burland
stating the Senior Action Mobile Van will be at the SouthOld Town
Hall _on Wednesday~ Septembe~ 7th from 10 A.M. to 12 noon. It will
be parked i~ front o~ the Town Hall, but in case of rain the Town
Hall will be' made available.
16. Request for a street l~ght in the east-west lighting district
Greenport, by Mary A. Heaney, Eighth Street. Councilman Homan stated
the request will be considered when they go into the new lights in
that area. At the present time the Town is converting the old lights,
and no n~w lights have been granted in some time.
1'7. Receipt of a copy of a resolution from the Town of Shelter
Island stating they would back a bil~ which has been introduced in
the State Legislature make, for a certain period to time, any energy
saving device such as solar energy, be free of assessment. The Town
of Southold has not received a copy of that particular bill as yet.
18. Receipt of a letter from George S. Case, Treasurer of the
Cutchogue Free Library, seeking an increase in the amount of monies
the Town has allocated to the libraries. At budget time the request
will be taken into consideration.
19. Letter from 11 year old Lisa Harris, Kenney's Road, Southold,
suggesting 'the Town install a ~loat at Ken~eys Beach. ~ighway
Superintendent Dean advised the Board that due to the vandalism,
shch as burning the lifeguard stands at Kenney's Beach it is question-
able whether they would have much success with a float; however, it
will be considered for another year. - ~ -
20. Receipt Of a letter fr~m Town Hall, Southwold, England,' -
expr~ss%ng the pleasure of having. Southold Town send a telegram
on the Silver Jubilee of Her'Majesty the Queen. They enclosed a
puog~am of the Silver Jubilee with a picture of the Queen enclosed,
along'with Southold Tomb's message.
On motion of Councilman Rich~ seconded by Councilman Homan~ i~ was
RESOLVED, that the cluster concept subdivision 'of Wilsberg~ east of
Brown'S Hills, Orient, he'and hereby is approved by the Southold
Town Board~

Deputy Supervisor Demarest:
21. A request has been r~ceived for a-.~o parkin~ sign on East
Inlet Lane, Greenport,. in the Vicinit~ of the breakwater. Mr. Dean
is checking to determine if that is in fact a town road.
22. Item 15 on the agenda referring to approval of roads in
Orient, pertains to property just east of Truman's Beach The
center'of the parcel has been sold and there are two pieces on each
side with proposed roads which are not up to town specifications.
This would be a matter for the Planning Board as to whether such
roads would be allowed, however, the developer requested approval
of the highway ~ommittee, and a decision wi~ be forthcoming in a
short time.
On motion of Councilman Homan, seconded by Justice Suter, it was
RESOLVED that a letter be sent to Philip W. Mc Grade, Chief
Regulatory Branch, Department of the Armyj N.Y. District, Corps of
Engineers commenting on the 'application of Long Island Lighting
company'for installation Of jettieS at the proposed nuclear plant
at Jamesport; a~d the installation of inlet and outlet pipes for
water and some dredging.

On motion of Councilman Homan, seconded by Councilman Rich, it was
RESOLVED, that Fishers Island Ferry DistriCt fu-nds in the amount of
$96.44 be and hereby are transferred from the Theatre Account to
Property Tax.

pays ~ax to the city of New London, Connecticut for the property
they ~wn for their ferry landing. They had ~2700.00 in th~ budget
for' it and Were $96.44~ort.)

Deputy, Supervisor Demarest explained that~he meeting of the Board
was b~ing held this date, Thursday, .because the Town Clerk, Tow~ ..
Attorney and he went to New York City on Tuesday to sign for the
Fishers Island Ferry District.---He stated that when the credit of
the Town Was discussed at the New York meeting, when drawing up
the prospectus they went over the town's financial goDditioD and ..
were quite amazed to see a town in th~ financial state~th~ town
is; and that coupled ~ith an article in the New York Time~ last
year that rated at i00% evaluation the Town of So~thold had the
second lowest rate of any municipality within 125 miles of
New York City. The Board over the years deserves a lot of c~edit
for runni~ the town in the sound financial manner it has.
Mr John G. Joannides of 49 Sound Beach Drive, Mattituck, presented
a petition from the residents of Sound Beach Drive in Mattituck,
requesting the Town pla~e signs banning, any motorized vehicles from
riding on the beaches in front of their home~~ during the summer season .......
The vehicles are jeopardizing the lives of their children add have-
become a nuisance. The petition contained 23 names.---Mr. Johnn~des
elaborated on the p~ition, stating motorcycles and other vehicles
drive at high unsafe speeds ~uring the day and during the night.
They go so close as to even pass over the edge of beach blanket~,
where the residents are sitting. Children have been near victims,
only saved in a few incidents_by quick action of their parents or
other residents. He cited Fire Island as having banned vehicles f,rom
the beaches.---Deputy Supervisor Demarest stated that Fire Island is

totally government controlle~ in most cases.---Town Attorney,~asker
statad that there are two different jurisdictions. The area above
hi~hwater mark is private property and anyone using it is tresspassing.
All that n~ed be done is file an information. Below high Water mark
the land belongs to the State of Ne~-¥ork. This question has come up
many times. Several years ago the Town was in Contact with the Attorney
General and asked if he wished the State to do anything and he didn't
want to-get-involved. Therefore it raises the question as %o whether
or not the Town of Southold. has the legal authority to regulate the
use of State owned land below the ordinary high water mark. Above it
i~ is private property.---Mr. D.G. Witschieben, a resident of Sound
Beach Drive, concurred with and elaborated upon Mr. Johnnides' 'state-
ments. He stated that the trucks and other vecicles are gaining~
access through public access roads and are breaking down the banks.
they have no mufflers, remove their license plates .so they cannot be
identified, ride day and night at high speeds. He feels the town
should put up signs and chains to stop all access to the beach.---
Deputy Supervisor Demarest stated they could consider cutting off
access, but the gates have been torn down, and it is almost impossible
to catch the .offenders. As far as a public nuisance is concerned,
someone must~make the accusation in court; there is a provision in
the law to take care of it~---Ju'stice Suter stated that he hai had -
10 motorcycle convic~6ns~ in the past two weeks, so they are apprehend-
lng the~offenders as they catch them, but they can't catch them'aL1.
the Park District is keeping the gates open because they have lost so
many gates they gave up. They also tear the signs down.---Mrs. Johnnides
stated she called the police a week ago because her child was almost
killed by an 11 year old child driving a motorcycle, and the police
stated once they are off public property there is nothing they can
d~about it.--~Deputy Supervisor Demarest stated that is true, .once
they a~e off -public property they do not need a license, nor license
plaCes.---Mr. Witschieben asked that the town pass a resolution to
stop.~e~icles from riding on private property.---Town Attorney Tasker
stated the town does not have the authority to pass such a regulation.
If someone drives a vehicle, or walks on private property without
permission :that is tresspass. As far as public nuisance as far
as the:Penal Law is concerned, it takes seven or mo~e people to be
annoyed to bring a charge that would stand up in court.----Mr.
Witschieben contin, ued to request the To~n Board to ~ake ~action to
prOtect-them against ~he problem of tresspassers and violators.---
Deputy_Supervisor ~Demarest stated they would consider it and do what
th~ law a'llo~s them to do.--Mr. Witschieben continued to pursue this
mat~er at 1.ength.
Cka-rtes Hickey, Sou.thold, asked if something coaldn't be done
about Kenney's ~ea'ch, bnnning of the life guard stands, and so forth.
Cou~d-n't the police make some extra :trips to try and catch someone
in the~ act of ~anda:lism?~--Deputy Supervisor Demarest stated he is
certain they are keeping a better watch on it. tt is believed they
have ~ames of some of the persons suspected of the vandalism.
Mr. Henry Lytle, Peconic, stated at a meeting of the Southold-Peconic
Civic Association the other night the matter of the hazard which has
been created by the new p~rkin~ lot east ~of Chinam was discussed. It
is sugg.ested that some sort of barrier or poles be erected Which would
force people to exit ~orth to Traveler Street rather then onto the
Main Road by way of the Chinam parking lot.---Highway Superintendent
Dea~ said that procedure was discussed, but Chinam said they didn't
care~:i~f people parked in~ the' new parking lot and the.~, drove out through
th.eir ~parking lot ~:0 exit. However, the: matter of exiting onto the
Main~Road is a problem and hazard and will be looked into.
Gene~eve.L. Richards, Southold, New ~ork, read the following letter
to the ~Town Board whi'ch she asked be entered in full in the ~inutes:
"August: 25, 19~77, Southold, N.Y.
Good Afternoon, members of the Board--I wish to introduce myself
as Genevieve L. Richards. I have been a Southold Town resident for
53 years, 30 of which I_have been a taxpayer, as was my father before
me, a~d members of my family are at this time. I won the historical
land (as.so designated with an appropriate plaque erected by Southold
Town) and residential property on the north side of Route 25, Main
Road, Southold, New York, beginning at the east side of Mill Creek
Bridge and extending east to.the Railroad Bridge. My home, .which is~
my present residence is located on this property. From the inception
of this bridge project, of which I was not made cognizant--legally,
my family and I have endured many hardships, such as the taking~of
my land at a price far below its current real estate value for
waterfront property, the devaluation of my property and the negative
effects on.my property and this area regarding its conservation
laws--the contradiction of which resulted from dredging, r-emoval of
valuable soil, accumulation of garbage., tidal waves and disturbanc~
of wild life. Now, incredible, though it sounds, .I am being asked
to take a small sum of money, because I am being denied the right to
live in peace and quiet in my own home, on my own property~ This.
God-given right is f~damently guaranteed to us by our government,
and enjoyed by you members of the board and your families as weLt~
Let me digress here---to clarify that again, in this instance, as
aforementioned (regarding the taking of of myproperty) I was not
made knowledgeable--before the above ~offer--of the plans of the
Department of_Transportation, and/or Lizza Industries in conjunction
with this board (who, I understand, granted permission for this 24
hour work shift of excessive mechanical noise of both night and day
duration-. The Town Board~has seemingly completely ignored my ~ight
in this matter~ I can appreciate that the increase of work.hours
would accelerate the completion of the new bridge, however, if it is
accomplished ~n accelerated time., it~will be done at my expense and
with no regard for me as a human being, Southold Town r~sident,property
and h~me owner and taxpayer~ I ask you, please, to envision, _if you
will, members .of this board, that, bein~ alone, I must work to keep
my home and proDert~.and to earn my living expenses. It is necessary
that I ar~se at a very early hour to report promptly to my position.
I must have proper and sufficient rest. I challenge any of you to
be able to have such rest with the. noise of back hoes~ pneumatic
drills, pile drivers--the rumbling of huge trucks, etc, which the
foreman informed me will be utilized in this 24 hour work shift.~
The loud voices alone would be a nightly distrubance in any residential
area--notwithstanding the constant mechanical clamor~ Therefore, I .am
here now to ask this Board to kindly rescind the permission you have
given to allow this 24 hour work shift and thereby protect, and not
depr~ve me of my God-given, legal right to l~ve in my own home, and
on my own property--~n peace and quiet, l I wish to request the Southold
Town Board to please record a copy of my remarks today and a copy of
an itemized list of expenditures that would be necessary if I am forced
to leave my home. Thank you. These figures represent the estimated
cost of being forced to leave my home and live in a motel. ~n accurate
account cannot be presented at this time. (and these are minimum figuresl

Deputy Supervisor Demarest stated he is not goimg to let her blame
the Town Board, the foreman come to him and asked if the Town would
have any objections to their accelerating the work by working shifts
beyond the eight hour shifts. Becuase ~his project has been a thorn
in the side of many people in the whole of Southold Town, he stated,
in speaking for the Town, they had no objection to getting the job
done as rapidly as it could be dohe. He subsequently had a call from
Mrs. Richards and he contacted the Department of Transportation and
asked them about Lizza Construction working extra shifts and

they-said they had no jurisdiction over them as to the number of
hours they-worked. Deputy Supervisor Demarest also talked to Mrs.
Burland, whom Mrs. Richards also contacted, and at her suggestion,
~e believed, Lizza Construction offered Mrs. Richards housing in
another ~rea.---Mrs. Richards stated that is not ~rue. She would
like to know why the Town Board gave permission to a private industry
know, ing- she would not be able to live~-in her home, sleep, rest.---
Deputy-Supervisor Demarest stated that when the foreman came in and
asked if the to%rn had amy objection, he told him at %he time he didn't
think the town had any jurisdidtion to tell him wheth~ he could or
couldn~'t work, I didn't give,permission, the Town has no authority
to give-approval, but he felt with all the trouble the town has had
with merchants in the area and traffic problems, the town would be
happy to see the job done, and if it took extra hours to do it, we
woul,d~ ha~e an~.objection. He also~ told him ~to make ~sure to'.contact
anyone in~_the area who lived there on a permanent basis.~--Mr$. Richards
sta%e~th~re-isn'~t ~nyone else there, everyone else is business.--~
Deputy iS~pervisor Demarest stated the~foreman said he would see Mrs.
Rich-ards%q--Mrs. Richards stated the foreman offered~her $100 a'week,
an~3i~ ~i-s impossible to live and eat ou~ for $100.00 a week. She asked
tha~ ~be Board rescind~their-permissionl---Town Attorney ~asker stated
that he thinks wha~ she is requesting is that perhaps the person who
indicated~.to the contracto~ that we had no objection-now indicate that
we ~o-have an obj~ection. That would be ~he most the to~n could do
because the town has no authority to require th~m ~to work overtime or
not work overtime. W/~at we have is the right to evidence our concern.---
Deputy Supervisor Demarest stated that he informed the Board, at a
meeting subsequent to his meeting with the foreman, of the action
he had taken, and they no way_ indicated he w~s wrong in the assessment
of having them go ahead and trying to. get the bridge done. He will
now, after this m~e~ing is over, meetwith the Board and if they
indicate they~want him to, ke will inform Lizza ~hat the Town' does
now have objection.---Mrs. Richards stated they have an alternative,
she has submitted a list of m~nimu~m expenses, if they want to go alomg
with that she will give some thought to leaving her home while the work
continues.
The question of the LI,LCO pla~t jetties was brought up by Mr. Witschieben
---Deputy Supervisor Demarest stated he does not believe they have any
permits as yet either by the Pederal or State government or Corps of
Engineers. He and Mr. Dean went to the office of the Attorney
General in New York City and indicated that if they put the plants in
there the jetties are going to be necessary. The Attorney General
will give testimony , it is believed to the Corps of Engineers, and
their idea was that the dredging that would be done initially would
be spread to the east of their proposed jetties to build up the beach
along the part that has been eroded. Mr. Dean and he suggested that
once this is done that they erect some short groins to hold it there
and in their proposal they indiciate that once there is a 5,000 yd.
imbalance in the amount that either left ar built up on ~e other side
immediately LILCO would have to transfer and put it from one side to
,the other. They intended to pump some 600,000 yards of fill from
between the two jetties to get the depth of water for~ their intake
and outlet pipes and that would be spread 2,500 feet to the east and
he suggested that in their proposal to the Corps of Engineers that
when that was put down there something be put on top of it, short
groins, to hold that there so it would remain.
The question was asked about the matter in the newspaper about the
HUD funds. It was recalled that about six months ago when it was

member of the board replied that the intent of the federal government
in giving HTJD funds was for urban development and rehabilitate homes
for the needy. At that time it was said the Board had permission from
the powers to be to use the funds for a senior citizen center and a
child care center was this given to the Board £n writing before the
town went into the expense of buying the property?---Deputy Supervfsor
Dema~est explained _that there was ~no ~expense 'to buy the p~operty, as
it was: the~ first year allotment of HUD funds. The town did not have
a written guar~antee that they would get all of the money for the-.i
project.~ The federal government, for-some reason or another, is
allowed to change the~rules as they go along. He-received a call
today-from Kerrin'Barnes, director.of.the low income housing _aspect
of ~th~e program, and there is to be_a meeting in Hauppauge to try and
straighten ~he matter ou~ and make recommendations to HUD in Washington
to see whether some of their~requirements can be waived. It is believed
the~e~has~been such a violent reaction ~to some of their criteria that
mus~ ben_followed to get the%final payment they are beginning tod~ange
their ideas~
Dr. Myron Stater, ~37 Sunset Lane, Greenport, Greenport Presbyterian
minister, ~spoke to the~Baord about a proposed cultural program'. The
No~th Fo~k Choral is starting up again in September and he proposes
a s?inging eh~istmas tree. It has been done twice in the United Statesm
in North Carolina and Kansas. He was involved in such a christma~s
tr~e ~in Frankfurt, Germany, although that was a stationar~ pro~ec~.
He would like to see what it. would cost the town to involve themselves
in ~he making of this project so'the~.~North Fork Choral people could
utilize it in carolling up and down the North Fork, and be used ~ear
after year. Dr. Slater had blueprints for the construction of th~s
tree~--Dep~ty~Supervisor-Demarest.stated it might very well be .
feasible and might be a project the town might wish to be involved
in. The Board will discuss and get in touch with Dr. Slater.
